Whereas, Heretofore, on March 3, 1950,
the Council of the City of Saint Paul
did extend permission to the St. Paul
Community Service, Inc. to erect a
com -, ",z on a _ portion of
WHEREAS, heretofore, on March 3, 1450, the Council of
the City of Saint Paul did extend permission to the St. Paul
Community Service, Inc. to erect a community building on a
portion of Merriam Park, the same to be presented to the City
of Saint Paul upon completion, reserving to St. Paul Community
Service, Inc. the free and exclusive occupancy, management, .
control, use and maintenance of said building, as provided for
by Minnesota Statutes, Section 450.23, and
'WHEREAS, the St. Paul CommunityiService, Inc. has duly
changed its name to Merriam Park Community Center, Inc., said
corporation being an unincorporated society of this State,
organized for the general purposes of fostering and promoting
educational, artistic, and scientific interests, or some one or
more of them, and not for any purpose of pecuniary gain or
profit to any of its members, and
WHEREAS, the said Merriam Park Community Center, Inc.
has delivered to Commissioner Bernard T. Holland, Commissioner
of Parks, Playgrounds and Public Buildings, a certified copy of
a resolution of its Board of Directors, authorizing the execu-
tion of a bill of sale and a deed of the building which it built
in Merriam Park, and has also delivered to said Commissioner a
bill of sale ar�da quitclaim deed of said building, pursuant to
the terms of the resolution of its Board of Directors, now there-
fore be it
RESOLVED, that the City of Saint Paul does accept, as
a gift, that certain building hereinabove�'desciibed and located
in Merriam Park, constructed by the predecessor corporation of
Merriam Park Community Center, Inc., with:the right reserved to
the said donor, Merriam Park Community Center, Inc. of the free
and exclusive occupancy, management, control and use of said
building by said organization for the general purposes of foster-
ing and promoting educational, artistic and scientific interests;;
or some one or more of them, and not for any gain or profit bo ' '
any of its members, subject to such regulations and restrictions
as shall be approved by the Department of Parks, Playgrounds and

Public Buildings, or any other conditions imposed bytk�' said
Department in line with the acceptance -of said building` - from-'
said Society, said action of the City Council hereunder being
taken pursuant to the provisions of M. S. A. 450.23, a copy of
which is hereto attached'and made a part hereof, and be it
FURTHER RESOLVED, that the Council of the City of
Saint Paul, on behalf of its citizens, hereby extends its
thanks and gratitude to the Merriam Park Community Center, Inc.
and all of its members, for the gift of the building herein -
above described, and be it
FURTHER RESOLVED, that a certified copy of the resolution
of the said organization, as above described, be attached hereto
and made a part hereof, and that the instruments of transfer of
the said building herein referred to be filed in the proper
offices of record, and be it
FURTHER RESOLVED, that the City Clerk of the City of
Saint Paul is hereby directed to send a certified copy of this
resolution, with its attachments, to the Merriam Park Community
Center, Inc.

450:23 Qifts_or devises
The board of park commissioners of any city of the
first class is authorized to receive and accept, in the name
of the city, any gift or devise of land or buildings to be
used for a public park, museum, gallery, or school of
arts or crafts, or for the construction, equipment, improvement,
maintenance, or use thereof or for any one or more of such
purposes, with the right reserved by the donor or devisor
to the -free and exclusive occupancy, management, control,
and use of the building by any incorporated society of
this state organized for the general purposes of fostering
and promoting educational, artistic, and scientific interests,
or some one or more of them, and not for any purpose of
pecuniary gain or profit to any of its members, and upon
such other conditions, but subject to such regulations
and restrictions, as shall be approved by the board of
park commissioners.
.The board may likewise accept gifts and bequests of
money and other personal property to be used for any of
these purposes.
