Sauer to construct a storm sewer upon the center line of the public alley in Registered Land Survey No. 104, from a point approximately 148 feet east of the center line of Winthrop Street extended, to and connecting with the public sewer presently constructed, maintained and operated in said Winthrop Street. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. .THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Yea Attu 1M 11 Section 1. That permission and authority are ereby granted to Louis V, Sauer to construct, at,.his own expense, a storm sewer upon the nter line of the p blic alley in Registered Land Survey No. 104, from a point approximately 148 feet east of the center line of Winthrop Street extended, to and connecting with the public sewer presently constructed, maintained and operated in said Winthrop Street, Section 2. The Commissioner of Public Works is hereby authorized to issue a permit to said ,.Louis V. Sauer for the con - struction of said storm sewer, upon his compliance with the following c editions, viz: J W Lo 1. Said permittee shall con struct4-,THa t-e rc and �p_pr = +A said storm sewer entirely .,at his own expense, under the supervision and to the satisfaction of the Commissioner of Public Works, and in accordance with plans and specifi- tions approved by said Commissioner and by the Chief Engineer of the City of Saint Paul. 2. Said permittee shall pay the cost of engineering and inspection of said work, and also the cost of publication of this ordinance. 3. Said permittee shall properly protect all excavations made in the said alley, both day and night, so as to avoid all damage or injury to person or property, and shall properly fill and tamp said alley to avoid settling, and shall restore said alley to its original condition. 4. ]Said permittee, after the inception of said work; shall prosecute same continuously, with diligence, and fully complete said work, to the satisfaction and approval of said Commissioner, on or before October] �rlxinal to City Cleric • y ORDINANCE 188.1 -92 COUNCIL FILE NO. Said permittee shall furnish a bond to the City of Saint Paul, in the sum of $5,000.00, conditioned to comply with all the terms of this ordinance, and to indemnify and save harmless said City from all liability, charggs, loss, judgments, suits, costs or expense that may accrue to persons e:f--o?' property occasioned by the making of said improve- ment or arising out of the same. 60' Said permittee shall, within 10 days after the passage and publication of this ordinance, file a written acceptance thereof with the City Clerk. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. Section 4. This ordinance shall take effect and be in force from and after its passage, approval and publication.
