Gentlemen and Madam: In re Appeal of Grace Evangelical Lutheran Church for building setback on property lo- cated at and commonly known as 1730 Old Hudson Road. I wish to call your attention to a letter from Mr. Wieland to the City Council, read at the first hearing on this appeal, stating in part that the above property is "presently vacant and undeveloped land ". Know- ing this to be untrue, I went to the Planning Board office, pointed out the error, and asked whether I should call it to the, attention of Mr. Wieland or the Council. The answer I got was, "Neither., Those buildings are going to -be torn down." No matter what future disposition is made of the buildings, the fact remains that a modern house and a garage are now on this property;\and definitel y remove a large g portion from the "vacant and undeveloped" class. Furthermore, it is on this particular portion that the church is now pro- posed to be built. If you visited the property, each of you is personally aware of this fact, but, since Mr. Wieland's letter is a matter of record; I feel that the correct status of the property also should be recorded. _%�. Yours truly, Mrs. Raymond McGraw. f,o�zk 9 Wewmamz, JG. gad 6, A January 7, 1959 St. Paul City.Council Dear Council Members Some time ago, Mrs. Germann and myself were asked to sign a petition requesting the City Council to permit the construction of a church twelve feet from the property line, on a site on the Old Hudson Road between Kennard and White Bear Ave. We were told that this met with the wishes of the other property owners, but the petition was necessary for the City Council to make an exception to the building code. This petition was signed by Mrs. Germann and myself in all sincerity, believing this to be the wishes of our neighbors. However, it has been brought to our attention that this is not correct. While we welcome the building of this church in our immediate area, I do feel however, that every effort should be made to select the location on their trac+, of land that will meet with the approval of the adjoining property owners. The legal description of the applicant's property follows: the west 433.08 feet of the east 937!,.22 feet of that par`t'of the southeast quarter lying south of- Hudson Road except that part which lies south of U. S. Trunk Highway No. 12 as now laid out in Section 34, Township 29, Range 22, except the south 673 feet thereof, accord- ing toNthe Government survey thereof. The present zoning of the property is "Alt Residence, and has been such since 1922. The property has a frontage of 435 feet along Old Hudson Road, and an average depth of 285 feet; making a total area of approximately 2.85 acres. The established building line along the south side of Old Hudson Road in this vicinity is 69' feet abased on set backs of existing residences which were constructed prior to A gust22, 1922. The City Architect, the Planning Board Staff, and the Board of Zonin mem- bers are agreed that this 69 foot set back is an unreasonable requirement f r - n w construction., i The property under consideration is presently vacant, undeveloped land. The applicants propose to build a new church structure on the property, setting the building twelve feet south of the south street line of Old Hudson Road. There is a residence on-the property immediately to the west which has a set back of eighteen feet; and the property immediately to the east is developed as a single family residence with a 98 foot set back. Both of these residences are located on large lots which, in the future, might very likely be divided into smaller lots. In February 1956, a petition to rezone this property from "Att Residence to Commer- cial to,,permit the use of the land as a restaurant site was denied by the City Council.. The future highway needs were considered by the Planning Staff and Board of Zoning. There is a possibility that the south portion of the church property may be subject to rigbt -of -way acquisition for an interchange at White Bear Avenue and Highway No. 12. However, it is felt that this will not materially affect the `church structure, since the plans ca 1 for its erection on the north portion of the property. 4 , ! T Grace English Evangelical Lutheran Church - 2 - On November 12, 1958, this appeal for a twelve foot set back was presented at the meeting of the Board of Zoning, at which time the Applicants pointed out that -the reason for their request for this twelve foot set back was based on topography and the contour of the land. The architect for the church also stated that, in his opinion, it is necessary to maintain the twelve foot set back due to the sewer connection. The City Architect and the Planning Board staff disagreed with this statement, basing their opinions upon the records in the Public Works Department and the drawings submitted. There were four of the six members of the Board of Zoning present at this meeting, and the vote on the matter of the establishment of this twelve foot set back was divided with two.members voting in favor, and two in opposition to the proposal. The staff recommendation of a 25 foot set back was not voted upon at the meeting. , I shall be happy to answer any questions concerning this report.
