referenced public hearin the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subj t Property at 519 BAY STREET.

Legislative Code, apter 45.

shall be removed from t property by the responsible parties by the end of this time
period. If all personal pro erty is not removed, it shall be considered to be abandoned
and the City of Saint Paul s 11 remove and dispose of such property as provided by law.
4. It is further ordered, that a copy�gf this resolution be mailed to the owners and interested

The building is a two-story, wood frame, three-unit dwelling, on a lot of 5,227 squaze feet.
According to our files, it has been a vacant building since September 7, 2007.
The current property owner is Bank of New York c/o Country Home Loans, per AMANDA and
Ramsey county property records.
The city has had to boazd this building to secure it from trespass.
There have been nine (9) SUMMARY ABATEMENT NOTICES since 2007.
There have been nine (9) WORK ORDERS issued for:
- Boarding
- Removal of improperly stored refuse and debris
On September 25, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on October 15, 2008 with a compliance date of
November 14, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (By assessment 10/1/08, good thru 9/7/09)
TaYation has placed an estimated market value of $46,800 on the land and $179,800 on the
buiiding.
As of January 26, 2009, a Code Compliance inspection has not been completed. (C of O Team
Inspection completed on 8/1/08).
As of January 26, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taxes are current.
Code Enforcement Officers estimate the cost to repair this structure is $70,000 to $80,000. The
estunated cost to Demolish is $10,300 to $14,300.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

On September 25, 2008, a Building Deficiency Inspection Report was compiled and the
following conditions were observed.

ORDER:
Repair the structure to a habitable condirion.

This strucbare is a registered vacant building that must have a Code Compliance
Certificate before the structure may be occupied. Obtain a Code Compliance
Certificate from the Deparhnent of Safety and Inspections. You may contact Jim
Seeger at D.S.I, 651-266-9016, for a code compliance inspection, permits, and
issuance of Code Comptiance Certificate. Under Chapter 33.03 of the Saint Paul
Legislative Code, failure to obtain a Code Compliance Certificate before
occupying the structure may result in issuance of criminal summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance corcdition is not conected by November 14, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compiiance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate° to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership ar
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which deciares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,

Division of Code Enforcement. The department is further required to file a copv of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time iestimony �vill be
heard from interested parties. After this hearsng the City Council wi11 adopt a resolution stating
what action if any, it deems appropriate.
Lf the resolution cails for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

2. Ordering the owner to remove or repair the building(s) at 519 Ba� within fifteen (15)
days from adoption of resolution.
The property owner of record, Bank of New York c/o Country Home Loans, did not appear.
Douglas Coppess appeazed and stated that he and a partner had made an offer to purchase the
property at auction in mid-November which offer had been accepted. The closing had been
scheduled for December 1; however, he then became aware that it was a Category 3 vacant buildin�
which required the property be brought up to code before it could be sold. He was able to get his
money back; however, he believed the building was a good, solid structure and he wanted to be
granted the tnne to do the rehab. He said he also had rehabbed several other Category 2 vacant
buildings in St. Paul.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two-
story, wood frame, three-unit dwelling on a lot of 5,227 square feet and had been vacant since
September 7, 2007. A C of O team inspection had been done on August 1, 2008, the vacant
building registration fees in the amount of $1,000 were paid by assessment on October 1, 2008, and
the $5,000 performance bond had not been posted. On September 25, 2008, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on October 15, 2008 with a compliance date of
November 14, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land
to be approximately $46,800 and the building to be $179,800. Real estate taxes were current. Code
Enforcement estimates the cost to repair the building to be approximately $70,000 to $80,000. The
cost for demolition was estimated to be approximately $10,300 to $14,300. There had also been
nine summary abatements issued to this property since 2007, nine of which went to work order: to
secure the building and the City had to boud the building to secure it from trespass, boarding, and
remove improperly stored refuse and debris. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner said that in looking at STAMP, this property was
zoned RTl which would allow for a two-family dwelling; however a tri-plex would be a non-
confirming use particularly given the size of the lot. Since the building had been vacant for more
than one year, any non-conforming use would have to go through the Planning Commission for
review and recommendation. He presented photographs of the property.
Ms. Moermond asked for a report from Ms. Boulware. Ms. Boulwaze stated that this building was
built in 1875 and was an Italianate-style building. It had been inventoried in 1983, had good
integrity with the original siding being visible and an early addition being added to the structure.
She encouraged rehabilitation.
Ms. Moermond asked Mr. Magner about the ownership l�istory of the property. Mr. Magner
responded that in 2003, the owner was listed as Josey Perez. This was a case managed property due
to the nuisance conditions and behavior of the tenants at the property and the unresponsiveness of
the property owner to address those concerns.
Mr. Coppess stated that while he could understand there was a history of problems with the
previous owner, he said he should be given the chance to bring the building up to code as a tri-plex
and that if he had to get a variance to do so, he would. He said that he was working with
Countrywide on addendums to the agreement so that he could purchase the property and that he had

the money for the bond as well as financing available to do the rehabilitation. He requested
additional time to be able to do the rehab.

