WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of
noise in the City of Saint Paul; and
4 WIIEREAS, §293.11 provides for the granting of variances from the sound level limitations
5 contained in §293.09, upon a finding by the City Council that full compliance with Chapter 293 would
6 constitute an unreasonable hazdship on the applicant, other persons or on the community; and

WHEREAS, The University of St. Thomas / STAR, represented by Jese Ledbetter and Matt
Gustafson, Assistant Directors of Campus Life who have been designated as the responsible
persons on the application, has applied for a variance to present live music at Foley Plaza�n the
University campus at 2115 Summit Avenue; and or parking lot M
WHEREAS, applicant is seeking a variance for the hours of 7:00 p.m. unti19:00 p.m. on e�-e�

WHEREAS, if applicant is not granted a variance it will not be able to present live music at 2115
Smmnit Avenue; and
WHEREAS, the Deparhnent of Safety and Inspections has reviewed the application and has made
recommendations regarding conditions for the variance; now, therefore, be it

22 RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to The University
23 of St. Thomas / STAR, subject to the following condirions:

1) The variance shall be for the hours of 7:00 pm. unti19:00 pm. on ..,..:...�.��'^t^ a°'°s•

2) Ail electronically powered equipment used in conjunction with the event sha11 not exceed 90
dBA, as measured at 50 feet from the noise source.
3) The applicant shall provide personnel and equipment who shall provide continuous sound level
monitoring at all stages and each sound mix during the hours of the variance, to ensure
compliance with Condition #2.
4) All electronically powered equipment, PA systems, loudspeakers or similar devices shall be
turned off no later than 9:00 p.m. on the event date.
