The hearing was called to order at 10:17 a.m.
Staff Present: Kristina Schweinler, Department of Safety and lnspections (DSI); and Jean Birkholz,
Council Research
Others Present: Khaled AI-mansari, business owner; Tim Maklad, cousin of Mr. AI-mansari; and
Terrence M. Sullivan, owner of 1377 Randolph Avenue
APs Gas: Gas Stafion, Retail �ood (C) - Grocery 1001-3000 sq. ft. and Cigarette/Tobacco licenses
Ms. Vang stated that this is an informal legislative hearing for a license application. This is a Class N notification
which means that the neighborhood is notified and people have a chance to voice their concerns. If anyone has a
concern, it automatically triggers a hearing. Other Class N Licenses include: bars, entertainment, auto sales, auto
repair, etc.—things that have an immediate impact on their neighbors. The Ciry received one (1) letter of concern
regarding the issuance ofthis license. Ultimately, there are three (3) possible outcomes from this hearing: 1) Ms.
Vang can recommend to the City Council that they issue this license without any conditions; 2) she can
recommend to the City Council that they issue this license with agreed upon conditions; or 3) she can recommend
to the City Council that they not issue this license but refer it to an administrative law judge for a further hearing
and findings.
Ms. Vang will ask staff to present their report; staff will be asked to explain their review of the application and
will also explain their recommendation. Then, she will enter the email of objection into the reeord. Next, she will
ask the applicant to talk about the business plan. Then, she will hear from people who are here in support of the
issuance of the license and those with concerns about the issuance of the license.
Ms. KrisYina Schweinler, Department of Safety and Inspections, provided a staff report. At this time, the license
has been approved by Environmental Health, Licensing and Zoning inspectors. There was no requirement for a
Building inspection because iYs an on-going building. DSI recommends approval with no conditions.
Ms. Vang asked why no conditions were recommended. Ms. Schweinler responded that DST did not see a need
for condirions.
Mr. AI-mansari stated that he has operated a similar business with a similar license in Blaine for six (6) years. He
purchased this business in December, 2008. It is his only gas station.
Ms. Vang read the email of objeetion from Terrence M. Sullivan, who is not in favor of granting the license
because:
- "Mom & Pop" convenience stores seems to be a sign of neighborhood decay;
- National and regional chains are better equipped and financed to maintain the store;
- Prices increase when a"Mom & Pop" shop takes over;
- Maintenance of the property, store cleanliness and selection all decline at other "Mom & Pop" shops
that he has observed;
- Hangers-on and weird products start appearing in these stores to fatten the margins of the owners.
"Weird products" include pomography, rolling papers, pipes, biker paraphernalia, ete., to name just a
few. Hangers-on include criminals and would be criminals.
In short, he believes that this is an insult perpetrated by the seller to allow subprima enterprises like this to be
introduced into the Randolph Heights neighborhood. Marathon or whoever the seller is should Pind a more

suitable chain or adapt the property for another use such as office or some other professional commercial
enterprise.
— Tim Maklad, cousin of Mr. AI-mansari, responded that it seems as though the whole neighborhood has "Mom &
Pop" stores. The only business that is not a"Mom & Pop" establishment in the neighborhood is the BP; all the
rest are ]ocally-owned and operated. He thinks iYs unfair to characterize this business as a"shady" business. The
store doesn't have a magazine rack for pomography; they don't carry pipes. They dasplay a sign that says no
cigarettes will be sold to minors. Their staff is trained to check IDs. They try to maintain the store as best they
can. They make sure the sidewalks are shoveled. Customers also give them suggestions as to how to keep up the
place. They took care of enhancing the exterior lighting to make sure people feel safe. They don't allow people
to loiter out in front of the gas station. They keep their gas prices competitive for the benefit of the neighborhood.
They sell similar items, except deli, as a Super America would sell.
Mr. Tenence M. Sullivan addressed the hearing in objection. He owns a duplex down the street. His main
concern is preventing neighborhood decay in the future, when the owner needs to maintain his profit ievel. At
some point, the owner may stick in "junk" such as pornography and other high margin products. The
maintenance of the properry is also a concern. The previous owner did have a problem with graffiti and teenagexs
hanging around there. He hopes that this newer owner has the financial where-with-all to maintain the property.
Mr. Al-mansari stated that he just started at this location a few months ago. He needs a]ittle time to get things
going. He explained that the Marathon owns the property and many of the exterior things are supposed to be
maintained by them. They are allowed to paint inside and change flooring. They will do so when the weaiher
warms up.
Ms, Vang asked that Mr. AI-mansari maintain his business appropriately.
Ms. Schweinler explained that this type of license is renewad annually. DSI responds to compla'rnts as they come
in. She reiterated that the property is owned by Marathon. They have certain requirements as to type of paint,
colors, how they're painted, signage, (ighting, etc. Mr. A6mansari is Ieasing the store. He can operate it as APs
Gas but Mv will maintain the property ownership. In many cases, DSI has found that larger corporations
along University Avenue maintain the praperty. They feel that it is to their benefit to keep the property. Each
one, however, is different. Saint Paul has some "Mom & Pop" gas stations that run perfectly and some who don't
have a vested interest in the store and they go from one place to the ne�:t, which results in deterioration. IYs not
because these stores are "Mom & Pop"; iYs because the larger corporations don't have the interest in maintaining
the properties themselves. The exteriors are their responsibility; sometimes the tenants are beriveen a rock and a
hard p{ace because the larger corporation doesn't want ta put the money into the exterior of the store and the
tenant can't afford it. Mr. Al-mansari replied that they told Marathon about all of the damages three (3) months
ago; Marathon took pictures and he is still waiting.
Ms. Vang will recommend approval with no conditio��s.
