These criteria are covered below under "Required Findings:' §69.705 regulates registered land surveys. F. HiSTORY/DISCUSSION: The site was formerly occupied by the H. B. Fuller Company. A site plan for H. B. Fuller was approved in 1991. G. DISTRICT COUNCIL RECOMMENDATION: District 12 had not commented on the application at the time the staff report was prepared. H. REQUIRED FINDINGS: § 69.406 of the Zoning Code requires that all of the following findings shall be made prior to approval of a subdivision: 1. AIl the applicable provisions of the Legislative Code are complied wi1h. City staff have reviewed the proposed RLS and have determined that all applicabte provisions of city codes are met, provided that a reciprocal easement agreement between Tracts A and B be filed within six months of City Council approval of the RLS and copies sent to the Department of Safety and Inspections and the Department of Fire and Safety Services. 2. The p�oposed subdivision will not be det�imentaJ to the present and potentia/ surrounding /and uses. The proposed RLS is consistenf with the surrounding land uses, and wiil not be detrimental to present and future use of surrounding land. 3. The area surrounding tlie subdivision can be planned and developed in coordination and compatibility with the proposed subdivision. The area surrounding the proposed RLS is already developed and compatibie with the proposed RLS. 4. The subdivision is in con(orrrrance with the comprehensive plan. The subdivision is in � conformance with the Land Use chapter of the comprehensive plan, which caAs for City support �or redevelopment of sites with good freeway access. Highway 280 is identified as a priricipai arterial i� the Transportat+on Pfan, and this site is ad}'acent to an exit from 280. The subdivision preserves and incorporates the srte's important existing natural features whenever possible. The site is a flat, fully devefoped area with no flooding, erosion, high water tabte or soii condition problems. 7. The subdivision can be economically served with pubiic facilities and services. The subdivision can be economically served with public facilities and services from surrounding streets. PARKLAND DEDICATION: §69.511 requires dedication of two (2) percent of the total land area of the plaf for public use, for parks, playgrounds, frails, open space, or conservation purposes. At the discretion of the City Council, a cash dedication in lieu of land may be paid prior to the city clerk's signing of the final plat. Since this subdivision is a Registered Land Survey rather than a plat, the provisions of § 69.511 {b) do not apply: The provisions of § 69.511(d) are applicable and a fee of $10,777.00 has been imposed as part of site plan approval.
