According to our files, it has been a vacant building since November 13, 2007. The current property owner is Wells Fargo Bank, per AMANDA and Ramsey county property records. The city has had to board this building to secure it from trespass. There have been five (5) SUMMARY ABATEMENT NOTICES since 2007. There have been seven (7) WORK ORDERS issued for: - Boarding - Removal of snow and ice On September 9, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NUISANCE BUILDING was posted on October 9, 2008 with a compliance date of November 7, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are paid. (Good thru 11/13/09) TaYation has placed an estimated market value of $60,000 on the land and $360,000 on the building. As of January 12, 2009, a Code Compliance inspection has not been completed. Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance Certificate hefore occupying the structure may result in issuance of criminal suminonses. As owner, agent or responsible party, you are hereby notified that if these deficiencies and the resuiting nuisance condition is not corrected by November 07, 2008 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process To demolish and remove the building(s). If you sell, transfer, or convey in any manner, the ownership or responsibility for this property you must within seven (7) days, notify the Enforcement Officer with the names and addresses of any new owners or responsible parties. The Enforcement Officer is required by law to post a piacard on this property which declares it to be a"nuisance condition", subject to demolition and removal by�he City. This placard shall not be removed without the written authority of the Department o£ Safety and Inspections, Division of Code Enforcement. The department is further required to file a copy of this "Order tc �bate" with the Ciry C:erk's Office. If corrective action is not taken within the Yime specified in this order, the Enforcement Officer will notify the City Councii that abatenient action is necessary. The City Cierk will then schedule dates for Public Hearings befare the City Council at which time testimony will be heard from interested parties. After this hearing the City Council will adopt a resolution stating what action if any, it deems appropriate. If the resolution calls for abatement action the Council may either order the City to take the abatement action or fix a rime within which this nuisance must be abated in accordance with the provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action is not taken within the specified time, the City shall abate this nuieance. Ordering the owner to remove or repair the building(s) at 288 Forbes Avenue within fifteen (15) days from adoption of resolution. Leah Weaver, attomey with Reiter & Schiller, appeared on behalf of the property owner, Wells Fazgo Bank. Ed Joluison appeared on behalf of the West Seventh/Fort Road Federation (the "FederaUOn"). Mr. Magner stated the building was a two and one-half story, wood frame, multi-unit dwelling with a detached wood shed on a lot of 4,792 squaze feet and had been vacant since November 13, 2007. A C of O team inspection had been done on July 14, 2008, the vacant building registration fees were current, and the $5,000 performance bond had not been posted. On September 9, 2008, an inspection of the building was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on October 9, 2008 with a compliance date of November 7, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the mazket value of the land to be approximately $60,000 and the building to be $360,000. Real estate taxes were current. Code Enforcement e'stimates the cost to repair the building to be approximately $100,000 to $125,000. The cost for demolition was estimated to be approximately $9,600 to $12,600. There had also been five summary abatements issued to this property since 2007, seven of which went to work order: to secure the building and the City had to board the building to secure it from trespass, boazding, and remove snow and ice. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked how they became aware this was a vacant building. Mr. Magner responded that Fire Prevention revoked the C of O and condemned the building as the property was vacant, open to access, the utilities had been shut off, and the number of interior and exterior violations. He noted that the previous owner was listed as JT Horizon who had a history of obtaining over-inflated property appraisals in order to get financing and would then not manage ar maintain the properties. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in 1885 during the Victoria era and had been surveyed, a copy of which is attached to this report. The property was located in the Invest St. Paul area and was a potential historic resource to the neighborhood. She said that she believed it was originally built as a single-family dwelling and then had been converted some time later. Mr. Magner stated that the building was currently a four-unit building and had originally been built as a single family or duplex. He said that the area was zoned RT2 which would allow for a four- plex; however, the lot size was non-compliant. Ms. Moermond stated that she had spoken with Rebecca Schiller, the attorney representing Wells Fargo, several times concerning this property. Ms. Weaver stated that her client would like to sell the property for approximately $2,000 to $3,000 to the Federation who would then rehab the property. She was requesting time in arder for the Federation to obtain the necessary funding. Mr. Johnson stated that they would like to de-convert the building into a duplex or single-family dwelling. Mr. Magner suggested that once the building was gutted, they could request a code compliance inspection, at the $138 fee, so that Mr. Seeger could address the exterior or any interior issues. He said that his concern was that the current ordinance did not allow an exemption to the January 13, 2009 Legislative Hearing Minutes Page 7 sale of a Category III vacant building, although he was awaze there was discussion concerning an amendment to the ordinance to a11ow for such an exemption. Ms. Moermond stated that it was her information that the ordinance change was being worked on and would be presented to the Council for first reading in the very near future. In order to give time foF the ordinance change to come into effect, she recommended continuing the legislative hearing to March 24 to obtain a progress report and the Council public hearing to April 15.
