RESOLVED, that upon appeal of the Spiegler Construction
Company from the decision of the Commissioner of Parks, Play-
grounds and Public Buildings, the Commercial Use authorized on
a portion of the property adjacent to the southwest corner of
West Seventh and Springfield Streets, described as the northwesterly
150 feet of Lot 30, Lot 31 except the southeasterly 150 feet, Lot
32 except the southeasterly 150 feet, and Lot 4, Block 3, Palisade
Addition, and Lots 12 and 13, C. W. Youngmants 4th Addition, and
Block 5, Rankin's Addition, is hereby extended to the entire
property hereinabove described, and permission is hereby given to
the owner of such property to devote the same in its entirety to
commercial use, with the same intent, purpose and effect as if said
property had been entirely classified under the Zoning Code, as
amended, in a Commercial District.

This is in the matter of the application of the Spiegler Construction Company
for an appeal to extend a permitted apartment use on a portion of this property
to cover the entire - property which is located adjacent to the southwest corner
of West Seventh and Springfield Streets; and to permit the installation and
operation of a 28 car private parking lot in conjunction with the proposed
apartment,lbuildings. This property is described as the northwesterly 150 feet
of Lot 30; Lot 31 except the southeasterly 150 feet; lot 32 except the south-
easterly 150 feet and Lot 4, Block 3, Palisade Addition; Lots 12 andl3, C. IV.
Youngman's 4th Addition; and Block 5, Rankins Addition.` The zoning is Commercial
93 feet in depth from West Seventh Street, and the remainder is "B" Residence.
This property has a'frontage of 180 feet along West Seventh Street, extending
145.8 feet southerly along Springfield Street, giving a site area of 26,244 square
feet. The applicant proposes to erect two 21 story apartment buildings; one
for 17 units and the other 11 units, each of which will have a combination-of
one and two bedroom type units. The proposed apartments meet the recommended
standards for density and ground coverage.
The adjacent land uses are as follows: east :l across Springfield Street is
vacant land; west and adjoining are single family residences fronting on West
Seventh Street; north across West Seventh.Street is wooded, undeveloped land
which is a hillside; south and adjoining-are the. rear yards of single family
residences,f ronting,on Benson Avenue.
Field investigation discloses no objection as the present zoning does permit
commercial• uses for the front 93 feet of this property. This use would be more
compatable with the existing adjoining development than commercial uses which
would be permitted under the commercial zoning. The Traffic Engineer has approved
the layout,.and operation'of the'off.- street parking lot in conjunction with the
proposed development- and'the plans meet .standards for this type of facility.
In consideration of the above factors, the Board of Zoning recommends the
granting of this appeal to extend the commercial use, and the permit for the
installation and operation of a- 28 car private parking lot in conjunction with
the proposed 28 unit apartment buildings.
