a '2,000 gallon fuel oil tank below the surface of the
areaway known as Lyons Court at Sibley Street_,,adjacent
to No. 512 Sibley Street, in the City,of Saint'Paul,
Ramsey County, Minnesotb. �'=This is an emergency ordi-
nance rendered neces "spry for the preserv9tion of the
public,gpda,ce, health pnd safety.
THE COUNCIL OF THE CITY OF SAINT DUL DOES ORDAIN:
Section 1. 'That upon compliance by Lax Electric Company,
Inc. with the conditions hereinafter set out,"the Commissioner
of Public Woxlks is authorized_to issue a permit to Lax Electric
Company, Inc. to install and, maintain a 2,000-,gallon fuel oil
tank below the surface of the areaway known as Lyons Court at
Sibley Street, adjacent to -No. 512 Sibley Street. The conditions
are as follows: ,

1. Permittee `shall furnish a bond of-
$10,000 to the City of Saint Paul, conditioned
to save said City harmless from any and all lia-
bility, judgments, suit's, costs, damages or
expense accruing to person or property, arising
..out of the installation,.,maintenance, use, presence
or removal of said tank.. Said bond shall be satis-
factory to the Commissioner of Finance as to surety,
to the Corporation Counsel as to form and execution,
and shall be filed with the City Comptroller,
2. Permittee shall file plans and specifi-
cations for said tank with--the Commissionex" f`Public
Works, which shall be satisfactory to the Chief Engineer
of the Department of Public.Works, said installation
of said tank to be made as he'shall #xect, and shall
be subject to approval of the Fire Prevention-Bureau and
other City Departments, concerned with such installation.
Permittee shall pay the cost of inspection.
3. This permit may be revoked by the Council
at any time and thereupon permittee shall remove said
tank.
4. Said permittee, its successors and assigns
shall have the absolute obligation to fully indemnify and
hold harmless said City of Saint Paul against all liability,
without limitation, on account of injury to person or
property resultant from the installation, maintenance and/
or removal of said tank.

the publication of this ordinance, file a written
acceptance thereof with the City Clerk.

an emergency ordinance rendered necessary for the preser-
vation of the public peace, health and safety.
Section 3. This ordinance shall take effect and be
in force upon its passage, approval and publication.
