WHEREAS, Donald Swenson, an employe of the Department
of Public Safety of the City of Saint Paul, was injured on
September 1, 1957, when, in the performance of his duties for
the Department of Public Safety, he was struck by an automobile
driven by Charles K. Marschke; and
WHEREAS, the City of Saint Paul has incurred medical
expenses in the amount of $92.10 therefor, and the employe, by
reason of said injury, was disabled for work for a period of
five working days, being paid the amount of $90.50 therefor; and
WHEREAS, a settlement has been negotiated by the parties
in the total amount of $1,900.00, including any amount to which
the City would be subrogated for medical expense and salary, and
attorneys for said employe, McGuigan & McGuigan, have offered $100 to
the City in full settlement of its claim in connection therewith,
their draft for such amount having been received by the office
of the Corporation Counsel; and
WHEREAS, in view of the injuries of the employe, in-
cluding a 10% permanent partial disability to his left thumb
sustained in said accident, and the fact that there will be
-" no claim therefor or any further claim on the City made by the
employe because of said injury on duty, and the attorneys for
said employe will waive the usual 25% fee to which they would
be entitled for obtaining settlement of the City's claim, the
office of the Corporation Counsel recommends acceptance of said
amount of $100.00 in full settlement. of the City's claim for
medical expenses and salary paid; now, therefore, be it
RESOLVED, The proper City Officers are hereby authorized
to accept said amount oft-$100.00 in full settlement of the amount
due the City of Saint Paul in connection with the injury sustained
by said employe in said third party accident; and the proper .,.City
officers are hereby authorized to execute any necessary /releases;
and be it further resolved that of said settlement of $100.00,
the amount of $50.00 be credited to fund 31 -G1 -A and the amount
of $50.00 be credited to fund 7 -C -1.
