THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
I� Section 1. That the Zoning Code, Chapters 60 to 64 inclu-
s s ve, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is hereby
further amended so as to rezone the follovk ng described property
from "B" Residence District to "Alt Residence District:
Lots 16 through 30, Block 5, and Lots 1 through 15,
Block 4, Summit Park Addition, according to the plat
thereof on file and of record in the office of the
Register of Deeds in and for Ramsey County, Minnesota,
being both sides of Lincoln Avenue from Grotto to St. Albans
Streets.
Section 2. That despite such rezoning of said real estate
hereunder, any lawful use existing therein, or in any of the
several subject tracts or parcels of the same, at and immediately
prior to the effective dateof this ordinance, may be continued
therein although non - conforming to the regulations of said Zoning
Code applicable to said IIAt1 Residence District, in each instance,
subject to the same regulations and restrictions, under said
Zoning Code, as if the non - conforming use had been a lawful use of
the real estate existing therein on August 22, 1922, although
non - conforming to the regulations of City of Saint Paul Building
Zone Ordinance No. 5840, applicable to said ".An Residence District
and said "All Residence District had been the original zoning classi-
fication of the real estate under said last mentioned ordinance.

Dear Sir;
This is in the matter of the application of Richard Parranto et al to rezone
from "BII Residence to IIAII Residence the property fronting on both the north
andsbuthi sides of Lincoln Avenue between Grotto and St. Albans. This property,
is described as Lots 1 through 15, Block 4. and Lots 16 through 30 Block 5;
Summit Park Addition. The owner`s of 25 out of a possible 32 or 78.1% of the
several descriptions located within 100' of the area sought to be reclassified•
have consented to this petition, and approximately 76.5% of the frontage in-
volved within the area sought to be reclassified have signed this petition.
The property under consideration is completely developed and with the following
land uses, 13 single family homes, 5 duplexes,•one multi - family structures and
2 dormitories. The attached map illustrates the present uses of the property
in the area in relationship to those owners whose names appear on the petition.
In -reviewing this proposal the Zoning Board takes note of the fact that this
rezoning is a northerly extension of the IIAII Residence zoning pattern in the
area. It appears to be the intent of the owners of the property in this area
to prevent future conversions to uses other than single family occupancy, and
related land uses permitted in 11BII Residence which could substantially increase
the population density in this area. It must also be noted that existing land
uses would not be required to vacate if this property is rezoned to !Alt
Residence but would be placed in a non - conforming status.
In view of the expressed desire of the majority of the owners of property in
this area to retain the existing high standards for this neighborhood the
Zoning Board feels that the effect of this proposed reclassification would be
in the direction of securing this objective.
In view of the existing predominance of the single family character of this
neighborhood, the Zoning Board finds that the proposed IIAII Residence classifi-
cation would'in fact reflect the highest and best-use of the property within
the district without injury or damage to any existing property owners. In
consideration of these facts, the Board of Zoning recommends this petition to
to reclassify from IIBII Residence to IIAII Residence both sides of Lincoln between
Grotto and St. Albans be granted.