Ms. Moermond responded that the code required a Category 3 vacant building must be brought up
to code by the owner of the property before it could be sold. This was a directive by the City
Council and she was not in a position to waiver from this requirement. She told Mr. Coppess that
since he did not own the property, she could not recommend granting him the time to rehabilitate
the property. She said that given the history of summary abatement orders that had gone to work
order, it was obvious that the bank had not been maintaining this property. She also said that given
the zoning, she would recommend the building be de-converted to a single-family residence.
Ms. Moermond stated that given the historical significance of this pro�erty, she recommended
referring it to the HPC for review. Mr. Magner suggested the West 7/Fort Road Federation also be
given the opportunity to review and make comments concerning this property. Ms. Moermond
recommended laying this matter over to the April 14 Legislative Hearing and May 6 Council Public
Hearing.

A. SITE DESCRIPTION: The house at 519 Bay Street was constructed ca. 1875, prior to the
issuance of building permits in the City of Saint Paul, The building permit index card lists John
Zahradim (Zahademik) as the owner from as eazly as 1885 to 1892. This Italianate style house is two
stories with hipped and central �able roof and gable roofed two-story and one-story kitchen additions
at the rear. The additions were constructed prior to 1903. Visible omamentation includes the
bullseye attic window, gable returns, incised carving in the window frames and a transom window
over the front door. The ariginal siding is covered by aluminum siding and original two-over-two
and one-over-one windows sit behind aluminum storms. There is one interiar chimney and a
limestone foundation.
B. PROPOSED CHANGES: During the Legislative Heazing on January 27, the Legislative
hearing officer recommended the HPC consider this property for review as a historic resource. A
historic resource is defined as "A propeiTy that is believed to have historical, cultural, architectural,
archaeological or engineering significance and to meet at least one of the criteria for designation as a
heritage preservation site or district as provided in this chapter."
G GUIDELINE CITATIONS:
Sec. 73.05. Designation of heritage preservation sites.
(a) Criteria. In considering the designation of any area, place, building, structure or similar object
in the City of Saint Paul as a heritage preservation site; the commission shall apply the following
criteria with respect to such designation:
(1) Its character, interest or value as part of the development, heritage or cultural chazacteristics
of the City of Saint Paul, State of Minnesota, or the United States.
(2) Its location as a site of a significant historic event.
(3) Its identification with a person or persons who significantly contributed to the culture and
development of the City of Saint Paul.
(4) Its embodiment of distinguishing characteristics of an architectural or engineering type or
specimen.
(5) Its identificarion as the work of an architect, engineer, or master builder whose individual
work has influenced the development of the City of Saint Paul.
(6} Its embodiment of elements of architectural or engineering design, detail, materials ar
craftsmanship which represent a significant azchitectural or engineering innovation.
(7) Its unique location or singulaz physical characteiistic repTesenting an established and familiar
visual feature of a neighborhood, community or the City of Saint Paul.

D. FINDINGS
1. The property was surveyed and identified during the 1983 IIistoric Sites Survey of Ramsey
Counry (RA-SPG0299). The survey states:
"District 9 also contains a tremendous concentration of lazger brick and wood-frame houses dating
from the 1870s through the tum of the century. Many have intact open porches. These houses
represent the Italianate, Queen Anne, Eastlake, and Colonial Revivai ad other styles."
The survey identified 83 sites in District 9 as eligible for designation or as sites of major
significance. Properties like 519 Bay Str�eet aze integral to the historic context of the
neighborhoods. No images were found in a seazch of the MN Visual Resource database.
2. A more intensive level survey would be required to determine if the building would be
individually eligible for local designation or be eligible for the National Register.
3. It is always better to retain historic fabric type buildings than it is to demolish and create a hole in
the neighborhood. This pazticular block face has a variety of housing styles; most constructed
prior 1883 when building permit records began in the city and up until 1910. The house is a
mosUy intact example of I 870s Italianate residential construction in the West End.
4. The integrity, or authenticity as evidenced by a site's location, design, setting, workmanship or
association, is good because the alterations that have occurred, such as aluminum siding over
clapboard, non-ariginal storm windows and doors are easily reversible. The rear additions are
evident on the 1903 Sanborn Map which also shows the building did not have a front poTCh at
that time. There aze still design features intact on this property. The site's location and setting
would be considered to have good integrity.
E. STAFF RECOMMENDATION: Based on the findings, staff recommends that a qualified
historian be hired to evaluate both National Register and local eligibility. Staff recommends that
demolition be delayed for this site in order for altematives to demolition to be explored, such as
mothballing or rehabilitation.
