City of Saint Paul. This is an emergency ordinance
rendered necessary for the preservation of the
public peace, health and safety.
THE COUNCIL *OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclu-
sive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts and Rezoning of certain properties
in the City of Saint Paul, as amended, be and the same is
hereby further amended so as to rezone the following described
property, situated on the south side of Lafond Avenue, between
Oxford and Chatsworth Streets, from "B" Residence District to
Commercial District:
Lots 4 and 5, D. W. Moorets Addition, accord-
ing to the recorded plat on file and of
record in the office of the Register of Deeds
of Ramsey County, Minnesota,
subject to the following express exceptions and conditions:
1. That, subject to any further reclassification of the
hereinabove described real estate by virtue of proceedings therefor
hereafter instituted, conducted and completed according to appli-
cable provisions of said Zoning Code, Chapters 60 to 64 inclu-
sive, of the Saint Paul Legislative Code, as amended, and appli-
cable provisions of the statutes of the State of Minnesota,
hereby,.the employment of said real estate henceforth is re-
stricted and limited to the following specified uses, to -wit:
(a) Residential District uses permitted by the regulatory pro-
visions of the said Zoning Code, as amended, in '!A" Residence 1
District, t13I' Residence District, and "C" Residence District,
thereby established, and (b) Commercial uses which shall include
nd more than the off - street parking of motor vehicles as the
off - street parking of motor vehicles shall be permitted by the
regulatory provisions of said ordinance, as amended, in Commercial
District, thereby established.
2. That the owner of said real estate, within the period
of ten (10) days next succeeding the publication of this ordi-
nance, shall file with the City Clerk, in two fully executed
counterparts, said ownerts written acceptance of this ordinance,
incorporating, among other things, said ownerts grant unto said
City of Saint Paul of a negative easement affecting said real
estate for the imposition, maintenance and enforcement of the
aforesaid restrictions and limitations upon the employment and

3. That, in addition to other requirements therefor,
said written instrument of acceptance and grant shall incor-
porate a certified copy of this ordinance, and immediately upon
the aforesaid filing of the same the City Clerk shall cause one
of such counterparts thereof to be filed of record in the
office of the Register of Deeds in and for Ramsey County,
Minnesota.
Section 2. This ordinance is hereby declared to be an
emergency ordinance rendered necessary for the preservation of
the public peace, health and safety.
Section 3. This ordinance shall take effect and be in
force upon its passage, approval and publication.

This is in the matter of the application of W. G. Schwab Company to rezone from "B"
Residence to Commercial two lots fronting on the south side of'Lafond Avenue appro-
ximately in•the center, of the block between Oxford and CbatswaLtth. This property
is described as Lots 4 and 5, D. W. Moore's Addition.

The owners of 13 out of 18, or 81% of'the several descriptions located within 100'
of the area sought to be reclassified have consented to this petition. The property
under consideration is presently vacant and has a frontage of 80' on Lafond Avenue
and extending southerly a distance of 124.681. The purpose of this rezoning is to
provide off-street parking in connection with the uses of the structure to the west;
The adjacent land uses are as follows: immediately to the east are vacant lots, with
an apartment building presently under construction further east; to the north across
Lafond Avenue are single family homes; tb the south across an alley is a parking lot,
with single family homes east of the parking lot; to the west is a large building ex-
tending from Lafond Avenue to Thomas Avenue on the east side of Oxford used by
Wholesale Bbilders and Christensen Electric Company.
Although detailed plans of the proposed parking area have not as yet been submitted,
it has been determined that the area will adequately serve approximately 24 car
spaces. Field investigation points out that -this proposed parking area adjoins an
ungraded public alley on the north and east. I!, must also be further noted that the
proposed commercial zoning is a northerly and easterly extension of commercial and
light industry zoning on Thomas and Lafond respectively, however across an inter-
vening public alley in both instances.
In view of the existing land uses in the immediate neighborhood, the Board of Zoning
finds: 1.: inadequate off-street parking for existing land uses, and 2. the pro-
posed reclassification and use of this property for off-street parking purposes
would be a proper transitional land use without injury or damage to any existing pro-
perty in the area, provided the parking area is properly landscaped and fenced.,
In consideration of these factors, the Board of Zoning recommends that this petition
to reclassify from "B" Residence to Commercial the property under consideration be
granted. However, to insure that the use "of this property be .limited to -off- street
parking purposes, the Board of Zoning recommends that this.limitation be made a part
of the Ordinance so rezoning this property in accordance with procedures set forth`
by the Corporation Counsel under similar circumstances.
