Whereas, The Board of Water Com-
missioners in resolution dated June 6,
1958, indicated a desire to enter into
an agreement with Toltz, King, Duvall,
Anderson and Associates, Inc., on an
annual basis, to perform so much work
as the Water Department niay wish

the terms of a proposed agreement
between-the Board of Water Commis-
sioners and said Company covering
the conditions of the agreement, said

WHEREAS, the Board of Water Commissioners in resolution dated June 6, 1958,
indicated a desire to enter into an agreement with Toltz, King, Duvall, Anderson and
Associates, Ilic., on an annual basis, to perform so much work as the Water Department
may wish to give said firm in accordance with the terms of a proposed agreement
between the Board of Water Commissioners and said Company covering the conditions of
the agreement, said proposed agreement being closely patterned after agreements
between said firm and the Airports Commission and the Minneapolis -Saint Paul Sanitary
District, copy of said proposed agreement being marked "Exhibit A" and made
a part hereof by reference; and
WHEREAS, the resolution of the Board of Water Commissioners dated June 6,
1958, reads as follows:
"WHEREAS, the Water Department has for anumber of years been
engaged in a large improvement program, and in connection
therewith employed the consulting services of Black &
Veatch of Kansas City, Missouri, and Toltz, King, Duvall,
Anderson & Assocs. Inc. of St. Paul, Minnesota, both for
the preparation of plans, specifications and inspection
of certain - specifically designated works, and
"WHEREAS; the Board has directed that all -work contemplated
under the recommended improvement program be prosecuted as
speedily as possible, and has further directed that a con-
tinued study be made now for any additional improvements
designed to assure a full and safe future water supply; and
"WHEREAS, prior to the time any firm decisions can be made as to
future needed projects, engineering studies and surveys will
be required at once and from time to time; now therefore be it
"RESOLVED, that the Board employ the services of Toltz, King,
Duvall, Anderson & Assocs. Inc. on a yearly basis to render
such engineering services as and when required and as directed
so to do by the General Manager under the terms of tl�e at-
tached proposed agreement with said firm; and be it further
"RESOLVED, that the Council be asked to concur in this resolution

and direct the Corporation Attorney to prepare
such an agreement."
now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul concurs
in the action of the Board of Water Commissioners heretofore set forth
with respect to retaining the professional services of the firm of
Tolta, King, Duvall, Anderson and Associates, Inc., and authorizes and
directs the proper officers of the Board of Water Commissioners to
execute the agreement prepared by the Corporation Counsel, the same
being a modification of the aforementiondd "Exhibit A ", modified by
the Corporation Counsel to meet City requirements, a copy thereof being
attached hereto and marked "Exhibit B11 and made part hereof by reference.
