WHEREA Department o Safety and Inspections has requested the City Council to

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of 5afety and Inspections on or before June 9, 2008, the
following are the now known interested or responsible parties far the Subject Property:
Deutsche Bank Nat Trust CO, 1610 East St. Andrews Street, Santa Ana, CA 92705; Usset,
Weingarden & Liebo, 4500 Puk Glen Rd, #120, Minneapolis, MN 55416; Michael Olsen,
Keller Williams Premier Realty, 659 Bielenberg Dr, #100, Woodbury, MN 55125; West Side
Citizens Organization.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Naisance Building(s)" dated September 3, 2008; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by October 3, 200$; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served tiotice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 9 and December 23, 2008 to hear testimony and evidence,

and after receiving testimony and evidence, made the recommendation to approve the request to
order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 7, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 178 CONGRESS STREET WEST.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00). �
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then laiown
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been conected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not dehimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
��k� demolition and removal of the structure must be completed within
fdteen (15) days after the date of the Council Hearing.
If the above conective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accardance with Chapter 45 of the Saint Paul Legislative Code.

The building is a two-story, wood frame, single-family dwelling with an attached gazage, on a lot
of 2,614 squaze feet.
According to our files, it has been a vacant building since February 7, 2008.
The current property owner is Deutsche Bank National Trust Co., per AMANDA and Ramsey
county property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been two (2) SUMMARY ABATEMENT NOTICES since 2008.
There has been one (1) WORK ORDER issued for:
- Boarding
On August 5, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A Ni1ISANCE BUILDING was posted on September 3, 2008 with a compliance date of
October 3, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees aze paid.
Taxation has placed an estimated mazket value of $59,700 on the land and $116,900 on the
building.
As of December 8, 2008, the $5,000.00 performance bond has not been posted.
As of August 18, 2008, a Code Compliance inspection has been completed.
Rea1 Estate taxes for the year 2008 are delinquent in the amount of $3,012.80 plus penalty and

Code Enforcement Officers estimate the cost to repair this structure is $70,000-$80,000. The

The Vacant/Nuisance Buildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

45.02, and subject to demolition under authority of Chapter 45.11.
On August 5, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of de�ciencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspecfion will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condirion. You
may also be required to post a five thousand dollar ($5,000.00) performance
bond with the Building Inspection and Design Oftice before any permits are
issued, except for a demolition permit.

and shall not again be used for occupancy until such rime as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story, wood frame, single family dwelling and its attached, tuck-under
garage.
Interior
1. There is loose, hazardous carpet on the stairs to the 2" floor.
2. There are no smoke detectors.
3. There are no approved handrails.
4. There is water damaged, partially collapsed ceilings.
5. There is water damaged, warped floors.
6. There are water damaged walls.
7. There is mold.
8. There is missing copper water and heating lines; theft
9. There is heating lines with damaged or missing insulation; asbestos possible.
Exterior
10. The gas meter is locked off
11. The electric meter is removed.
12. The water service is off.
13. The foundation has deteriorated mortar joints.

As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by October 3, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the

requirements to correct this nuisance condition.
As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Departrnent of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the Ciry shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

the water service.
Bond around water meter with a copper wire sized for the electrical service per
Article 250 of the NEC.

ELECTRICAL
4. Verify that fuse/circuit breaker amperage matches wire size.
5. Provide one (1) light for each 200 square feet in unfinished basement. One light must
be switched from the top of the stairs.
6. Remove all cord wiring.
7. Repair or replace all broken, missing or loose light fixtures, switches & outlets,
covers and plates.
8. Install hard-wired, battery backup smoke detector as specified in Bulletin 80-1 and
other smoke detectors as required by the IRC.
9. Install exterior lights at fronUside and back entry doors.
10. Install receptacle for garage door opener.
11. Remove and/or rewire all illegal, improper or hazardous wiring in basement and
garage.
12. The dwelling has no power.
PLUMBING
All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
1. Wire entire house to Bulletin 80-1.
2. The water heater temperature and pressure relief valve is required.
3. The water heater temperature and pressure relief valve discharge piping is inconect.
4. The water heater piping is incorrect.
5. The water meter is removed and not in service.
6. All water meter piping missing.
7. The boiler fill water line requires back flow assembly or device.
8. Replace corroded gas piping.
9. The soil and waste piping has no front sewer cleanout; no soil stack base cleanout.
10. The soil and waste has improper pipe supports and improper connections,
transitions, fitting or pipe usage.
11. The second floor toilet fixture is broken, or parts missing.

