WHEREAS, the Riverview

Association (REDA) holds a block party permit for Cinco de Mayo to be
WHEItEAS, Saint Paul Parks and Recreation is assisting in the organizarion of a one-day softball tournament on May 5, 2009 m
connection with the Cinco de Mayo hollday, but sepazate from the block party, to be held at the EI Rio Vista ballfields; and
WHEREAS, IZEDA has control of the area witirin the block party pemut limits which includes the ballfields on which the
toumament would take place, and wishes to be indemnified in the event of any claims resultutg from the tournament because it
is being held within the block pazty azea; and
WHEREAS, the Saint Pau] Ciry Council finds that this athletic events is a legitimate public purpose which fosters a stronger
West Side commumty and acknowledges the Cinco de Mayo holiday; and
RESOLVED, that the Council of the City of Saim Paul on behalf of the City of Saint Paul hereby agiees to defend, mdemmfy,
and hold REDA harmless from any and all suits, claims, actions, or judgments for injunes arising out of the soRball toumament;

FURTHER RESOLVED, that the foregoing defense and indemnification does not cover any occurrences or events which are not
part of the toumament and which do not occur or take place at the El Rio Vista ballfields during the course of the toumament,
nor injunes which azise out of ciiminal actions, assaults, battexies or other acts of violence committed by any peison or persons;

FINALLY RESOLVED, ihat nothing in the foregoing provisions shall be conshued as a waiver of the municipal torY liability
limits set forth in Minu. Stat. § 466A1 et seq.

Pazks and Recreation is assisting in the organization of a one day softball toumament to be held on May 5, in connection with the
Cinco de Mayo holiday, to be held at the EI Rio Vista ballfields. REDA (R.iverniew Economic Development Association) holds a
block party permit for the Cinco de Mayo event, which includes [he ballfields at El Rio. REDA wishes to be indemnfied for any
