A RESOLUTION REGARDING TRANS FAT AND MENU LABELING
�0
WHEREAS, it is a funcrion of the City CouncIl to safeguard the health of all of its cirizens, and to estabhsh,
maintain, implement, promote and conduct appropriate acrions for the puxpose of protecung the public health; and
TRANSFAT
WHEREAS, health authorities worldwide recognize that earing uans fat that sesult from paztial hydrogenarion is
neither requiued nor beneficial for health, increases the risk of coxonary heazt disease, and creates mote of a health
xisk than consumpuon of fats that occur natucally; and
WFiEREAS, high level oF consumpuon of aztificial trans fat has been £ound to increase LDL ("bad") cholesterol
and decrease HDL ("good") cholestexol; and
WHEREAS, trans fat is found in fried foods and baked goods made unth paxpally hyckogenated vegetable oils,
including French fries, doughnuts, pastries, pie crusts, biscuits, pizza dough, snack chips, cookies, crackers, sdck
margarines, and shortenings; and
WHEREAS, in May 2005, Tiburon, Califomia, became the first city in the nauon whexe all restaurants voluntarily
cook urith uans-fat-free offs; and
WHEREAS, effecrive January 2006, the Food and Drug Adrninistrauon (FDA) xequired food companies to list
trans fat content separately on the Nutririon Facts panel of all packaged goods, such as snack chips and cookies; and
WIIEREAS, the FD�'s acrion has caused many food manufacturers, such as Fxito-Lay, PeppeTidge Farms,
Country Crock, Lean Cuisine, and Kellogg's to xeformulate theix foods; and
WHEREAS, the FDA regulation does not apply to restauxants, and many xesta�ixants have lagged behind food
manufactuxexs in their effoxts to eliminate or reduce uans Fat; and
WHEREAS, in Decembex 2006, New Yock City became the fixst city in the nafion to ban artiflcial trans fat m all its
sestausants; and
WHEREAS, in May 2007, Montgomery County became the first county in the narion to Testrict artificial trans fat
by banning paztially hy�ogenated oils in restauxants, supermaxket bakeries and delis; and
WHEREAS, orher ciues and counries axound the nation have adopted sunilax legislarion banning the use of
arhficial trans fat, lncluding the ciries of Boston, Chicagq Cleveland, Philadelphia, Seatde and StamFord, and
counties of King, WA, and San Francisco, CA; and
WHBREAS, in July 2008, Califomia became the fixst state in the narion to ban astificial trans fat in zestauxants and
other food facilmes; and

WHEREAS, obesiry is a serious and gzowing public health crisis affecting stares and localities aaoss rhe countcy
and smdies show that consumeis aze unable to accuxately esnmate the nutndonal and caloric content of xestauzant
food; and
WI3EREAS, in oxdex to combat the serious public health crisis xesulting from obesity, and the attendant fmancial
costs and othu impacts, it is necessary that consumexs have access to basic nutrient and calorie m£ormation; and
WHEREAS, pxovidtng basic nutrient and calone in£onnauon m a menu item ro consumexs at the point of
puxchase would assis[ consumeis in making an infoimed deusion in furthexance of theix individual health and
welfaze; and
WHEREAS, evtdence from a study conducted by Technoms Inc. suggests that when calorie informarion is
avatlable, people aze likely to use it ro make heakhy choices;
NOW, THEREFORE� BE IT RESOLVED, that the Ciry Council requests chat the Depacttnent of Safery and
Inspecttons (DSn wosk with the Minnesota Restauxant Associarion to sutvey the xestauxant industry regazcling trans
fat in food pxepaxation and menu labeling pxactices and that DSI xepart to the City Council by Apiil I5, 2009, the
sutt�ey xesults.
BE IT FURTHER RESOLVED, that the Ciry Councfl suppoxts fedexal legislauon xeducing or eliminaung
axtificial txans fat content m food pxeparation and xeqwring xestauxants to pxovide nutxmon infoxmaaon, including
caloxies, on menus. If Congxess faIls to take action by Novembex 2009, the City Council requests the Depaztment
oE Safery and Inspections ro develop secommendations fos state ox local xegulauon, as appiopiiate.
