1 WHE S, Dep nt of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame dwelling and its wood accessory shed in
4 backyazd located on properiy hereinafter refened to as the "Subject Property" and commonly
5 known as 43 HING STREET EAST. This property is legally described as follows, to wit:

WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
inforxnation obtained by Department of Safety and Inspections on or before June 9, 2008, the
following are the now known interested or responsible parties for the Subject Property: Hiway
Federal Credit Union, 111 Empire Drive, St. Paul, MN 55103; FNMA c/o MN BPO, Dawn
Reinke — Add-Vantage Realty, 2026 Englewood Circle, Shakopee, MN 55379; West Side
Citizens Organization.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated August 12, 2008; and
WHEREAS, this order informed the then known interested ar responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this arder informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 11, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 9, 2008 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitaring
this structure in accordance with all applicable codes and ordinances, or in the altemative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 7, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 43 HING ST E.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Deparhnent of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitared by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolurion and that the notification requirements of Chapter 45 have been fulfilled.

safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the shucture in accordance with all applicable codes and ordinances. The

fifteen (15) days after the date of the Council Hearing.
2. If the above corrective acrion is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling with a detached
accessory shed on a lot of 3,920 squaze feet.
According to our files, it has been a vacant building since May 6, 2008.
The cunent property owner is Highway Federal Credit Union, per AMANDA and Ramsey
county property records.
There has been one (1) SUMMARY ABATEMENT NOTICES since 2008.
On July 31, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on August 12, 2008 with a compliance date of
September 11, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid.
Taacation has placed an estimated mazket value of $41,600 on the land and $78,700 on the
building.
As of December 8, 2008, the $5,000.00 performance bond has not been posted.
As of June 6, 2008, a Code Compliance inspection has been completed.

Inspecrions, Division of Code Enforcement, hereby declares the premises located at:

45.02, and subject to demolition under authority of Chapter 45.11.
On July 31, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspection will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.

This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame dwelling and its wood accessory shed in
backyard.

General
A Code Compliance Inspection Report was done by Jim Seeger on June 6, 2008.
Details of Yhe report are as follows:
BUILDING
1. Remove floor covering throughout and replace or repair finish floor, sub floor and
support structure as necessary.
2. Remove water damaged ceiling covering and repair structure as necessary. Reinstall
approved covering.
3. Remove mold throughout dwelling, including in cellar area.
4. Remove floor covering and sheathing in back rooms to expose structure. Repair or
replace as necessary. Provide access and ventilation to the under floor area.
5. Replace reaz roof covering using approved material and repair or replace the roof
sheathing as necessary.
6. Replace the side yard storm doar and repair or replace other storm doors.
7. Provide latch at front door.
8. Demolish shed and remove all debris.
9. Insure basement cellar floor is even, is cleanable, and all holes are filled.
10. Strap or support top of stair sh
11. Install floor covering in the bathroom and kitchen that is impervious to water.
12. Install tempered glass in window on stair.
13. Provide thumb type dead bolts for a11 entry doors. Remove any surface bolts.
14. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc.
as necessary.
15. Provide complete storms and screens, and in good repair for all doar and window
openings.
16. Repair walls and ceilings throughout, as necessary.

17. Provide hand and guazdrails on all stairways and steps as per attachment.
18. Re-level structure as much as is practical.
19. Where wall and ceiling covering is removed attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
20. Prepaze and paint interiar and exterior as necessary (take the necessary precautions if
lead base paintis pzesent).
21. Any framing members that do not meet code (where wall and ceiling covezing is
removed, members that are over-spanned, over-spaced, not being carried properly, door
and window openings that are not headered, etc.) are to be reconstructed as per code.
22. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high
minimum but not less than 5.7sq. fr. overall).
23. Provide general clean-up of premise.
24. Provide smoke detectors as per the Minnesota State Building Code.
25. Repair soffit, fascia trim, etc. as necessary.
26. Provide proper drainage around house to direct water away from foundation.
27. Install downspouts and a complete gutter system.
ELECTRICAL
1. Ground the electrical service to the water service within 5'of the entrance point of the
water service.
2. Bond around water meter with a copper sized for the electrical service per �lrticle 250 of
the NEC.
3. Provide a complete circuit directory at service panel.
4. Remove all cord wiring.
5. Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers
and plates.
6. Check all 3-wire outlets for proper polarity and verify ground.
7. Remove any 3-wire ungrounded outlets, and replace with 2-wire, or ground 3-wire to
code.
8. Throughout building, install outlets and light fixtures, as specified in Bulletin 80-1.
9. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and
other smoke detectors as required by the IRC.
10. Properly wire exterior lights at front(side/back door.
11. Install exterior lights at frondside/back entry doars.
12. All electrical work must be done by a licensed electrical contractor under an electrical
permit.
13. Any open walls or walls that are open as part of this project must be wired to the
standards of the 2005 NEC.
14. Remove or protect open wiring by panel.
15. Need access to juncrion box above panel.

PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
Basement:
1. Water heater has incorrect gas venting, water piping and is not fired or in service.
2. Raise water meter from pit.
3. Repair or replace all corroded, broken or leaking water piping.
4. Water piping has improper fittings or usage.
S. Provide mare hangers for water piping.
6. Replace corroded gas piping.
7. The dryer gas shutoff, connector or piping is inconect.
8. Provide more hangers for gas piping.
9. Soil and waste piping has no front cleanout; no soil stack base cleanout.
10. Laundry tub faucet is missing, broken or parts missing.
11. The second floor bathroom tub and shower faucet must be pressure balanced.
12. The exterior lawn hydrant(s) require back flow assembly or device.
HEATING
1. Condensate drain piping for air conditioner coil to be installed according to code.
2. Install class B venting from fumace outlet to chimney with class B wye for
connection of water heater venting.
3. Clean and Orsat furnace burner. Check all controls for proper operarion. Check
furnace heat exchanger for leaks; provide documentation from a licensed contractor
that the heating unit is safe.
4. Connect fiunace and water heater venting into chimney liner.
5. Vent clothes dryer to code. (Ventilation perniit and inspection is required).
6. Provide adequate combustion air and support to code.
7. Provide support for gas lines to code. Plug, cap and/or remove all disconnected gas
lines.
8. Clean all supply and return ducts for warm air heating system.
9. Repair and/or replace heating registers as necessary.
10. Appropriate mechanical warm air, ventilation permits are required for this work.

This structure was inspected as a Single Family Home.

Repair the structure to a habitable condition.

This structure is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Department of Safety and Inspections. You may contact Jim
Seeger at D.S.I., 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Compliance Certificate. Under Chapter 33.03 of the Saint Paul
Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by September 11, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolirion costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Tnspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner ar responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolftion and removal by the City. This placard shali
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The deparhnent is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If correcrive acrion is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.

If the resolution calls for abatement action the Council may either order the Ciry to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if conective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including adsninistrative costs will be assessed against the property as a special
assessment in accordance with law.

BUILDING
1. Remove floor covering throughout and replace or repair finish floor, sub floor and
support structure as necessary.

19. Where wall and ceiling covering is removed, attic, replace doors and windows,
(insulation, glass, weather stripping, etc.) shall meet new energy code standards.
20. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paint is present).
21. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being carried properly, door
and window openings that are not headered, etc.) are to be reconstructed as per code.
22. Habitable rooms with new usage, replaced windows shall have giass axea equal to 8% of
floor area, or a minimum of 8sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high

24. Provide smoke detectors as per the Minnesota State Building Code.

1. Ground the electrical service to the water service within 5'of the entrance point of the
water service.
2. Bond around water meter with a copper sized for the electrical service per Article 250 of
the NEC.
3. Provide a complete circuit directory at service pane1.
4. Remove all cord wiring.
5. Repair or replace all broken, missing ar loose light fixtures, switches & outlets, covers
and plates.
6. Check all 3-wire outlets for proper polarity and verify ground.
7. Remove any 3-wire una ounded outlets, and replace with 2-wire, ar ground 3-wire to
code.
8. Throughout building, install outlets and light fixtures, as specified in Bulletin 80-1.
9. Install hard-wired, battery backup smoke detector, as specified in Bulletin 80-1, and other
smoke detectoxs as required by the IRC.

9. Ordering the owner to remove or repaar the building(s) at 43 KinQ Street East within fifteen
(15) days from adoption of resolution.
The property owner of record, Highway Federal Credit Union, did not appear. Dave Yankovec
appeared and said that his wife had made a bid of $8,000 to purchase the house on an on-line
auction and the closing occurred on October 25.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling
with a detached shed on a lot of 3,920 square feet and had been vacant since May 6, 2008. A code
compliance inspection had been done on June 6, 2008, the vacant building registration fees were
current, and the $5,000 performance bond had not been posted. On July 31, 2008, an inspection of
the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on August 12, 2008 with a
compliance date of September ll, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $41,600 and the building to be $78,700. Real estate
taYes were current. Code Enforcement estimates the cost to repair the building to be approximately
$60,000 to $70,000. The cost for demolition was estimated to be approximately $8,780 to $11,780.
There had also been one suminary abatement order issued to this property since 2�08, none of
which went to work order. Code Enforcement recommends the building be repaired or removed
within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1890 and was a workers cottage-style building. Originally, the property was listed as having five
buildings on this one corner 1ot with three out buildings and the lots were later split. Although other
properties on King had been surveyed, this property had not and she did not believe demolition
would have an adverse effect on the neighborhood.
Mr. Yankovec stated that his wife had purchased several properties both in St. Paul and
Minneapolis and he was unaware that this property was a Category III vacant building. He was
currently working on an old Victorian home in Minneapolis and had only been on the inside of this
house once since purchasing the closing in October. He said that from what he had heard at this
hearing, the sale of the property by the bank was not a legal transaction.
Mr. Magner asked Mr. Yankovec whether he was a licensed contractar. Mr. Yankovec responded
that he was not. Mr. Magner explained the State Building Code and that he was only allowed to
pull permits to do work on one other structure, other than his own, within a two-year time period.
Mr. Yankovec responded that he had talked to a general contractor on the cost of hiring out all of
the work. He said that he would need additional time to sort out the legal issues conceming the
purchase of this property.
Ms. Moermond recommended continuing the Legislative Hearing to Jan. 13 and Council Public
Hearing to February 4. The following must be provided the following: 1) post the $5,000
performance bond; 2) provide a work plan to be done in accordance with the code compliance
inspection report; 3) provide contractor bids; 4) provide financial documentation; and 5) the
property must be maintained.

with the standard requirements, she recommended the building be removed within 15 days with no
