WHEREAS, the City Architect having re quested the City Council
to hold a public hearing to consider any complaints.about the expense
incurred by the City of Saint Paul in removing a dangerous structure
at No. 176 - 1761/2 Thomas Avenue, more particularly described as East
One -half of Lot 12, Block 1, Magoffin & Breckenridgets Addition to
Saint Paul, the City Council held a public hearing on December 30,
1958, to consider the expense and to confirm the amount thereof, and
WHEREAS, it appears that the City Council, pursuant to Council
File No. 186475, approved March 11, 1958, published March 15, 1958,
set a public hearing to consider removing the dangerous structure,
and the City Council by Council File No. 186884, approved April 8,
1958, published April 12, 1958, ordered the wrecking by and at the
separate cost and expense of the owner, occupant, or other person in
control thereof, and the City Council By Council File No. 187552,
approved May 21, 1958, published May 24, 1958, directed the Commissioner
of Parks, Playgrounds and Public Buildings to enter upon the premises
and wreck,and remove the building thereon, and do any and all things
therein necessary for the protection of life, limb and adjoining
property, and that the City of Saint Paul has incurred the expense
of $412.25 in removing said structure; and
WHEREAS, it appears that Catholic Diocese of Superior, Wisconsin,
is the record owner of the premises, copies of proceedings herein
having been sent to Odin G. and Marion 0. Nelson, 722 Berwood Avenue,
Saint Paul, , rJgan�J. Burke, 700 Sherburne Avenue, Saint Paul, 4,
Berkey Realt' Paul 4, and Earl Dolan, Attorney, 1024
Pioneer Building, Saint Paul 1; be it
RESOLVED, that we, the City Council of the City of Sa int Paul,
do hereby confirm the amount of $412.25 to be thefair, true and
reasonable amount for such services incurred in removing the dangerous
structure; and be it
FURTHER RESOLVED, that the City Clerk be directed to file in the
office of the Register of Deeds for the County of Ramsey, a statement
of expense incurred by thee ity for the purpose of securing a lien on
the property, pursuant to the Building Code, Chapter 1 of the Saint Paul
Legislative Code; Sec. 1.07.

We are attaching a copy of Council File No. 190578, approved
by the Council January 13, 1959, and p;blished in the offi-
cial paper of the City of Saint Paul, January 17, 1959.
This has reference to the property at 176 -176% Thomas Avenue,
St. Paul, more particularly described as East 1/2 of Lot 12,
Block 1, Magoffin & Breckenridge's Addition to St. Paul, of
which the Catholic Diocese of Superior, Wisconsin, appears to
be record owner. Copies of the proceedings were sent to: Odin
G. and Marion 0. Nelson, 722 Berwood St., St. Paul 10; Jean J.
Burke, 700 Sherburne Ave., St. Paul 4; Berkey Realty Co., 1692
Selby Ave., St. Paul 4; Mr.Earl Dolan, Atty., 1024 Pioneer
Bldg., St. Paul 1. This resolution confirms the expenses in-
curred by the City in the condemnation and wrecking of the
structures thereon, which amounted to $412.25.
As you will note, the final paragraph directs the City Clerk
to file, in the office of the Register of Deeds, a statement
of expenses incurred, for the purpose of securing a lien on
the property, in accordance with Section 1.07 -7 of the St. Paul
Legislative Code.
