THE COUNCIL OF THE CITY OF SAINT PAUL DOES CRDA IN:
Section 1. That Chapters 60 to 64 inclusive, of
the Saint Paul Legislative Code, pertaining to the Zoning
Code, Use Districts, and-Rezoning of certain properties in
the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the following described property
from "C" Residence District to "B" Residence District, to -wit:
Lots 1 through 13 inclusive, Block 2,
Royal Oaks, according to the plat
thereof on file and of record in the
office of the Register of Deeds in
and for Ramsey County, Minnesota,
said property fronting on the south
side of Como .Avenue, between Avon and
Grotto Streets.
Section 2. This ordinance is'hereby declared to
be an emergency ordinance rendered necessary for the preser-
vation of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication'.

This is in the matter of the application of Ludvig M. Vanelli et al to rezone
from "C" Residence to "B" Residence property fronting on the south side of Como
Avenue between Avon and.Grotto Streets. This property is described as Lots latbru
13 inclusive, Block 2, Royal Oaks Addition. The property under consideration has
been zoned "C" Residence since the adoption of the zoning ordinance in 1928.
The owners of '18 out of',20,'or 90 per cent of the several descriptions located with-
in 100 feet of'the area sought to be reclassified have consented to this petition,
and 75 per cent of the frontage involved within the area sought to be reclassified
have signed this petition. Of -the four parcels in this block to be rezoned which
were not counted, in three cases one -half credit for the signature on the petition
was given. The property under consideration is developed with single family homes
except for two lots; one near the middle of the block, and one large irregular Y
tract of ground on the west end of the block at the intersection of Jessamine, Avon
and Como Avenues. The attached map shows the area to be rezoned in relationship
to those owners whose names appear on the petition.
The basic purpose of this petition is to prevent the construction of a seven unit
apartment building on the irregular lot located adjacent to the intersection of
Avon Street, Jessamine and Como Avenues. There is presently pending before the
City Council an appeal to establish a new building line on Jessamine Street in
connection with this proposed apartment building. When the Zoning Board considered
this rezoning petition, several of the owners of property in the area appeared in
favor of this petition. These people informed the Zoning Board that it was their
purpose and intent to preserve the single family character of thisswea, although
they had no objection to two-family occupancies. In addition, Mr. Schreiber,wbo
intends to construct an apartment building, appeared with his attorney in opposition
to the proposed reclassification. Mr., Ulvin, attorney for Mr.Schreiber, told the
Board that his client objected to the rezoning of this property on the grounds that
the recent purchase of this property was made only after an intensive examination "
of the records in the planning board, which research showed that his client would
be permitted to construct an apartment building on this property, and in fact, if
it were not for the desire of his client to construct this building in a manner
to preserve in his opinion the character of the area, by requesting a change in
the building line, this building would now be well under construction. The pro-
ponents of the rezoning petition told the Board that the rezoning of this property
was started after they discovered that the intended use was to be an apartment
building, and that they were originally informed that it was to be a two - family
bungalow. They felt that this rezoning was needed at this time to retain the basic
single family character of the neighborhood, and thereby protect the use of the
homes in the area for one and two - family dwellings. Furthermore, they felt this
rezoning would prevent the neighborhood from rapidly deteriorating which, in their
opinion, would occur if this apartment building is constructed.

The Board of Zoning, with the benefit of the testimony of the interested
parties involved on both sides of this issue, are of the opinion that the
"C" Residence classification should be retained in this instance, on the
grounds that Mr. Schreiber, before the purchase of this one lot, checked
the public records and determined that the proposed use of a seven unit
apartment building was proper at this location, and purchased the property
on this basis.' They felt that this property having been classified for "C"
Residence since 1922, necessary steps to change this zoning should have been
taken prior to a purchaser buying property and spending money for improvements
under existing regulations. The Board of Zoning finds no objection to the
reclassification of the remaining portion of this block from "C" residence to
"B" Residence which would require the filing of another petition.
Therefore, the Board of Zoning recommends that this petition to reclassify
from "C" Residence to "B" Residence the entire block on the south side of
Como Avenue between Grotto and Avon Streets be denied.
