A n ordinance amending the Zoning Code, Chapters
60 to 64 inclusive, of the Saint Paul Legislative
Code, pertaining to Use Districts, Height Districts
and Rezoning of certain properties in the City of
Saint Paul. This is an emergency ordinance rendered
necessary for the preservation of the public peace,
health and'safety.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1. That the Zoning Code, Chapters 60 to 64 inclu-
sive, of the Saint Paul Legislative Code, pertaining to Use
Districts, Height Districts, and Rezoning of certain properties
in the City Jept aint Paul, as amended, be and the same is hereby
�ux-therameso as to rezone the east 10.5 feet of Lot 6 and
all of Lo the east 6.75 feet thereof, Block 80, Dayton
and Irvinets Addition to Saint Paul, situated on the north side
of Dayton Avenue between Western Avenue and Virginia Street,
.from "C" Residence District to Commercial District, subject to
the following express exceptions and conditions:

1. that, subject to any further redlassification
of the hereinabove described real estate by virtue of
proceedings therefor hereafter instituted, conducted
and completed according to applicable provisions of said
Zoning Code, as amended, and applicable provisions of
the statutes of the State of Minnesota, hereby, the
• employment of said real estate henceforth is restricted
and limited to the following specified uses, to -wit:
(a) Residential District uses permitted by the regu-
latory provisions of said Zoning Code, as amended, in
"All' Residence District, "B ""Residence District, and "Ct°
Residence District, thereby established, and (b) �
Commercial uses which shall include no more than the
off - street parking of motor vehicles as the off- street

period of sixty (60) days next succeeding the publica-
tion of this ordinance, shall file with the City Clerk,
in two (2) fully executed counterparts, said owner's
written acceptance of this ordinance, incorporating,;
among other things, said owner's grant unto said'City of

estate for the imposition, maintenance and enforcement
of the aforesaid restrictions and limitations upon the

Dayton and IrvindsAddition to St. Paul, situated on the north side of Dayton Ave.

St. Paul Legislative Code, re Zoning
etc., be amended so as to rezone prop-
erty described as the east 10.5 ft.
of Lot 6, and except the east 6.75 ft.
Lot 7, Block 80, Dayton &1 Irvine's
Addition, located on the north side of
Dayton Ave., west of Virginia, to Com-
mercial District, the Council of the
City of Saint Paul has fixed the 31st
day of July,-1958, at ten o'clock in
the forenoon in the Council Chamber
in the City Hall of said City, and at
said time and place, the Council will
hear all persons and all objections

This is i'n' the matter of the application of Richard M. Walsh to rezone from
"C" Residence to Commercial one parcel fronting on the north side of Dayton
Avenue in,the middle of the block between Western Avenue and Virginia Street.
This property is described as the east 10.5' of Lot 6, all of Lot 7 except
the east 6.75' tbereof, Block 80, Dayton and Irvine Addition to St. Paul.,
The owners of 10 out of 14, or 71% of the several descriptions located within
100' of the area sought to be reclassified have consented to this petition.
The property under consideration is vacant but has been used for the parking
of cars by the tenants of the adjoining apartments in the area. This property
has a f rontage of 73.75' on Dayton Avenue and extends northerly to a depth of
116.5'. The purpose of this rezoning is to provide an off-street parking lot
for approximately 20 cars for,customers of the Thomas Finn Company, roofing
and sheet,metal contractors located across the street at 370 Dayton Avenue.
The adjacent land uses are as follows: immediately to the east and west are
apartment buildings; to the north are two homes facing Marshall Avenue, to
the south across Dayton Avenue are commercial businesses.
Cn view of the history of land use for this property, the Board of Zoning
finds that there will be no change in the character of the area if this peti-
tion is granted. The plans submitted by the applicant provides satisfactory
screening to protect the adjacent residential land uses, the Traffic Engineer
/has approved the proposed layout and operation of the parking facility.
in consideration of ,these factors, � the Board of Zoning recommends that this
petition to reclassify from "C" Residence to Commercial the property under
consideration be granted. %However, to insure that the use of this property -
be limited to off-street p rking purposes, the Board of Zoning recommends that
this limitation be made a part of the Ordinance for the rezoning of this pro-
perty in accordance with procedures set forth by,the Corporation Counsel under
similar circumstance's. The applicant has agreed to this condition.
