A public hearing having been had upon the taking and condemnation of the lands or easements therein,
for the above improvement, and the awards of damages therefor, and also upon the assessment of benefits
therefor, and the Council having duly considered the same, now therefore be it
Resolved, That the taking and condemnation of the lands described in the annexed assessment roll,
identified by the signature of the Commissioner of Finance, and made a part hereof, and the awards of
damages to the owners of such lands for said taking and condemnation as set forth in said assessment roll,
be and the same is hereby in all respects ratified and confirmed.
Resolved further, that the said assessment of benefits, be and the same is hereby in all respects ratified,
and the same is hereby ordered to be submitted to the District Court for confirmation.
Be it further Resolved, that the said assessment be and it is hereby determined to be payable

TO THE CITY COUNCIL OF THE CITY OF SAINT PAUL; MINNESOTA:
The undersigned, Montgomery Ward & -Co., Incorporated,
the owner of property proposed to be taken by the City of Saint
Paul in the above entitled condemnation proceeding hereby objects
to the taking of the property of this objector and of any easement
therein and objects to the amount of damages proposed to be awarded
for said taking as incorporated in the report of the Commissioner
of- Finance and as-g`rounds -for such-,objections states:

That-there-is no public necessity for the taking of

the property or any easement in the property of the petitioner which

it is proposedzt-o take--yand condemn in this proceeding; that said
proposed taking is not for a public purpose and deprives the petitioner
of its said property in violation of its rights under the Constitution
and Laws of the State of Minnesota.
(2) That the amount of damage's proposed to be awarded
for the -taking -of the property of this objector is wholly inadequate
and is not a fair award and said proposed award deprives objector of
its property without•the payment of just compensation therefor.
