1 WHEREAS, Department of Safety and Inspections has requested ttie City Council to
2 hold public hearinas to consider the advisability and necessity of ordering the repair or wrecking

4 refened to as the "Subject Property" and commonly known as 113 COMO AVENUE. This

WHBREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before August 08, 2008, the
following are the now lmown interested or responsible parties for the Subject Property: Kohner
Investments Llc/Co Kristin And Brendan Kohner, 1264 Woodhill Dr, Woodbury, MN 55125;
Option One Mortgage, Legal Actions Dept, 3501 Irvine Center Drive, Irvine, CA 92618;
Wilford & Geske, 7650 Currell Blvd, #300, Woodbury, MN 55125; District 7 Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an oxder identified as an "Order to
Abate Nuisance Building(s)" dated October 30, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by December Ol, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the L,egislative Hearing Officer of the Saint Paul
City Council on Tuesday, February 10, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitaring this structure in accordance with all applicable codes and ordinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within fdteen
(15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held befare the Saint Paul City Council on Wednesday,
March 4, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 113 COMO AVENUE.

That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislafive Code, Chapter 45.
That the costs of demolirion and temoval of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then Imown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, VacantJNuisance Buildings.
That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

bligi�ting influence on Yhe community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building{s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removai of the structure must be completed within
fifteen (15� days after the date of the Council Hearing.
If the above conective action is no2 completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this sttucture, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of 5aint Paul shall remove and dispose of such property as provided by law.
4, A priority for the City is to safeouard historic buildinQS throu�h preservation and
rehabilitation. A buildin�must retain a good level of integritv in order to convey its
historical or architectural si¢nificance. The concept of salva�na individual coinponents
of an historic building is not considered by the HPC a way to mitigate the loss of an
historic buildinQ. However, every reasonable option for stabilizarion, mothballing and
�reservation has been exvlored, and no viable plan for the rehabilitation of this nuisance
building has been forthcoming. Therefore, the Council reguests that the Department of
Safetv and Inspections modify the bid specifications to remove this building, to rp ovide
that everv reasonable effort shall be made to salva�e the buildin�'s historic buildin�
5. The Council further requests that the Department of Safety and Insnections provide for
the following:
A. The building eaterior and its immediate context shall be documented with di�ital
photoQraohv. The images shall be at least 2400 x 1800 pixels and the images
shall be submitted to HPC staff on a gold CD.
B. An architectural descrintion of the pronerty be written that addresses remaining
unique historic fabric and the prouerties existing condition.
C. A brief history�context) of the development of the immediate nelghborhood be

Legis]ative Code. The owners, interested parlies and responsible parties known to the Enforcement Officer were given an order to
repair or remove the buitding at 113 COT20 AVE by December 01, 2008, and ttave failed to comply with those orders.

The building is a one and one-half story, wood frame, single-family dwelling, on a lot of 7,405
square feet.
According to our files, it has been a vacant building since April 2, 2008.
The current property owner is Kohner Investments, LLC, per AMANDA and Ramsey county
property records.
There have been no (2) SUMMARY ABATEMENT NOTICES since 2008.
There has been one (2) WORK ORDER issued for:
- Removal of tall grass and weeds
- Remove snow and ice
On September 30, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUTSANCE BUILDING was posted on October 30, 2008 with a compliance date of
December 1, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid. (Good thru 6/9J09)
Taxation has placed an estimated market value of $46,600 on the land and $31,500 on the building.
As of February 9, 2009, a Code Compliance inspection has not been com�leted.
As of February 4, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taxes for the year 2008 are delinquent itt the amount of $1,608.62 plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $65,000 to $75,000. The
estimated cost to Demolish is $7,827 to $10,827.
DSI, Division of Code Enforcement Resolution submitted for considerarion orders the property

Inspections, D'avision of Code Enforcement, hereby declares the premises located at:

45.02, and sub,ject to demolifion under authority of Chapter 45.11.
On September 30, 2008, a Suilding Deficiency Inspecrion Report was compiled and the
following conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building InsQection and Design Office before any permits are
issued, except for a demolition permit.

