1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame duplex located on property hereinafter
4 refened to as the "Subject Property" and commonly lrnown as 334 STINSON STREET. This
5 property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of SaFety and Inspections on or before June 9, 2008, the
following are the now known interested or responsible parties for the Subject Property: US Bank
Na/Co Americas Servicing, 3476 Stateveiew Blvd, Fort Mill, SC 29715; Reiter & Schiller, 25 N
Dale St, 2" Floor, St. Paul, MN 55102; George Farkas, 480 W. Highway 96, Shoreview, MN
55126; District 6 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated August 12, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structiu located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September ll, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 9, 2008 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the structure to be completed within fifteen (15) days after the date of the
Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 7, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefare
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 334 STINSON STREET.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subj ect Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Deparhnent of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within tifteen (15) days after the date of the Council
Hearing.
2. If the a6ove corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incuned against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.

The building is a one and one-half story, wood frame, single-family dwelling, on a lot of 3,920
square feet.
According to our files, it has been a vacant building since May 16, 2008.
The current properry owner is US Bank NA c/o America's Servicing, per AMANDA and
Ramsey county property records.
The City of St. Paul has boazded this building to secure it from trespass.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2008.
There have been two (2) WORK ORDERS issued for:
- Boazding
On July 9, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on August 12, 2008 with a compliance date of
September 11, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $30,700 on the land and $62,900 on the
building.
As of December 5, 2008, the $5,000.00 performance bond has not been posted.
As of October 20, 2008, a Code Compliance inspection has been completed.
Real Estate taxes aze current.
Code Enforcement Officers estimate the cost to repair this structure is $40,000-$50,000. The
estimated cost to Demolish is $6,548 to $9,548.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property

remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demolition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
334 STINSON ST
and legally described as follows, to wit:
FRONT ST. ADDITION TO THE CITY OF ST. PAUL, RAMSEY CO., MINN. LOT
2 BLK 2
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On July 9, 2008, a Building Deficiency Inspection Report was compiled and the following
condirions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Bnilding Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame duplex.
Interior
L The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling unit(s).
FURNACE: Have a licensed heating contractor service and clean the fumace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a permit.
4. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
5. There are missing or defective guardrails. Provide all stairways, porches,
decks or steps which are more than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.
6. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
7. The interior wa11s are defective. Repair all wall defects and finish in a
professional manner.
There is evidence of a rodent infestation. Imxnediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
9. SANITATION: Immediately remove improperly stared or accumulated refuse
including; garbage, rubbish, junk, vehicle parts, wood, metal, recycling
materials, household items, building materials, rubble, rires, etc., from yard.
The Saint Paul Legislative Code requires all exterior property areas to be
maintained in a clean and sanitary condition. Usable materials must be stared
in an approved manner, so as not to constitute a nuisance.

10. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
11. Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
12. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
13. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
Exterior
14. The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
15. The eaves and soffits are in a state of disrepair ar deterioration. Repair all
defects, holes, breaks, loose or rotting boazds, to a professional state of
maintenance. Permit may be required.
16. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
17. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
] 8. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by September 11, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrarive costs
and demolition wsts will be assessed against the property ta�ces as a special assessment in
accardance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parCies.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of 5afety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced property was inspected and the following report is
submitted;
BUILDING
1. Replace deteriorated reaz deck and stairway in approved manner. Permit and plan
approval required for work.
2. Provide access and ventilation per code at crawl space under front porch. Repair
floor structure as necessary.
3. Replace or repair siding as necessary.
4. Remove water damaged wa11 covering in basement. Replace rotted structural
components. Remove unnecessary rotted components. Remove mold and mildew
from remaining surfaces including in upstairs closet.
5. Remove or replace stairway carpet in approved manner.
6. Replace basement exterior walkout door with weather sealed exterior door with sill
draining to exterior.
7. Install weather seal at structure of siding with foundation. Cover exposed insulation
and framing.
8. Insure basement cellar floor is even, is cleanable, and hall holed are filled.
9. Tuck point interior/exterior foundation.
10. Install floor covering in the kitchen that is impervious to water.
11. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
12. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
13. Provide storms and screens complete and in good repair for all door and window
opemngs.
14. Repair walls and ceilings throughout as necessary.
15. Provide hand and guardrails on all stairways and steps as per attachment.
16. Prepare and paint interior and exterior as necessary (take the necessary precautions if
lead base paintis present).

