The Commissioner of Public Works, having had under consideration
the preliminary order of the Council, known as Council File No. 189285
approved September 24th 19 58 relative to grading Hoyt Avenue
from Dale Street to Grotto Street
and having investigated the matters and things referred to therein, hereby
reports:
1. Said improvement is necessary and (or) desirable.
2. The estimated cost thereof is $ 9,972.53 and the total cost

I am returning herewith the petition, filed in opposition to
the grading of West Hoyt Avenue from Dale Street to Grotto Street.
The petition has been signed by 62% of the resident owners, who
own 76% of the lineal frontage on the line of the improvement.
However, the petition does not meet the requirements of a peti-
tion of remonstrance as the descriptions of real estate and lineal
frontage are not stated.
Four descriptions out of a total of twenty -four remain signed in
favor of the improvement.

Petition in Opposition to the Grading of West Hoyt
Avenue between Dale Street and Grotto Street, City
of Saint Paul, County of Ramsey.
We the undersigned, being owners of property abutting West
Hoyt Avenue between the West line of Dale Street, are opposed
to the regrading of West Hoyt Avenue between the West line of
Dale Street and the East line of Grotto Street for the
following reasons:
(1). This part of West Hoyt Avenue at the present time
is graded and adequately maintained by the City of Saint Paul.
(2 f, The regrading as proposed would not improve the
street and would be an unnecessary expense 'to the undersigned
abutting property owners.`
(3), Construction is not completed on all lots in this
area and accordingly regrading at this time would not be in
accord with sound judgment.

abutting this portion of West Hoyt Avenue request the Council
to deny the petition calling for the regrading of West Hoyt
Avenue between the West line of Dale Street and the East line
