1 WHEREAS, Ireland Sandrock Systems Inc d/b/a American Burger Baz, located at 354 Wabasha St.
2 N. in Saint Paul, has requested a waiver of the I S-day notice requirement for Liquor on sale — 181-290
3 seats, Liquor on sale — Sunday, and Liquor on sale — 2:00 a.m. closing licenses; and

WI-IEREAS, the District 17 Community Council has agreed to the waiver of the notice
requirements; and

WIIEREAS, the Council finds that the application is in order and there aze no grounds for denial of
the license and that the failure to grant the waiver and the consequent delay in approving the license would
cause exceptional and unusual hazdship to the license applicant; and
WHEREAS, the licensee agrees that in the event a complaint is received prior to the expiration of
the 15-day period and the complaint provides a basis for adverse action against the license, that the
Department of Safety and Inspections may direct the licensee to immediately discontinue all operations
until a public hearing is scheduled, and that the licensee sha11 comply with said directive; now, therefore,
be it,
RESOLVED, that the 15 day notice requirements of § 409.11 of the Saint Paul Legislative Code
aze hereby waived and Liquor on sale —181-290 seats, Liquor on sale — Sunday, and Liquor on sale — 2:00
am, closing licenses are hereby approved for Ireland Sandrock Systems Inc d/b/a American Burger Bar,
located at 354 Wabasha St. N. in Saint Paul, subject to the agreement stated above.

District 17 CapitolRiver Council welcomes American Burger and Bar restaurant to its
new location in downtown St. Paul. The Executive Committee of CapitolRiver Council's
Board of Directors approves waiving the fifteen day heazing notice so that the restaurant
can obtain its liquor license and be open to the public by Marchl2, 2009.
