2 BE IT RESOLVED that, upon the petition of Common Bond Acquisition, LLC, as documented
3 in the Office of Financial Services, Vacation File Number 17-2008, the public right-of-way
4 hereinafter described, as follows and on attached map Eahibit A, is hereby vacated and
5 discontinued as public property, and subject to the herein state objections, the easements within
6 said public right-of-way are hereby released:

That portion of the east/west alley, not previously vacated, in block 3, F.W.
HoyNs Rearrangement of Lots 25, 26 and 27, Hall and Brown's Addition to
Hyde Park that lies easterly of a line extended south from the southwest
corner of lot 25 in said block 3.
This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981,
of the Saint Paul Legislative Code as amended, and to the following conditions:
1. That the petitioners, their successors and assigns shall pay $1200.00 as an administrative
fee for this vacation which is due and payable within 60 days of the effective date of this
resolution.
2. That an easement sha11 be retained on behalf of Qwest, a Delaware Corporation, for
existing facilities. The pefitioner or its successor shall provide new easements if required
and the petitioner or its successor shall assume all costs of relocating facilities to the new
easements. (Qwest and the petitioner are currently in the process of relocating facilities.)
3. That an easement sha11 be retained on behalf of Northem States Power Company d!b/a
Xcel Energy (Electric), a Minnesota corporation, for existing facilities. The petifioner or
its successor shall provide new easements if required and the petitioner or its successor
shall assume all costs of relocating facilifies to the new easements.
4. That an easement shall be retained on behalf of Comcast, a Pennsylvania Corporation, far
exisring facilities. The petitioner ar its successor shall provide new easements if required
and the petitioner or its successor shall assume all costs of relocating facilities to the new
easements.
5. That the petitioner, their successors and assigns agree to iridemnify, defend and save
harmless the City of Saint Paul, its officers and employees from all suits, actions or claims
of any character brought as a result of injuries or damages received or sustained by any
person, persons ar property on account of this vacation, or the petitioners' use of this

properiy, including but not lunited to, a ciaim brought because of any act of omission,
neglect, or misconduct of said petitioners or because of any claims or liability arising from
any violation of any law or regulation made in accordance with the law, whether by the
petitioners or any of their agents or employees.
6. That the petitioners, their successors and assigns shall, withiu 60 days of the effective date
of this resolution, file with the Office of Financial Services, Real Estate, an acceptance in
writing of the conditions of this resolution and shall, within the period specified in the
terms and conditions of this resolution, comply in all respects with these terms and
conditions.

I am not sure that I ever responded to you on this �reotion.
The vocation generally iooks OK. But I will just raise one small issue: The portion of the alley to be vacated currently provides
accc�s to garages on lots 25 and 26. So to cover ourselves, we might want to add a cnndition that tlie vacation does not become
effecUve until either
1. The houses and ga2ges are demolished
or
2. M access easement is provided for the garages. (the easement could be written to etipire once the houses are demo'd.)

St. Mthony, south of Central Ave.
The purpo5e of this vawtlon is to allow the developer/owner to utilize the site for parking and landscaping, as it may be allowed.
