The rehabilitation or demolition of the structure to be campleted within fdteen (15) days after the date of the Council Hearing; and WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 18, 2009 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVEA, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 301 STURGIS STREET. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. F� � E� That the costs of demolition and removal of this building(s) is estimated to exceed five Yhousand dollars ($5,000,00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies ar to demolish and remove the building(s). That the deficiencies causing this nuisance condition have not been corrected. That Department of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by Department of Safety and Inspections, Vacant/Nuisance Buildings. SITE DESCRIPTION: The house at 301 Sturgis Street was consuucted in 1869 on a lot with a frame workers cottage, 299 Sturgis, constructed about 1870. The building permit index cazd show permifs being issued in 1888, This one-and-one-half story residence has a front gabled roof and a one-story rear addition that was constructed priox to 1903. The original siding is covered by asphalt shingle siding and the windows aze double-hung with a one-over-one configuration. There is one interior chimney and the foundation is not visible due to siding and snow. 299 Sturgis was identified and surveyed in the 1983 Historic Sites Survey and was listed in the 2001 Pioneer Houses Context Study. 299 and 301 Sturgis were identified as"First Wave Immigrant Buildings" in the 1992 Uppertown Survey. The 2008 Histaric Saint Paul neighborhood survey of the Uppertown Invest Saint Paul focus area also identified 301 Stwgis as architechual contributing to the neighborhood. B. PROPOSED CHANGES: Buring the Legislative Hearing on 7anuary 27, the Legislative heazing officer recommended the HPC consider this property for review as a histoxic resource. A historic resource is defined as "A propesry that is believed to have historical, cultural, architectural, archaeological or engineering significance and to meet at least one of the criteria far designation as a heritage preservation site or district as pxovided in this chapter." C. GUIDELINE CITA'I`IONS: Sec. 73.05. Designation of heritage preservation sites. (a) Criteria ln considering the designation of any azea, place, building, structure or similar ob}ect in the City of Saint Paul as a heritage preservation site; the commission shall apply the following criteria with respect to such designation: (1) Its character, interest or value as part of the development, heritage or cult�al characteristics of the City of Saint Pau1, State of Minnesota, ar the United States. (2) Its location as a site of a significant historic event. (3} Its identification with a person or persons who significantly contributed to the culture and development of ihe City of Saint Paul. (4) Its embodiment of distinguishing characteristics of an architectural or engineering type or specimen. (5) Its identification as the work oP an azchitect, engineer, or master builder whose individual �vork has influenced the development of the City of 5aint Paul. (6) Its embodiment of elements of azchitectuxal or engineering design, detail, materials or craftsmanship which represent a significant architectural or engineering innovation. Historic Resource Review D. FINDINGS l. The properry was not surveyed or identified during the 1983 Historic Sites Survey of Ramsey County, but was surveyed in the 1992 Uppertown Historic Survey and surveyed again in 2008 by neighborhood volunteers as part of Historic Saint Paul's Invest Saint Paul focus areas surveys. The 1983 survey states: "... the West Seventh Street neighborhood confains modest frame and brick houses built by German,Irish,Polish,Bohemian,andItalianimmigrantworkingclassfamilies. Thesebuildings are some of St. Paul's most azchitecturally and historically significant working class housing. They date from as eazly as the 1850s and 1860s when solid limestone workers' cottages such as the Mutin Weber Hause at 202 McBoal and the Anthony W aldman House at 445 N. Smith were built, as we11 as many smali 1 and 1 Yz story woodframe houses, some with dog-eared and segmental arched window aud door moldings. The Historic Sites Survey identified a number of houses situated unusuallyon lots, indicating rather haphazard development, houses doubled up on bts, and houses which stand today above or below the present street gradc' The survey identified 83 sites in District 9 as eligible for designation or as sites of major significance. The 1992 Uppertown survey recommended historic district boundaries that would include 301 Sturgis Street. Properties like 301 Sturgis Street aze integral to the historic context of the neighborhoods. No images were found in a seasch of the MN Visual Resource database. 2. A more intensive level survey would be required to determine if the building would be individually eligible for local designation or be eligible for the National Register. 