RESOLVED, that upon appeal of Sam.Taruscio from the
decision of the Commissioner of Parks, Playgrounds and Public
Buildings, there is hereby established a 23 foot building line
on Hoyt Avenue for all of Lot 10, B16ok 4, Ufton Grove Thiid
Plat' and an 8 foot building line on Greenbrier Street for

appeal of Sam Ta.ruscio for the establishment of a 23 -ft. building line on
Hoyt Ave. and an 8 -ft. building line on Greenbrier St., also described as
Lots 10, 11 and 12, Block 4. Ufton Grove Third Plat, in accordance with
appellant's letters dated August 5th, August 7th and August 8th, 1958.

This is in the matter of the appeal of Mr. Sam- TAYuscio to establish a new
building line on property located adjacent to the northwest corner of Green-
brier Street and Hoyt Avenue. 'The property under consideration is described
as Lots 10, 11, and 12; Block 4; Ufton Grove Third Plat. This-property, which
has been zoned ''A "' Residence since 1922, has a frontage of 113.92' on E. Hoyt
Avnue and 115:56' on Greenbrier Street.
Mr. Taruscio is the owner of the east 50' of the above property, and proposes
to construct a single family home on this portion. Under the provisions of
the Zoning Code the set-back-from Greenbrier Street is 23' and from Hoyt Avenue
is'4', The applicant proposes to construct his home so that the set -back would
be 23' from Hoyt Avenue and 8' from Greenbrier Street.
In support of his proposal, the applicant has submitted a letter from the pro-
perty owners adjoining on the north and west agreeing to the establishment of
a 23' set back from Hoyt Avenue for all of Lot 10, and an 8' set back from
Greenbrier Street for'lots 10 and 11.
The adjacent land uses are as follows: East across Greenbrier Street are
single family residences fronting on Hoyt Avenue; west and adjoining is a
vacant undeveloped lot fronting on Hoyt Avenue; south across Hoyt Avenue are
single family residences fronting on,Hoyt Avenue; north and adjoining, vacant
land. ,
The Board of Zoning finds that the strict application of the present set -back
requirements from Hoyt Avenue results in practical difficulties in the develop
went of this property and that the proposed use and change in the building line,
if granted, will not be materially detrimental to the adjacent property. Fur-
ther, the proposed development will result in less population density than
would be allowed under the original platting.
In consideration of these factors, the Board of Zoning recommends that a 23'
building line be established on Hoyt Avenue for all'of lot 10, and an 8' build=
ing line be established on Greenbrier:Street for Lots 10 and 11; Block 4, Ufton
Grove Third Plat in accordance with the attached letters dated August 5, and
August 7,, -and August 8, 1958.
