1 WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or v✓recking
3 and removal of a two story plus, wood frame, single family dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 1342 YORK
5 AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Department of Safety and Inspections on or before June 9, 2008, the
following are the now known interested or responsible parties for the Subject Property: J& A
Properties Group LLP, Attn: Jim Barton and Alan Peterson, 1951 University Ave W, #20, St.
Paul, MN 55104; Western Bank, 4700 W 77` St, #160, Edina, MN 55435; LaSalle Bank, c/o
Wells Fargo, 7495 New Horizon Way, Frderick, MD 21703; District 2 Community Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated September 2, 2008; and
WHEREAS, this arder informed the then known interested or responsible parties that the
shucture located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by October 3, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, December 9 and December 23, 2008 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by rehabilitating this structure in accordance with all applicable codes and
ordinances, or in the altemative by demolishing and removing the structure in accordance with
all applicable codes and ordinances. The rehabilitation or demolition of the structure to be
completed within fdteen (15) days after the date of the Council Aearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 7, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 1342 YORK AVENUE.
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placazd on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcring all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the strucrixre must be completed within
fdteen (15) days after the date of the Council Hearing.
If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this struchu fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. Prior to demolition of the building(s) and/or removal of any unique building or
architectural features, the Deparhnent of Safety and Inspection shall ensure that a
qualified consultant be hired to evaluate the property for National Register or local
historic designation and if determined eligible, would continue to work to protect the site
from demolition. If demolition is considered the only reasonable alternative, then the
following level of documentation far the historic resource at 1342 York Avenue is
recommended by HPC staff:
A. The building exterior and its immediate context shall be documented with digital
photography. The images shall be at least 2400 x 1800 pixels and the images shall be
submitted to HPC staff on a gold CD.
B. An architectural description of the property be written that addresses remaining
unique historic fabric and the properties existing condition.
C. A brief history (context) of the development of the immediate neighborhood be
written (2 to 3 paragraphs).

It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

This building(s) is a nuisance building(s) as defined in Chapter 45 and a vacant building as defined in Chapter 43 of the Saint Paul

The building is a two and one-half story, wood frame, single-family dwelling on a lot of 14,374
squaze feet.
According to our files, it has been a vacant building since October 21, 2005.
The current property owner is J& A Properties Crroup, LLP, per AMANDA and Ramsey county
property records.
There have been seven (7) SUMMARY ABATEMENT NOTICES since 2005.
There have been two (2) WORK ORDERS issued for:
- Removal of tall grass and weeds
- Removal of snow and ice
On August 20, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on September 2, 2008 with a compliance date of
October 3, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are paid.
Taxation has placed an estimated market value of $113,400 on the land and $47,300 on the
building.
As of December 5, 2008, the $5,000.00 performance bond has not been posted.
As of January 9, 2007, a Code Compliance inspection has been completed.
Real Estate taxes for the years 2006 — 2008 are delinquent in the amount of $2,064.16 plus
penalty and interest.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$70,000. The
estimated cost to Demolish is $10,900 to $14,900.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

Inspecrions, Division of Code Enforcement, hereby declares the premises located at:

With the following Historic Preservation information:

45.02, and subject to demolition under authority of Chapter 45.11.
On August 20, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspecfion and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (651)266-9090. That inspecrion will identify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar ($5,000.00) performance

bond with the Building Inspection and Design Office before any permits are
issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a two story plus, wood frame, single family dwelling.
Interior
1. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. FURNACE: Have a licensed heating contractor service and clean the furnace
or boiler and make any necessary repairs. Perform a C/O test on the heating
plant. Then, send the attached fonn back to the Inspector. Repair of gas fired
appliances requires a permit.
3. G.F.C.I.: The bathroom is lacking an electrical G.F.C.I. outlet. Permit May
Be Required.
4. There are missing or defective guardrails. Provide all stairways, porches,
decks or steps which aze more than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.
5. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of more that three (3) risers with handrails wluch
are grippable and installed 34" to 38" above the nose of the stair treads.
6. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
7. The interior wa11s are defective. Repair all wall defects and finish in a
professional manner.
8. There is evidence of a rodent infestation. Immediately exterminate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessazy to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
9. SANTTATION: Immediately remove improperly stored or accumulated refuse
including; gazbage, rubbish, junk, vehicle par[s, wood, metal, recycling
materials, household items, building materials, rubble, tires, etc., from yard.
The Saint Paul Legislative Code requires all exteriar property areas to be

maintained in a clean and sanitary condition. Usable materials must be stored
in an approved manner, so as not to constitute a nuisance.
10. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
11. DEFECTIVE STAIRS. Stairs are broken, defecrive, or in disrepair. Repair in
a professional manner.
Exterior
12. Lack of Water Service. Immediately restore water service. Failure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
13. The chimney is defective, deteriorated or in a state of disrepair. Replace all
missing or defective bricks, tuckpoint as needed to restore the chimney to a
professional state of maintenance and repair. Permit may be required.
14. T`he eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
15. The exterior walls and/or trim of the house and/ar garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
16. The exterior walls and/or him of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.

17. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
18. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
19. The window and/or door screens are missing, defective or in a state of
disrepair. Provide proper window and door screens far all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
20. The windows and/or storm windows are in a state of disrepair. Replace a11
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.