3. It is always better to retain historic fabric type buildings than it is to demolish and cxeate ahole in the neighborhood. This particulaz block face has a vaziery of housing styles; most constructed in the 1880s or earlier. The house is a slightly altered one-and-one-half story frame workers cottage in Uppertown. 4. The integrity, or authenticity as evidenced by a site's location, design, setting, workmanship or association, is good because the alterations that have occurred, such as asphalt shingle siding over clapboard, aluminum wrapped soffit and fascia and non-original windows and doors are easily reversibte. The rear additions are evident on the 1903 Sanborn Map which also shows the building without front porch at that time. The site's location and setting would be considered to have good integrity. E. STAFT� RECOMMENDATION: Based on the findings, staff recommends that a qualified historian be hired to evaluate both National Register and local eligibiliry. Staff recommends that demolition be delayed for this site in order for alternatives to demolition to be explored, such as mothballing or rehabilitarion. For the 1195 Bush Avenue property, the HRA suppiied me with a draft of the donation agreement and I provided the HRA with my comments. I am waiting to hear back from the HRA. If and when we agree upon a donation agreement with the HRA for 1195 Bush Avenue, I expect that the agreements for other properties will look similar and that the length of negotiations will be significantly shortened. Due to the status of the negotiations, I understand that you agreed it was not necessary for someone from my office or me to attend the hearing on 938 DeSoto scheduled tomorrow morning in front of you. Tn addition, the City Council will consider a motion at its April 15, 2009, meeting, to order the demolition of the property located at 1195 Bush Avenue. I know your recommendation will be that City Council should order the property be demolished. As you discussed with Cndy Carlson, the HRA will agree to assume all of the costs of demolition in the donation agreement for 1195 Bush Avenue. Ms. Carlson called you on Friday, April 10, 2009 and updated you on the status of the negotiations. I understand you will be at the City Council hearing on April 15, 2009, and that you will inform the City Council of the HRA's indication that it will assume the cost of the demolition. As we discussed, based on your recommendation to demolish the property and the HRA's commitment to assume the costs of demolition, I do not plan on attending the City Council hearing. My client's goal is to compfete the donation agreement with the HRA as soon as possible. My office will continue to work diligently with Ms. Carlson to compiete the donation agreement. I have a couple of things to amend. I believe we discussed 301 Sturgis and 1195 Bush, and not 938 DeSoto. (938 DeSoto is on for its first Legislative Hearing 5/6/Q9, but I don't think we discussed it today.) About 1195 Bush: my recommendation is that the building be removed. I believe that your client's intentio� is to donate the property to the HRA. So the only question Ieft in the balance from my perspective is who will pay for the building's removal. I can certainly (and pfan to) inform the Councif that the HRA is discussing with you the donation of the property. However, I cannot say that the HRA wilf assume the costs, as you indicated in you email. This was simpiy my impression from Cindy Carlson as to how this would likely proceed. There are other posslbilities, and I think it would not be appropriate for me to surmise how this would proceed in terms of potential payments or reimbursements. From my perspective, payment for the removal of the building doesn't change the nature of the nuisance abatement discussion for the Council, as this is an enforcement discussion. About your attendance, I cannot advise you one way or the other. However, I think there is general agreement that the building should be removed, and that is the question in front of the Council. I expect your testimony would reinforce the recommendation and possibly provide commentary on the donation and cost of demolition, I understood that my informing the Cou�cil of the intended donation was (likely) sufficient. If you are unsure, or wish to monitor for any unplanned-for questions from the Council, you may wish to attend. I would hate for a circumstance to arise where the Council chose to do something different than my recommendation, only to have it be something you would have wanted the opportunity to testify about, but didn't, because of a conversation with me. And while I can teil you that I don't anticipate that, it is always a possibility. About 301 Sturgis, I believe I understood you to say that this property is also to be donated to the HRA, and that those conversations had been taking place since ]anuary. At the 1/27/09 hearing you indicated that your client wanted to get it into the hands of