A RESOLUTION SUPPORTING'�'HE "MARRIAGE AND FAMILY PROTECTION ACT" AS
INTRODUCED IN MINNESOTA SENATE BILL 120 AND HOUSE BILL 893
WI IEREAS, marriage is one of the fundamental elements of individual liberty; and
WIiEREAS, the United States Constiturion states that no laws will be made depriving any pexson of life, libexty or
property without due process of law; and that no person within its jurisdicrion will be denied equal piotecuon of the
laws; and
WHEREAS, all amendments to the United States Consutution heretofore either clarified or expanded the narion's
vision of equahty, liberry, and the puxsuit of happiness; and
WIIEREAS, the mstitunon of mamage serves as one of the buildmg blocks of society, suengthemng and stabilizmg
relationships between individuals; and
WHEREAS, the institution of marriage provides benefits to society thxough a system of laws that regulate inheritance,
the pxovision of benefits from government and private pxogzams, the provision of inedical c�e to pexsons who are not
able to make theu� own medical decisions, and responsibility for financial obhgations, among othex axeas; and
WHEREAS, extending the insriturion of marriage to same-sex couples gives entities such as the courts, govexnment
and private progxams, medical institutions, banks, and othexs the benefits of using the established legal structuxe that
suxrounds mazriage in seroing same-sex couples; and
WHEREAS, the oppoxtunity to commit publicly and legally to share one's life wirh a person of one's choice is fox
many people one of the most central aspect of the human expexience, and denial of marriage to same-sex couples is a
denial of fundamental human rights; and
WHEREAS, same-sex couples deseroe the same nghts and legal pxotection as other families undex the law, including
protection of their spousal rights and pxivIleges and pxotection of their ctuldren's economic interests by insuxing the�
access to the resouxces of both paxents;
WHEREAS, same-sex marriage, as any othex marriage, provides family stability and pexsonal happiness to
gay/lesbian/bisexual/transgendex couples, theu childxen, and their extended families; and
WHEREAS, denying civil maxxiage to gay/lesbian/biseaual/txansgender couples would deprive them of certain rights,
psivileges, immunides, protecuons, and xesponsibilitres; and
WHEREAS, discrimniatory civil marriage laws xesult, especially, in significant haxm to lesbian, gay, bisexual and
transgendered people by pexpetuaung homophobia, just as anti-miscegenadon laws bazring people of different races
from mazrying perpetuated xacism and social osteacism; and
WHEREAS, discriminatory civil maznage laws undermine the United States' comnutment to equality, privacy and
justice fox all of its citizens; and

WHEREAS, in February 2004, Massachusetts Supzeme Judicial Court ruled in "Goodridge V. Department of Public
Health" that the govemment may no longer deny marriage and muriage rights to same-ses couples because it is
unconsrituuonai under the libertc and equalin provisions of the Massachusetts Constirurion, and
WIIEREAS, the City of Saint Paul has bc local pracnce, policy, and oxdinance shoum its commitment to faii and
equitable txeatment of all and by affording equal rights and benefits to ga��/lesbian/bisexual/uansgendex couples
residing in the Citv, would set an example of excellence in the non-discnminatorv treatment of all persons and the
pxomotion of the ideal of diversity; and
WHEREAS, the City of Saint Paul calls upon the State of Muinesota and its counry and city governments to
xecognize same-sex marriages; and
NOW, THEREFORE, BE IT RESOLVED, that the Ciry Council of Saint Paul suppoxts Senate Bill 120 and
House Bill 893 regarding the "Marriage and Family Pxotecrion Act," which would not restrict maniage to a union
between a man and a woman and would protect all families of Minnesota.
