That the Zoning Code, Chapters 60 to 64 inclusive, of the Saint Paul Legislative Code, as amended, pertaining to Use Districts, Height Districts and Rezoning of certain properties in the City of Saint Paul, be and the same is hereby further amended so as to rezone the following described pr.oper.ty, from- -llB11 .Residence District to "C" Residence District: Lots 11 and 12, Block 1, Skidmore & Cassedyts _ Park Addition, and South One -half of Block 5, Oakland Park Addition, except part taken for alley, located at the northwest corner of Dayton Avenue and Herschel Street, according to the plat thereof on file and Qf record in the office of the Register of Deeds in and for Ramsey County, Minnesota. November 21, 1958. 1956 my petition for the corner of Herschel and "C" zoning came up At this time two of the adjoining property owners questioned the petition and requested that its approval be postponed until further information was given to them concerning the eventual use of the vacant part of this property. This writer, and petitioner, has met with these two gentlemen and given them the information requested. On this basis they have removed any and all /objections and questions to my request for approval. Attached to this letter is their letter to the City Council removing their objections and request for postponemnent and signed by both parties, May I request that thisiezoning petition be placed on the agenda of the City Council at the next regular meeting. At a meeting of the City Council on -November,6, 1958 this petition came up for approval and we objected to this petition on the basis that as adjoining property owners we did notknow to what purposes the vacant lot would be used. Since that date the petitioner, Mr. John B. Hilton, has given us further information con- cerning the eventual use of the land. On the basis of this information we do hereby remove our questions and objections to the petitioners rezoning request. Hilton to rezone from "B" residence to "C" residence property located adjacent to the northwest corner of Dayton Avenue and Herschel Street. This property is described as Lots 11, and 12, Block 1, Skidmore and Cassedy Park Addition, and the south one -half of Block 5., Oakland Park Addition. - u The owners of fourteen out of fifteen descriptions, or 93 per cent within 100 feet of the area sought to be reclassified have acquiesced in this petition. There is presently a triplex on the west forty feet of this property, and the remainder of the property is vacant. This property has a frontage of 110.44 feet on Dayton Avenue and 138 feet on Herschel Street, making a total area of 15,253.92 square feet. The applicant proposes to continue the present three family occupancy of the existing home and to either build, or move a home on the vacant property that would be occupied by no more than four units, and that would have a maximum size of 35 feet fronting on Dayton Avenue and 71 feet fronting on Herschel Street. All yard and area requirements of the zoning and building codes will be cogiplied with; in addition there will be one off-street parking space per unit. Field investigation~discloses that this site is in an area of predominately single family homes with a few apartments.. In addition, there are commercial uses one block to the south on Selby Avenue. The frontage of the property l immediately to the north on Marshall Avenue is zoned for multi - family uses, although developed for single family purposes. By virtueof the existing zoning of the property to the north, and the general land use pattern for this area, existing and proposed,,the Board of Zoning finds that the proposed development would be proper for this area. The proposed plan will meet mini- mum standards.forbuilding coverage and dwelling unit density. E In consideration of the above factors, the Board of Zoning recommends that this petition be granted, subject to the condition that this property would be used for a maximum of four dwelling units on the vacant land, and that the size of the home be no more than 35 feet by 71 feet whether bbilt or moved on to this site, and that these conditions be made a part of the ordinance for granting this reclassification.
