WHEREAS, Deparhnent of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and xemoval of a two and one-half story, wood frame dwelling located on property hereinafter
referred to as the "Subject Property" and commonly known as 830 SHERBURNE AVENUE.
This property is legally described as follows, to wit:
SYNDICATE NO. 1 ADDITION LOT 8 BLK 4
WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before July 21, 2008, the
following are the now known interested or responsible parties for the Subject Property:
Deutsche Bank Trust Co/Co Homecomings Fin Netwark, 1270 Northland Dr, #200, Mendota
Heights, MN 55120; Thomas-Dale District 7 Planning Council.
WHEREAS, Depariment of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an"Order to
Abate Nuisance Building(s)" dated October 9, 2008; and

WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subj ect Property by November 7, 2008; and
WHEREAS, the enfarcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and .
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, January 13 and January 27, 2009 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request to

order the interested or responsible parties to make the Subject Property safe and_not detrimental
to the public peace, health, safety and welfare and remove its blighting influence on the
community by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation of the structure to be completed within fdteen (15) days after
the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
February 4, 2009 and the testunony and evidence including the action taken by the Legislarive
Hearing Officer was considered by the Council; now therefare
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 830 SHERBURNE AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).

That the deficiencies causing this nuisance condition have not been corrected.
That Department of Safety and Inspections has posted a placard on the Subj ect
Property which declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fizlfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested ar responsible parties sha11 make the Subject Property
safe and not detrimental to the public peace, health, safety and welfaze and remove its

blighting influence on the community by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The demolition and removal of the
shucture must be completed within fifteen (15) days after the date of the Council
Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and chazge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. Tn the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislarive Code.

The building is a two and one-half story, wood frame, duplex dwelling, on a lot of 3,920 squaze
feet.
According to our files, it has been a vacant building since June 22, 2007.
The current property owner is Deutsche Bank c/o Homecomings Financial Network, per
AMANDA and Ramsey county property records.
The city has had to board this building to secure it from trespass.
There have been seven (7) SUMMARY ABATEMENT NOTICES since 2007.
There have been ten (10) WORK ORDERS issued for:
- Boarding
- Removal of snow and ice
- Removal of improperly stored refuse
- Removal of tall grass and weeds
On September 25, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on October 9, 2008 with a compliance date of
November 7, 2008. As of this date this property remains in a condition which comprises a
nuisance as defined by the legislative code.
The Vacant Building registration fees are paid. (By assessment 8/21/O8, good thru 6/22/09)
TaYation has placed an estimated market value of $32,200 on the land and $164,500 on the
building.
As of November 7, 2008, a Code Compliance inspection has been completed.
As of January 12, 2009, the $5,000.00 performance bond has not been posted.
Real Estate taYes are current.
Code Enfozcement Officers estimate the cost to repair this structure is $75,000 to $85,000. The
estimated cost to Demolish is $9,400 to $12,400.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property

The Vacant/Nuisance Buildings Unit, Departrnent of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
830 SAERBURNE AVE
and legally described as follows, to wit:
SYNDICATE NO. 1 ADDITION LOT 8 BLK 4
to comprise a nuisance condition in violatian of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On September 25, 2008, a Building Deficiency Tnspection Report was cornpiled and the
following conditions were observed.
This list of deFciencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be abtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200,
Commerce Building (6S1)266-9090. That inspection will identify specific defects,
necessary repaars and legal requirements to correct this nuisance condition. You
may also be required to post a�ve tlhousand dollar ($5,000.00) performance
bond with the Bnilding Inspection and Design Office before any permits are
issued, except for a demolirion permit.
This building(s) is subject to the restrictions of Saint Pau1 Ordinance Chapter 33.03
and shall not again be used for occupancy until such time as a Certificate of
Compliance or a Certificate of Occupancy has been issued.

1. The eaves and soffits are in a state of disrepair or deterioration. Repair all
defects, holes breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
2. The exterior walls and/ar trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.

4. The foundation is deteriorated, defective ar in a state o£ disxepair. Repaix all
faundation dafects in a professional mannex to a weaxher-tight, water-tight and
rodent-proof condition. Permit may be required.
5. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.

7. STORM DOQR(S): The storcn doar(s) are in disrepair; repair or replace the
door(s).
8. The window and/ar doar screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for all openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
9. The windows and/or storm windows are in a state of disrepair. Keplace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hardware and associated trim in a professional manner. Permit may be
required.
10. The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
11. FURNACE: Have a ficensed heating contractor service and clean the furnace
or boilet� and make any necessary repairs. Perfonn a C/O test on the heating
plant. Then, send the attached form baek to the Inspector. Repair of gas fired
appliances requires a permit.
12. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.

13. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
14. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectors in accordance with the attached
requirement, within 24 hours.
15. There are water damaged floors. Repair in a workmanlike manner.
16. The structure is a registered vacant building and must have a Code
Compliance Certificate before the structure may be occupied. Immediately
vacate the structure or obtain a Code Compliance Cerrificate from L.I.E.P.
You may contact Jim Seeger at L.I.E.P. for code compliance inspection,
permits, and issuance of Code Compliance Certificate. Under Chapter 33.03
of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate or to vacate the structure may result in issuance of criminal
summonses.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not coirected by November 07, 2008 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accardance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth SYreet, Suite #200, Commerce Building,
(651)266-9090. 'I`his inspecfion will identify specific defects, necessary repairs and 2ega1
requirements to correct this nuisance condition.
As an awner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership or
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is requiretl by law to past a placard on this property which declares it
Yo be a"nuisance condition", subject to demolition and removal by the City. T'his piacard shall
not be removed without the written authority of the Department of Safery and Inspections,
Division of Code Enfo:cement. The department is further required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If corrective action is not taken within the time specified in this order, the Enforcement Officer
will notify the City Councal that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be

heazd from interested parties. After this hearing the City Councii will adopt a resolution stating
what acrion if any, it deems appropriate.
If the resolution calis for abatement action the Council may either order the City to take the
abatement action or fix a time w:thin which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shalI abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance wath law.

HEATING
1. Clean and Orsat test boiler bumers. Check all controls for �roper operation. Provide
documentation from a licensed contractor that the heating units are safe.
2. Install chimney liner.
3. Replace boiler flue venting to code.
4. Vent clothes dryer to code.
5. Provide heat in every habitable room and bathrooms.
6. Attach metal tag to expansion tank valve stating that this valve must be OPEN at all times
except when draining the expansion tank.
7. Instali boiler pressure relief valve and(ox pipe boilex relief valve discharge to within 18" of
the floor.
8. Provide back flow preventer on city water fill line to hot water heating system.
9. Provide filter access cover for fumace.
10. Repair or replace radiator hand valves as needed.
11. Remove incinerator from basement, plug and cap all openings.
12. Above corrections apply to both units of duplex.
13. Appropriate gas and hydronic mechanical permits are required far the above work.

be completed at a later date. Possible purchasers of property shall be made aware of these items.
This is a registered vacant building. In order to reoccupy the building, all deYiciencies

1. Ordering the owner to remove or repair the buiiding(s) at 830 Sherburne Avenue within
,_ fifteen (15) days from adoption of resolution.
Tony I�ovak, attorney, appeazed' on behalf of Deutsche Bank Trust c!o Homecomings Financial
Network, the loan servicer. No other parties of interest appeared.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a two and
one-half story, wood frame, single-family dwelling on a lot of 3,920 square feet and had been
vacant since June 22, 2007. A code compliance inspection had been done on November 7, 2008,
the vacant building registration fees in the amount of $1,000 were paid by assessment on August 21,
2008, and the $5,000 performance bond had not been posted. On September 25, 2008, an
inspection of the building was done and a list of deficiencies which constitute a nuisance condition
was developed. An order to abate a nuisance building was posted on October 9, 2008 with a
compliance date of November 7, 2008. To date, the property remained in a condition which
comprised a nuisance as defined by the Legislative Code. Ramsey County Taacation estimated the
market value of the land to be approximately $32,200 and the building to be $164,50�. Real estate
taYes were current. Code Enforcement estimates the cost to repair the building to be approximately
$75,000 to $85,000. The cost for demolition was estimated to be approximately $9,400 to $12,400.
There had also been seven summary abatements issued to this property since 2007, 10 of which
went to work order, to secure the building and the City had to board the building to secure it from
trespass, remove improperly stored refuse, boarding, cut tall grass and weeds, and remove snow and
ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr.
Magner presented photographs of the property.
Ms. Moermond asked how they became aware this was a vacant building and the history of the
work orders. Mr. Magner responded that the Code Enforcement inspectar found the building vacant
as well as numerous exterior violations and referred the property to the V acant Buildings Program.
According to the file, summary abatement orders were issued in July and November, 2007 and
every time the property was inspected during 2008.
Ms. Moermond asked for a report from Ms. Boulware. Ms. Bouleware stated that this building was
built in 1908 as a four-square building. She noted that the front porch had been removed to allow
for a handicapped access ramp, the siding had been covered; however, the windows appeared to be
original. She believed the house had good integrity and noted that the houses on the block were
contiguous. She encouraged rehabilitation of the property.
Ms. Moermond asked Mr. Novak what his client intended to do with the property. Mr. Novak
responded that his client came into possession of the property last suuuner and had been attempting
to market it for sale. They were now prevented from doing so due to the change in the ordinance
which would not allow the transfer of title until the building was rehabilitated. He said that his
client was not in the rehabilitation business and did not intend to rehab it themselves.
Ms. Moermond stated that it was clear that the bank had not been maintaining the property and that
the vacant building fee had not been paid and went to assessment. She asked Mr. Magner whether
there was a vacant building registration form in the file. Mr. Magner responded that there was not.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.