HEATING
1. Provide heat loss for use electric heaters in kitchen and electrical data for electric
heaters.
2. Repairheplace all inoperable radiatar shut off valves.
3. Provide documentation from licensed contractor for asbestos abatement or
encapsulated.

HEATING
4. Install bathroom ventilation for second floor bathroom.
5. Install approved lever handle manual gas shutoff valve on all gas appliances.
Remove all unapproved lubricated plug gas valves.
6. Clean and Orsat boiler burner. Check all controls for proper operation. Check
furnace heat exchanger for leaks; provide documentation from a licensed
contractor that the heating unit is safe.
7. Vent clothes dryer to code. (Ventilation permit and inspecuon is required).
8. Provide adequate combustion air and support to code.
9. Provide support for gas lines to code. Plug, cap and/or remove all disconnected
gas lines.
10. Provide heat in every habitable room and bathrooms.
11. Attach metal tag to expansion tank valve stating that this valve must be OPEN at
all time except when draining the expansion tank.
12. Support supply and return piping for heating system according to code.
13. Provide witnessed test for hot water/steam heating system and check for leaks.
14. Provide back flow preventer on city water fill line to hot water/steasn heating
system.
15. Appropriate mechanical warm air ventilation permits are required far this wark.

5. Ordering the owner to remove or repair the building(s) at 178 Congress Street West within
fifteen (15) days from adoption ofresolution.
The property owner of record, Deutsche Bank National Trust Co., did not appear. No other parties
of interest appeared.
Mr. Magner stated the building was a two-story, wood frame, single-family dwellin� with an
attached gazage on a lot of 2,614 square feet and had been vacant since February 7, 2008. A code
compliance inspection had been done on August 18, 2008, the vacant building registration fees were
current, and the $5,000 performance bond had not been posted. On August 5, 2008, an inspection
of the building was done and a list of deficiencies which constitute a nuisance condition was
developed. An order to abate a nuisance building was posted on September 3, 2008 with a
compliance date of October 3, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the
market value of the land to be approximately $59,700 and the building to be $116,900. Real estate
taaces for 2008 were delinquent in the amount of $3,012.80, plus penalty and interest. Code
Enforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The
cost for demolition was estimated to be approximately $9,887 to $12,887. There had also been two
sumrnary abatements issued to this property since 2008, one of which went to work order: to secure
the building and the City had to board the building to secure it from trespass and boarding. Code
Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1904 and was a vemacular style-building. She noted that there were three similar houses built on
one lot and this particular building anchored the corner. Although this building had not been
surveyed, she encouraged rehabilitation.
Mr. Magner stated that the history of this property was that the water service for 468 Bellows
Avenue was connected to 178 Congress. When Congress became vacant, the water was shut off
after the pipes froze which also cut off the water service to 468 Bellows. A new water service
connection was then created for 468 Bellows and the property was currently occupied. It was his
understanding in conversation with the owner of 468 Bellows that the business partner intended to
purchase 178 Congress and had planned to attend this hearing. Since he had not heard anything to
the contrary, he did not laiow whether plans had changed.
Ms Moermond recommended continuing the Legislative Hearing to December 23.

Mr. Magner stated that he had not heard from any party interested in saving this property.
Ms. Spong asked whether the corner retaining wall could be saved if the building was going to be
demolished. Mr. Magner responded that he would need to check with the demolition contractor;
however, he believed there was no way to ingess the property from the back of the property.
Ms. Moermond requested a follow up at the January 6 hearing for determination on whether the
retaining wall can be saved. She recommended the building be removed within 15 days with no
option for repair.
