Johnson, an employe of the Department of Public Safety of the City of Saint Paul, was injured on January 14, 1957, in a third party accident, while engaged in the performance of his duties for the Department of Public Safety, and the City has incurred medical expenses in the amount of $90.00 therefor, and the employe, by reason of said injury, was disabled for work for a period of time, being paid the amount of $649.09 therefor; and WHEREAS, a settlement has been negotiated by the parties in the total amount of $2,200.00, of which the employe will receive the sum of $1,460.91, less att'orney's fees, in settlement of his claim against the party causing the accident, and the City will receive the sum of $554.32 for medical expense and wages paid said employe because -of said injury, said sum of $554.32 representing a settlement of $739.09 less attorney's fees of $184.77 to Bertie and Bettenburg, attorneys for Richard E. Johnson; and WHEREAS, the office of the Corporation Counsel is in possession of a check of said attorneys, Bertie and Bettenberg, in the amount of $554.32, payable to the City of Saint Paul toward its expenses and wages paid the employe, now, therefore, be it RESOLVED, The proper City officers are hereby authorized to accept said settlement, solely for the amount due the City in connection with the personal injury sustained by said employe, being its medical expenses incurred and salary paid, in the amount of $554.32, on behalf of the third party involved in sail accident, said amount to be credited as follows: to Fund 31 -G1 -A, $90.00; to Fund 7 -C -1, $464.32.
