09-19Council File # �9'"� / Green Sheet# 3065406 RESOLUTION PAUL, MINNESOTA Presented �S WFJEREAS, the City of Saint Paul, Division of Parks and Recreation (the "CiTy") owns park land known as Johnson Parkway, which is located between Maryland Avenue and Burns Avenue in Saint Paul; and WFIEREAS, Steiner Real Estate Acquisitions, LLC (the "Property Owner) has requested the diversion of a 6,695 square-foot azea of Johnson Parkway ("the Pazk Property") adjoining 1001 Johnson Pazkway (the "Private Properiy") for pazking purposes, as depicted on the survey attached hereto as Attachment A, a copy of which is on file in the Departrnent of Public Works, Technical Services-Real Estate Office, in the file number 03-PKLDVRS-2008; and 10 11 WHEREAS, the Saint Paul Parks and Recreation Commission supports the diversion of the Park 12 Properly, as stated in its resolution, Number 08-24, adopted December 10, 2008, a copy of which is 13 attached hereto;and 14 15 WHEREAS, the City recommends the sale of the Park Property to the Property Owner, and the 16 Property Owner has agreed to pay just compensation as determined by an independent appraisal pursuant 17 to Section 13.01.1 of the Saint Paul City Charter; now, therefore be it 18 19 20 21 22 23 24 RESOLVED, that the proper city officials aze hereby authorized and directed to convey via quitclaim deed said Park Property to said Property Owner; and to accept just compensation from the Property Owner to be deposited into the Parkland Replacement Fund and held in reserve for future purchase of park property as required in Chapter 13.01.1 of the City Charter; and that all fees required by the City to comply with the its parkland diversion guidelines sha11 be fully compensated by said property owner. Adjoining his proper[y is Johnson Parkway upon which aze located 25 paved parking spaces that serve the 1001 Johnson Pazkway property and have done so for many years. The owner would like to purchase that portion of the pazkway at this tune. Parks and Recreation staff and the Pazks & Rec Commission are supportive of the request. The owner would pay for the fair mazket value of the land rJiverted, which sum would be deposited into the Pazkland Replacement Fund. Advanfages If Approved: The City may dispose of parkway property it does not need and receive funding for future pazkland pwchases. The purpose of this hearing is to consider a resolution to dispose of a small section of Johnson Parkway for the purpose of providing pazking for the adjoining private property at 1001 7ohnson Parkway, and to authorize city officials to convey the parkway property to Steiner RE Acquisitions in exchange for payment of the property's appraised value.
