This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1. That permission is hereby given to Raymond V. Berg to connect his homestead at 1373 W. Hoyt Avenue, the same being all that tract or parcel of land in the County of Ramsey, State of Minnesota, more particularly described as Lot 24 *and except the east 32 feet of Lot 25, Cable's Hamline Heights Addition, according to the plat thereof on file and of record in the office of the Register of Deeds of Ramsey County, Minnesota, with the existing sewer of the City of Saint Paul, upon the following conditions: 1. That said permittee or his successors in interest in respect to said real estate shall pay to the City of Saint Paul the sum of $5.00 per frontage foot of said real estate, for an aggregate of 50 feet, said sum to be in lieu of special assessments and taxes on account of the sewer service, and upon payment of said sum said permittee or his successor in interest in respect bf said real estate shall be granted a permit to construct, maintain and operate a sewer connection connecting said premises with the public sewer, representing an extension of the public sewer system of the City of Saint Paul in Hoyt Avenue along the line of the same, for the drainage of sanitary sewage from said premises and the disposition of same, through the public sewer system of said City of Saint Paul. 2. Permittee or his successors shall, within 90 days from the passage of this ordinance,_.file a written acceptance thereof, specifically agreeing to all the provisions, terms and condition herein, and upon compliance therewith the Commissioner of Public Works is hereby authorized to iisue a permit for said sewer extension, subject expresdy to the provisions of this ordinance and Sections 235.08 to 235.14 inclusive, of the Saint Paul Legislative Code. June 25th, 1958 r Mr. Joseph Okoneski City Clerk Building , Dear Sir: -This is in the matter of the application of the Gardner Company et al to rezone from ItBIt Residence to LIAR Residence the- property fronting on the north and south side of Lincoln Avenue'between Chatsworth and Milton. This property is described as Lots I through 14, Block 25, and Lots 15 through 28, Block 26; Summit Park Addition. 24 out of a possible 34 or 70% of the several descriptions of property located within 100' of the area sought to be reclassified have consented to this petition, and approximately 92% of the frontage °involved within the area sought to be reclassified have signed this petition. The property under consideration is com- pletely developed with one and two family homes. The attached map illustrates the present use of the property in the area in-relationship to those owners whose names appear on the petition. It appears to be the intent of the owners of the property on Lincoln avenue from St. Albans to Lexington to prevent future conversions to uses other than single family occupancy and the related land uses now permitted in 1IA1I Residence which could substantially increase the population density of this area. In view of the expressed desire of the majority of owners of property in this area to retain the existing high standards of this neighborhood, the Board of Zoning feels that the effect of this proposed reclassification would be in the direction of securing this objective. In view of the existing predominately single family character of this neighbor- hood, the Zoning Board finds that the proposed IIAII residence classification would in fact reflect the highest and best use of the property within the dis- trict without injury or damage to any existing property owner and further, all but one iof the present two - family units in the block would be legally permitted in an ttAlt Residence zoning classification; the other, which is 101 Milton Avenue will be placed in an non- conforming'classification. ' In consideration of these factors, the Board of Zoning recommends that this petition to reclassify from UB11 Residence to ItAIt Residence both sides of Lincoln between Milton and Chatsworth be granted.
