3 WHEREAS, District Energy St. Paul, Inc. filed a norice on July 18, 2008 and an official affidavit on
4 September 18, 2008 notifying the City of Saint Paul of a proposed heating rate increase; and

6 WHEREAS, the heating rate increase became effective October 1, 2008, until approved or denied by the
7 Saint Paul City Council pursuant to Section .l 1(e) of the District Cooling franchise; and
8
9 WHEREAS, evidence and recommendations have been presented to the City Council in the form of a City
10 staff report submitted to the City Council on December 29, 2008, in conjunction with a public hearing on
11 this matter; and

13 WHEREAS, the cooling system customer rates as proposed by District Cooling St. Paul, Inc appear to be
14 reasonable in today's market conditions, and thus formal approval by City Council Resolution is

recommended;
NOW, THEREFORE BE IT RESOLVED, that the City Council approves the following cooling system
customer billing rate increases as proposed by District Cooling St Paul, Inc.:
The cooling demand rate changes from $24.79 to $25.66 per ton per month effective for fiscal
year 2009
2. The cooling energy rate remains at $0.079 per ton-hour effecrive for fiscal year 2009

District Cooling has proposed a rate change for FY-09. The City must review all proposed rate changes for Dis[rict Cooling. If
approved the cooling demand rate will change from $24.99 to $25.66 per ton per month.
Advantages If Approved:
District Cooling's rates will be established for 2009.
Disadvantages If Approved:
None.
Disadvantages If Not Approved:
The proper District Cooling rates will be in effect for FY 2009.