someone who could do the work. I referred this case to both to the Heritage Preservation Commission (HPC) and the West 7th/Fort Road Federation (the local CDC) to get their input. Given that the building was built in 1868 and that the e.xterior modifications have been more cosmetic than anything, the HPC wants the building saved. StafF at the W 7th Federation would be wilfing to either fix it or knock it down once they get feed6ack from their board. If iYs on its way to a neighborhood nonprofit CAC, the HRA is the usual intermediary. Given that the building's ultimate d+sposition is in Flux I think I need to do 2 things, neither of which require attendance by you or your firm at the hearing tomorrow. The first thing I need to do is to see if I can expedite the donation process with the HRA. I do not want to leave an order to remove/repair a nuisance bui�ding hanging out there without a conclusion. The second thing I need to do is ensure that a conciusion is reached in a timely fashion by the HRA/W 7th Federation as to how and when they will be abating the nuisance either through rehabilitation or demolition. According to our files, it has been a vacant building since September 20, 2005. The current property owners aze Kristine and Matthew Medick, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been seven (7) SUMMARY ABATEMENT NOTICES since 2005. There have been three (3) WORK ORDERS issued for: - Boarding On September 23, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on October 15, 2008 with a compliance date of November 14, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (By assessment 10/1/08, good thru 9/20/09) Taxation has piaced an estimated mazket value of $38,900 on the land and $97,500 on the building. As of January 26, 2009, a Code Compliance inspection has not been completed. As of January 26, 2009, the $5,000.00 performance bond has not been posted. Real Estate taaces for the years 2007-2008 aze delinquent in the amaunt of $3,228.78 plus penalty and interest, Code Enforcement Officers estimate the cost to repair this structure is $65,000 to $75,000. The estimated cost to Demolish is $8,700 to $11,700. Mr. Magner stated the building was a two- story, wood frame, single-family dwelling with a detached one and one-stall garage on a lot of 3,920 square feet and had been vacant since September 20, 2005. A code compliance inspection had not been done, the vacant building registration fees in the amount of $1,000 were paid by assessment on October 1, 2008, and the $5,000 performance bond had not been posted. On September 23, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An arder to abate a nuisance building was posted on October 15, 2008 with a compliance date of November 14, 2008. To date, tfie property remained in a condirion which comprised a nuisance as defined by the Legjslative Code. Ramsey County Ta:cation estimated the market value of the land to be approximately $38,900 and the building to be $97,500. Real estate taxes for 2007 and 2008 were delinquent in the amount of $3,228.78, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $65,000 to $75,000. The cost for demoliriou was esrimated to be approximately $8,700 to $11,700. There had also been seven summary abatements issued to this property since 2005, tlu of which went to work order: to secure the building and the City had to board the building to secure it from trespass, and boarding. Code Enforcement recommends the building be repaired or removed �vithin 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner responded that the code enforcement inspector for the area refened the building to the Vacant Buildings Program given the number of exterior violations, the building was open to entry, and appeared to be vacant. Ms. Moermond asked for a report from Ms. Boulware. Ms. Boulware stated that this building was built in 1868 and was a Victorian-style building. It had not been inventoried in 1983; however, it was a part of the 1992 Upper Town Survey and was surveyed as part of the Invest St. Paul Historic 5urvey done in August, 2008. The building had good integrity and she noted that there was an early rear addition added. She strongly encouraged rehabilitation of the property. Mr. Kelley stated that the property was being maintained and was secure from enhy. He said that his client was not in the business of doing rehab and would like to "get it into the hands" of someone who could do the work. He requested additional time. Ma Moermond stated that they would need to pay the delinquent real estate taxes. She also requested the vacant building form be filled out and submitted. She said siated that given the historical significance of this p�roperty, she recommended referring it to the HPC far review. Mr. Magner suggested the West 7` lFort Road Federation also be given the opportunity to review and make comments concerning this property. Ms. Moermond recoznmended laying this matter over to the April 14 Legislative Hearing and May 6 Council Public Hearing.
