That the Zoning Code, Chapters 60 to 64 inclusive, of the Saint Paul Legislative Code, pertaining to Use Districts, Height;.Districts and Rezoning of certain properties in the City of Saint Paul, as amended, be and the same is hereby further amended so as to rezone Lots 11 and 12 Block 11, Brewsterrs Addition at the northwest corner of Capitol Boulevard and Charles Avenue, in Class "C" Residence District, from Height District No: 1 to Height District No. II. Section 2. This ordinance is hereby declared to be an F emergency ordinance rendered necessary for the preservation of the public peace, health and safety. , Section 3. Dear Sir: This is in the matfer,of the petition of -the Board of Christian Services to change the classification of the Height District prescribed in the zoning Ordinance. This will affect the northwest corner of'Capitol Boulevard and Charles Avenue. This pro- perty is described as Lots 11 and la, Block 11, Brewsters Addition to Saint Paul. The zoning is "Ct1 Residence. 77 per cent, or seven out of nine property owners within 100 feet have acquiesced in this petition. The applicant's petition proposes that the above area be reclassified from Height District No.,.I to Height District II. Under Zoning Ordinance, Height District I limits the height of a building to forty feet except that said building may be con- structed to an excess of forty feet if the building is set back from the lot line one foot for each additional foot of height in excess of the forty feet that is de- sired. The applicants propose to construct a new six story addition to the existing hospital with ^a maximum total height of 74 feet above the street grade. This proposed addition cannot be constructed under existing Height District I regulations. Therefore, they have submitted a sufficient petition signed by the adjoining property owners ask- ing the Council to change the Height District I to Height District II. This permits a height up to 75 feet. The structure proposed by the applicant would be permitted in Height District II. Accompanying this petition for the change in height district limitations is an appli- cation to change the building line on Capitol Boulevard.- This change would be in the public interest and would not materially affect the adjoining property. It will improve -the applicant's operation and service that this hospital is rendering to the community, and the Board of Christian Services will provide satisfactory off - street parking not only for this proposed facility, but for their entire development. The Board of Zoning finds that this petition is a reasonable one, and, therefore, recommends that it be granted in accordance with the applicant's petition dated October 15, 111958. HCW :FGI Encl.
