Marschke; and WHEREAS, the City of Saint Paul has incurred medical expenses in the amount of $92.10 therefor, and the employe, by reason of said injury, was disabled for work for a period of five working days, being paid the amount of $90.50 therefor; and WHEREAS, a settlement has been negotiated by the parties in the total amount of $1,900.00, including any amount to which the City would be subrogated for medical expense and salary, and attorneys for said employe, McGuigan & McGuigan, have offered $100 to the City in full settlement of its claim in connection therewith, their draft for such amount having been received by the office of the Corporation Counsel; and WHEREAS, in view of the injuries of the employe, in- cluding a 10% permanent partial disability to his left thumb sustained in said accident, and the fact that there will be -" no claim therefor or any further claim on the City made by the employe because of said injury on duty, and the attorneys for said employe will waive the usual 25% fee to which they would be entitled for obtaining settlement of the City's claim, the office of the Corporation Counsel recommends acceptance of said amount of $100.00 in full settlement. of the City's claim for medical expenses and salary paid; now, therefore, be it RESOLVED, The proper City Officers are hereby authorized to accept said amount oft-$100.00 in full settlement of the amount due the City of Saint Paul in connection with the injury sustained by said employe in said third party accident; and the proper .,.City officers are hereby authorized to execute any necessary /releases; and be it further resolved that of said settlement of $100.00, the amount of $50.00 be credited to fund 31 -G1 -A and the amount of $50.00 be credited to fund 7 -C -1.