permits will be issued without HPC review and approval. HPC staff also can be reached by

As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" ta all interested garties, all present ar subsequent renters and
any subsequent owners. If you sell, transfer, ar convey in any manner, the ownership or

responsibiliry for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a°nuisance condition", subject to demolition and removal by the City. This placard sha11
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. 'I`he department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the rime specified itt this order, the Enforcement Officer
will notify the City Council that abatement acrion is necessary. The City Clerk wili then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement acti�n or fix a time within which this nuisance must be abated in accordance wlth the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is nat taken ruithin the specified fime, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

The property owner of record, Kohner Investments, LLC, did not appeaz. No other parties of
interest appeared.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and
one-half story, wood frame, single-family dwelling on a lot of 7,405 squaze feet and had been
vacant since Apri12, 2008. A code compliance inspection had not been done, the vacant building
registration fees were current, and the $5,000 performance bond had not been posted. On
September 30, 2008, an inspection of the building was done and a list of deficiencies which
constitute a nuisance condition was developed. An order to abate a nuisance building was posted on
October 30, 2008 with a compliance date of December 1, 2008. To date, the property remained in a
condition which comprised a nuisance as defined by the Legislative Code. Ramsey County
Taxation estimated the market value of the land to be approximately $46,600 and the building to be
$31,500. Real estate tases for 2008 were delinquent in the amount of $1,608.62, plus penalty and
interest. Code Enforcement estimates the cost to repair the building to be approximately $65,000 to
$750,000. The cost for demolition was estimated to be approximately $7,827 to $10,827. There
had also been two summary abatements issued to this property since 2008, two of which went to
work order: cut tall grass and weeds, and remove snow and ice. Code Enforcement recommends
the building be repaired or removed within 15 days. Mr. Magner presented photographs of the
property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was an
early pioneer building possibly built even earlier than 1885. She that that building appeared to be
originally just the basement with the one and one-half story structure being added to the top of the
basement later on. The basement had the original stone floor, hand hewn beams, and a stacked
wood ceiling and sides. She said that pioneer houses were hard to piece together and that this house
was noted in the Frogtown neighborhood context study. She believed this property was a good
candidate far rehabilitation and that if demolition was recommended, she believed the building
should be documented and the wood and stone should be salvaged.
Ms. Moermond recommended refemng this matter to the HPC for a recommendation. Laid over to
March 24 Legislative Hearing and April 1 Council Public Hearing.

Ms. Spong stated that this matter was presented to the HPC at their March 12, 2009 meeting. The
HPC voted 7 in favor to hire a qualified historian to evaluate both National Register and local
eligibility and that demolition be delayed for this site in order for alternative to be explored such as
mothballing or rehabilitation. The FiPC found that even though this property was not specifically
mentioned in the 2001 Pioneer Context Study, it had a lot of unique qualities to it and historic
fabric.
Mr. Magner noted that the real estate taxes for 2008 aze delinquent in the amount of $1,608.62 plus
penalty and interest. He also noted that a code compliance inspection had not been done.
Ms. Moermond stated that she would talk to Councilmember Carter to discuss whether the cost for
conducting the code compliance inspection could be assessed to the property. She said she would
also discuss adding HPC language in the resolution to assess the cost of hiring an historian to
review and document the property for its historical significance.

