WHEREAS, base upon the records in the Ramsey County Recorder's Office and
information obtained by De ent of Safety and Inspections on or before August 18, 2008, the
following are the now known i erested or responsible parties for the Subject Property:
Consumer Solutions Reo LLC, 1 5 S Main St, Salt Lake City UT 84115-5313; Reiter &
Schiller, 25 N. Dale St., St. Paul, 55102; District 5 Planning Council.
WHEREAS, Department of Safet d Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul L, islative Code an ordex identified as an "Order to
Abate Nuisance Building(s)" dated October 2 2008; and
WHEREAS, this order informed the then wn interested or responsible parties that the
structure located on the Subject Property is a nuisanc building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or sponsible parties that they must repair
or demolish the structure located on the Subject Property by ovember 28, 2008; and
WHEREAS, the enforcement officer has posted a placarc�n the Subject Property
declaring this building(s) to constitute a nuisance condition; subjec�o demolition; and
WHEREAS, this nuisance condition has not been corrected and eparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings be e the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and �
WHEREAS, the interested and responsible parties have been served noti in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time��te, place and
purpose of the public hearings; and e

and the City of Saint Paul all remove and dispose of such property as provided by law,

The building is a two story, wood frame, single-family dwelling, on a lot of 2,614 square feet.
According to our files, it has been a vacant building since February 16, 2008.
The current property owner is Deutsche Bank National Trust Co c/o Sa�on Mortgage Services,
(new owner) per AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been three (3) SUMMARY ABATEMENT NOTICES since 2008.
There have been eight (8) WORK ORDERS issued for:
- Boarding
- Removal of improperly stored refuse and debris
- Removal of tall grass and weeds
On October 9, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BL3ILDING was posted on October 29, 2008 with a compliance date of
Novembez 28, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (By assessment 8/21/O8, good thru Z/16/09)
Tvcation has placed an estimated market value of $21,000 on the land and $135,400 on the
building.
As of February 9, 2009, a Code Compliance inspection has not been completed.
As of February 9, 2�09, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $75,000 to $85,000. The

The VacantiNuisance Suildings Unit, Department of the Departrnent of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
711 DESOTO ST
and legally described as follows, to wit:
WARREN & WINSLOWS ADDITION TO THE TOWN OF ST. PAUL S 52 FT OF
LOT 1 BLK 8
to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
Q�n October 09, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the de�ciencies present at this time.
As first remedial action, a Code Compliance Tnspection must be obtained from
the Building Inspection and Design Section, 8 Fourth 5treet East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to tfie restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame dwelling.
The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Infestation of Cockroaches. Exterminate and eliminate all cockroaches
throughout the entixe building. Provide this office with a copy of the
extermination report from a licensed professional Pest Control Operatar, and
follow theix recommendations to eradicate these pests.
3. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
4. Lack of Electricity. Immediately restore elecYrical service. Failure to pxovide
proper electrical service will result in these premises being declared Unfit for
Human Habitation and ordered vacated for lack of this basic facility. Use of
candles, fuel operated lighting or extension cord wiring is not pe�nitted whil�
the power is off.
The exterior walls and/ar ri of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
6. The exterior walls and/or trim of the house has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint

The foundation is deterioxated, defective or in a state of disrepair. Repair all
foundation defects in a professional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
8. FURNACE: Have a licensed hearing contractor service and clean the fumace
or boiler and make any necessary repairs. Perform a C10 test on the heating
plant. Then, send the attached form back to the Inspector. Repair of gas fixed
appliances requires a permit.
9. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.

11. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire bulding. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestarion. Immediately remove any dead rodents from
the premises.
12. The rQOf is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
13. Smoke Detector: Lack of properly instalied and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
14. The extez7or walls of the house and/or garage are defective. Repair al] holes,
breaks, loose or rotting siding, to a professional state of maintenance.

16. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
17. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the fraives.
18. There is illegal wiring in use (under sized, improperly supported, or spliced).
19. Thexe are broke, defective pipes throughout home. A licensed profesional
plumber must be contacted to make xepairs per code.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not con by November 28, 2008 the Department of Safety
and Inspections, Di��sion of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this acrion, inciuding administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)266-9090. This
inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.

of the guidelines and design review application and forms are all available from the Department
of Safety and Inspections web site and from the HPC staff. A building permit «�ill not be issued
without HPC review and approval.
ALT 2: If this building is located in a historic district or site (noted above, just below the
property address) then you must contact Heritage Preservation (HPC) staff to discuss your
proposal for the xepairs required by this order and compliance with preservation guidelines.
Copies of the guidelines and design review appiication and fom�s are available from the
Deparhnent of Safety and Inspections web site (see letterhead) and from the HPC staf£ Nc
permits will be issued without HPC review and approval. HPC staff also can be reached by
calling 651-266-9078.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to AbaCe" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven {7) days, notify the Enforcement O£fiaer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is xequired by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shail
not be removed without the written authority of the Deparhnent of Safety and hispections,
Division of Code Enforcement. The department is further requixed to fi1e a copy of this "Order
to Abate" with the City Clerk's Office.
if corrective action is not taken within the time specified in this order, the Enforcement Officer
will norify the City Councii that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution ca11s for abatement action the Councii may either order the City to take the
abatement action or fix a time �vithin which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Cocie and provide that if correc6ve action
is not taken within fhe speci5ed time, the City ehall abate this nuisance. The costs of this
action, including adsninistrative costs will be assessed against the pmperty as a special
assessment in accordance with law.

3. Ordering the owner to remove or repair the building(s) at 711 Desoto Street within fifteen
(15) days from adoprion ofresolution.
The property owner of record, Deutsche Bank National Trust Co. c(o Sason Mortgage Services, did
not appeaz. No other parties of interest appeared.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, single-family dwelling on a lot of 2,614 square feet and had been vacant since
February 16, 2008. A code compliance inspection had not been done, the vacant building
registration fees in the amount of $1,000 were paid by assessment on August 21, 2008, and the
$5,000 performance bond had not been posted. On October 9, 2008, an inspection of the building
was done and a list of deficiencies which constitute a nuisance condition was developed. An order
to abate a nuisance building was posted on October 29, 2008 with a compliance date of November
28, 2008. To date, the property remained in a condition which comprised a nuisance as defined by
the Legislative Code. Ramsey County Taxation estimated the market value of the land to be
approximately $21,000 and the building to be $135,400. Real estate taaces were current. Code
Enforcement estimates the cost to repair the building to be approximatety $75,000 to $85,OOQ. The
cost for demolition was estimated to be approximately $9,180 to $12,180. There had also been
three suminary abatements issued to this properiy since 2008, eight of which went to work order: to
secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refizse and debris, boarding, and cut tall grass and weeds. Code Enforcement
recommends the building be repaired or removed within 15 days. Mr. Magner presented
photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1885 and was a very substantial, Victorian-era building. She noted that it had fish scale shingles on
the top roof, was stuccoed over clapbaard, and was near the potenrial Mt. Ida historic uea;
however, she believed a lot of work would need to be done to restare it to its historic value.
Mr. Magner stated that he believed this property was referred by Railroad Island Task Force with a
recommendation to remove the building; however, he would need to verify this information with the
inspector.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
Laid over to February 24 to verify recommendation of the Railroad Island Task Force.
At the February 24 Legislative Hearing, Mr. Magner referenced an e-mail he had received from
Linda Amesen, Chair of the Railroad Island Community Task Force, forwarding a list of properties
the Task Force wisl�ed the City to acquire or remove. After reviewing that list, the Task Force had
not identified this as one of the properties recommended for removal.