BUILDING
17. All bedroom windows shall meet emergency egress requirements (20: wide
minimum, 24" high minimum but not less than 5.7 sq. ft. overall).
18. Provide smoke detectors as per the Minnesota State Building Code.
19. Repair soffit, fascia trim, etc. as necessary.
20. Provide proper drainage around house to direct water away from foundation.
21. Replace house roof covering and vent to code.
ELECTRICAL
1. Ground the electrical service to the water service within 5' of the entrance point of
the water service.
2. Bond around water meter with a copper wire sized for the electrical service per
Article 250 ofthe NEC.
3. Provide a complete circuit directory at service panel.
4. Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen
appliance circuit.
5. Install "S" type fuse adapters and proper size "S" fuses/ listed circuit breakers.
6. Verify that fuse/circuit breaker amperage matches wire size.
7. Close open knockouts in service panel/junction boxes with knockouts seals.
8. Properly strap cables and conduits in basement or service conduit on the exterior of
the house.
9. Install/replace GFCI receptacle in first and second floor bathroom adjacent to the
sink.
10. Ground bathroom light in first and second floor bathroom and disconnect receptacle
on fixture.
11. Repair or replace all broken, missing or loose light fixtures, switches & outlets,
covers and plates.
12. Check all 3-wire outlets for proper polarity and verify ground.
13. Remove any 3-wire ungrounded outlets, and replace with 2-wire, or ground 3-wire to
code.
14. Throughout building, install outlets and light fixtures, as specified in Bulletin 80-I.
15. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and
other smoke

17. The gas heater on the second floor is inconectly vented.
18. Not sure if the pipe size is correct for appliance.
19. The exterior lawn hydrant(s) requires backflow assembly or device.
20. The exterior plumbing vents have broken piping and no flashing.
HEATING
1. Install venting of furnace to code.
2. Install wall furnace to code (gas pipe outside blu pipe).
3. Clean and Orsat furnace bumer. Check all controls for proper operation. Check
furnace heat exchanger for leaks; provide documentation from a licensed contractor
that the heating unit is safe.
4. Install chimney liner.
5. Connect furnace/boiler and water heater venting into chimney liner.
6. Vent clothes dryer to code. (Ventilation permit and inspection is required).
7. Install approved leer handle manual building shutoff gas valve in an accessible
location ahead of the first branch tee.

11. Ordering the owner to remove or repair the building(s) at 334 Stinson Street within fifteen
(15) days from adoption of resolution.
The property owner of record, US Bank NA, c/o America's Servicing, did not appear. No other
parties of interest appeared.
Mr. Ma�er stated the building was a one and one-half story, wood frame, single-family dwelling
on a lot of 3,920 square feet and had been vacant since May 16, 2008. A code compliance
inspection had been done on October 28, 2008, the vacant building registration fees were current,
and the $5,000 performance bond had not been posted. On July 9, 2008, an inspection of the
building was done and a last of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on August 12, 2008 with a compliance date of
September 11, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land
to be approximately $30,700 and the building to be $62,900. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $40,000 to $50,000. The
cost for demolition was estimated to be approximately $6,548 to $9,548. There had also been two
summary abatements issued to this property since 2008, two of which went to work order: to secure
the building and the City had to board the building to secure it from trespass, and boarding. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1890 and was a workers cottage-style building. There had many exterior alternations to the
building, the block face was not contiguous, and she did not believe demolition would not have an
adverse effect on the neighborhood.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