21. Lacking window locks. Provide operable window locks for all windows
except third floor and above.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by October 3, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property ta�es as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspection will identify specific defects, necessary repairs and legal
requirements to co�ect this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspections,
Division of Code Enforcement. The department is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates far Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolurion stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the Ciry to take the
abatement action ar fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced properiy was inspected and the following report is
submitted:
BUILDING
1. Install basement windows to code.
2. Remove tree ar log post from north side of fireplace and replace to code with approved
material.
3. Insure all posts, under beams, are solid blocked to foundation.
4. Insure joist hangers that are on each side ofthe fireplace, are installed to code on the main
floor.
5. Properly header off and anchor joist to meet code, on the first, second and third floors.
6. Remove or rebuild rear addition on house to code, with plans.
7. Remove and rebuild stair to basement, and from first to second floor, to code.
8. Insure basement cellar floor is even, is cleanable, and all holes are filled.
9. Install hand and guardrails on all stairways and steps as per attaclunent.
10. Strap or support top of stair stringers.
11. Install plinth blocks under posts in basement.
12. Tuck Point interior/exteriar foundation.
13. Install loor covering in the bathroom and kitchen that is impervious to water.
14. Install tempexed glass in window on stair landing Yo Code.
15. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
16. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
17. Provide complete storms and screens, and repair all door and window openings.
18. Provide fire block construction as necessary.
19. Re-level structure as much as is practical.

20. Where wall and ceiling covering is removed, attic, replace doors and windows, (insulation,
glass, weather stripping, etc.) shall meet new energy code standards.
21. Prepare and paint interior and exterior as necessary (take the necessary precautions if lead
base paintis present).
22. Any framing members that do not meet code (where wall and ceiling covering is removed,
members that are over-spanned, over-spaced, not being carried properly, door and window
openings that are not headered, etc.) are to be reconstructed as per code.
23. Habitable rooms with new usage, replaced windows shall have glass area equal to 8% of
floor area, or a minimum of 8 sq. ft., one-half of which shall operate and all bedroom
windows shall meet emergency egress requirements (20" wide minimum, 24" high minimum
but not less than 5.7 sq. ft. overall).
24. Provide general clean-up of premise.
25. Provide smoke detectors as per the Minnesota State Building Code.
26. Repair soffit, fascia trim, etc. as necessary.
27. Provide proper drainage around house to direct water away from foundation.
28. Install downspouts and a complete gutter system if needed.
ELECTRICAL
1. Ground the electrical service to the water service within 5' of the entrance point of the water
service
2. Bond around water meter with a copper wire sized for the electrical service per Article 250 of
the 1VEC
3. Provide a complete circuit directory at service panel
4. Properly strap cables and conduits in basement/ service conduit on the exterior of the house
5. Wire all open walls to the 2005 National Electrical Code.
6. Electrical work requires a permit and inspections.
7. Properly wire exterior lights at fronUside/back door
8. Remove and/or rewire all illegal, improper or hazardous wiring in basement/ garage

All plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
1. No plumbing installed. Install to code.

submit orsat test report, Mechanical gas permit required.
3. All gas piping must be tested (witnessed) by a licensed contractor and pulling proper permits.
4. Remove or properly install fixrnace system on first floor with proper permit and inspection.
5. Plug or remove first floor fireplace.

Provide plans and specifications for any portion of the building that is to be rebuilt.
Most of the roof covering could not be properly inspected from grade. Recommend this be done
before rehabilitation is attempted.
There was considerable storage/clutter within property at the time of the inspection. Property is
to meet appropriate Codes when complete.
All items noted as recommended do not have to be completed for code compliance but should be

12. Ordering the owner to remove or repair the building(s) at 1342 York Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, J& A Properties Group, LLP, did not appear. No other parties of
interest appeared.
Mr. Magner stated the building was a two and one-half story, wood frame, single-family dwelling
on a lot of 14,374 square feet and had been vacant since October 21, 2005. A code compliance
inspection had been done on January 9, 2007, the vacant building registration fees were current, and
the $5,000 performance bond had not been posted. On August 20, 2008, an inspection of the
building was done and a list of deficiencies which constitute a nuisance condition was developed.
An order to abate a nuisance building was posted on September 2, 2008 with a compliance date of
October 3, 2008. To date, the property remained in a condition which comprised a nuisance as
defined by the Legislative Code. Ramsey County Tasation estimated the market value of the land
to be approximately $113,400 and the building to be $47,300. Real estate taxes for 2006 through
2008 were delinquent in the amount of $2,064.16, plus penalty and interest. Code Enforcement
estimates the cost to repair the building to be approximately $50,000 to $70,000. The cost for
demolition was estimated to be approximately $10,900 to $14,900. There had also been seven
summary abatements issued to this property since 2005, two of which went to work order: cut tall
grass and weeds and remove snow and ice. Code Enforcement recommends the building be
repaired or removed within 15 days. Mr. Magner presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1889 and was a Victorian style-building. She believed it was originally built as a duplex, that the
exterior integrity was good with the original stoop, original spindle work, and original side porch.
This property had been inventoried and listed the architect and owner as C. W. Jones. She believed
this property was a potential historic resource to the neighborhood and recommended forwarding it
to the HPC for review.
Ms. Moermond recommended this property be forwarded to the HPC for a recommendation; laid
over to December 23 Legislative Hearing.

Ms. Spong presented a letter from Christine Boulware, HPC, noting that the HPC met on December
18, 2008 and recommended 7 to 0 to hire a qualified historian to evaluate this property. Said letter
is attached and made a part of this record.
Ms. Moermond stated that she would need to consult with the City Attomey's Office to deternune
whether the cost of hiring a historian to evaluate or document this property could be assessed
against the property. The resolution will need to be modified to include language to document the
historic value of the property and the funding source to pay for said evaluation/documentation.

As you know, the Heritage Preservation Commission (HPC) considered at its December 18, 2008
meeting fhe historic significance of the property listed above. The HPC voted 7 Yo 0 to recommend
that a qualified historian be hired to evaluate both National Register and local eligibility and thaY
demoliYion be delayed for this site in order for alternatives to be explored, such as mothballing or
rehabilitatioa This decision was based on the discussion at the public hearing and findings by HPC
staff.