A. SITE DESCRIPTI01_ti: The house at 113 Como Avenue was constructed prior to the issuance
of building permits in the Ciry of Saint Paui. The first recorded building permit listed on the index
card was issued in 1885. The basement level of the residence is made of limestone with yellow and
red mazkings. It sits mostly above grade with the front elevation wrapped in PermaStone. Beams in
the basement are hand-hewn and the walls and ceil aze wide planks with butt j oints. The second and
third levels of this house look like a typical, one-and-one-half story, front gabled 1880s residence.
The building is set back further from the street than other residence on the block. The onginal siding
is covered by a 1960s style, shingle siding. The foundation has been parged in places and it is
difficult to tell from photos whether original windows or detail remain. This house is sited autside of
the potential Frogtown Historic District, but in an azea described i� the 2001 Pioneex Houses Context
Study as an area with modest workers housing for !he nearby railraad industries.
B. PROPOSED CHANGES: During the Legislative Hearing on Pebruzry 10, the Legislative
hearing officer recommended the HPC consider this property for review as a historic resource. A
historic resource is defined as "A property that is believed to have historical, cultural, architectural,
azchaeological or engineering significance and to meet at least one of the criteria for designation as a
heritage preservation site or district as provided in this chapter."
C. GUTDELINE CITATIONS:
Sec. 73.05. Designation of heritage preservation sites.
(a) Criteria. In considering the designation of any area, place, building, structure or similu object
in the City of Saint Paul as a heritage preservation site; t�ie commission shall apply the foilowing
cziteria with respect to such designation:
(1) Its chazacter, interest or value as part of the development, heritage or cuitural characteristics
of the City of Saint Paul, State of Minnesota, or the United States.
(2) Its iocation as a site of a significant historic event.
(3) Its identification with a person or persons who significantly contributed to the culture and
developme"rif of the City of Saint Paul.
(4) Its embodiment of tiistinguishing characteristics of an architectural or engineering type or
specimen.
(5) Its identification as the woxk of an azchitect, engineer, or master buiider whase individuai
work has influenced the development of the City of Saint Paul.
(6) Tts embodiment of elements of architectural or engineering design, detail, materials or
craftsmanship which represent a signi&cant architectural or engineering innovation.

1. The properry was not surveyed and identified during the 1983 Historic Sites Survey of Ramsey
County. The 2001 Pioneer Houses Context Study describes this area:
"The residential development of Fro�town beaan in the I 860s and I 370s, with a major impetus
for a owth coming from the construction of the St. Paat and Pacific Railroad in the early 1860s.
The railroad shops at Jackson Street and Pennsylvania Avenue and ielatedrailroad industsies
providedemploymentformanygenerationsoffamilies Workers'modesthouseswerebuiltsouth
of the shops along Sherbume, Charles, and Como Avenues east of Rice Streef'
And
"Recent windshield survey of the Thomas-Dale area sug�ests that there are a good number of
properties remainina from the 1860s and 1870s, ac�d most are not included in the Historic
Resources Database"
The 83survey identified 62 sites and 2 potential historic districts in Distric[ 7 as eligibie for
designation or as sites of major sigriificance. Properties like 113 Como Avenue aze integral
to the historic context of the neighborhoods. No images were found in a search gf the MN
Visual Resource database.
2. A more intensive level survey would be required to determine if the building would be
individually eligible for local designation or be eligible for the National Register.
3. It is always better to retain historic fabric type buildings than it is to demolish and create a hole in
the neighborhood. This particular block face has a variety of housing styles; most constructed
prior 1883 when building permit records began in the city and up until 1910. Most within the
last year, a house at 129 Como Avenue identified in the 83 Survey and 20�1 Pioneer Houses
context study was demolished by the city. 113 Como Avenue appears to have a stone lower
lever that dates further back than the frame portion of the house above. Although potentialiy
aitered from its original form, the frame construction above would also be from the period of
significance for the neighborhood. -
4. The integriry, or authenticity as evidenced by a site's location, design, setting, workmanship or
association, is fair to good because the alterations that have occurred, such as non-original siding
over ctapboard, non-original storm windows and doors are easily reversible. There are features
intact on this property that show example of early construction in the neighborhood and Saint
Paul. The site's location and setting wouid be considered to have fair to good integrity.
E. STAFF RECOMMENDATION: Based on the findings, staff recommends that a qualified
historian be hired to evaluate both National Register and local eligibility. Staff recommends that
demolition be delayed for this site in order for alternatives to demolition to be expiored, such as
motnoaliing or renaoiiitation.
