WHEREAS, Thomas H. Shanley, Sr., an employe of the
Department of Public Safety of the City of Saint Paul, was
injured on July 12, 1957, in a third party accident, while
engaged in the performance of his duties for the Department
of Public Safety, and the City has incurred medical expenses
in the amount of $2476.85 therefor, and the employe, by reason
,of said injury, was disabled for work from date of accident to
April 1, 1958, being paid the amount of $2491.46 therefor, and
there -is outstanding a bill of Dr. L. J. Michienzi in the amount
of $9.50, which the City will pay; artotal of $4,977..81; and
WHEREAS, a settlement has been negotiated by the-parties
in the total amount of $12,500.00, including any amount to which
the City would be subrogated for medical expense and salary, and
attorneys for said employe, Douglass, Sheets & Bell, have offered
to the City a settlement equal to 75 per cent of the total expense
---"-above,,'- or $3,733.36, less the usual attorney's fee of 25 per cent,
or $933.34, leaving an amount of $2,800.02; and said attorneys
also propose that the City pay a proportionate share of the costs
connected with the law suit brought on behalf of the employe and
the City herein, one-third of the costs advanced by said attorneys
in the total amount of $156.30, or $52.10; and
WHEREAS, -i-n- =view of-the seriousness of the injuries sus-
tained by the ;employe in said third party accident, and the under-
standing that there will be no claim for permanent partial dis-
ability, if any, or any further claim made on the City by the
employe because of said injury on duty, the office of the Corpora-
tion Counsel 'recommends acceptance of said settlement offered
by employe through his attorneys, Douglass, Sheets & Bell, now,
therefore, be it
- RESOLVED, The proper City Officers are hereby authorized
to accept the 'settlement offered by employe through attorneys
Douglass, Sheets & Bell, as a cashier's check or certified check,
in the amount of $2,747.92, in full settlement of the claim of
the City of Saint Paul in connection with the injury sustained by
employe Thomas H. Shanley, Sr. in said third party accident, said
