This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety.. THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: SECTION 1. "The Bureau of Municipal Testing Laboratories of the City of Saint Paul, established by Ordinance No. 32619 shall be maintained and operated under the immediate supervision of the Director subject to administrative direction and con- trol of the Commissioner of Public Utilities. r• SECTION 2. The personnel of said Bureau shall consist of a Director and such other employees provided by law or deemed necessary by tYiq Commissioner- of Public Utilities. SECTION 3. From and after the effective date of this ordinance, all materials used by the City of Saint Paul or other govern- mental agencies in general governmental operations and in the making of public improvements shall, whenever the determina- tion of the quality thereof necessitates a chemical, physical, electric or other desired laboratory test, be subjected to the requisite laboratory test recommended for such purpose and approved as to quality by such Bureau before acceptance or use. M SECTION 4. �o That the Commissioner of Public Utilities shall a forthwith prepare and submit to the Council a schedule of uni- form charges to be made and collected in accordance with the provisions of this Ordinance, for all such tests by said Bureau; that said schedule shall be subject to review, revision and approval by the City Council by resolution. tiI Page 2. SECTION 5. 1¢?ti559 0 3D That in accordance with said schedule, as approved by the Council, there shall be collected and paid a charge for each such test made by said Bureau. That for each such test made by said Bureau of materials in connection with the general operation of the city government and with any public ,improvement, the charge therefor shall be paid by the proper city officers from the fund provided for the payment of such charges. SECTION 6. The balance remaining in the Bureau of Municipal' Testing Laboratories Revolving Fund, Code 1004, on December 31, 1958; is hereby appropriated and set aside for the purchase of equipment for said testing laboratories. 'All revenues derived from charges made for such tests shall, after January 1, 1959, be considered as department receipts. SECTION 7. Said Bureau shall, upon proper application therefor, make such laboratory tests of materials used in general govern- mental operations and in public improvements by any govern - mental.agency and in each instance there shall be made and col- lected a charge in accordance with said schedule of charges as ,approved by the City Council. SECTION 8. The requirements,of this ordinance for laboratory tests by said Bureau shall not be construed as superseding any other provision of law for the inspection or testing of materials or supplies used or purchased by the City of Saint Paul by any agency other than said Bureau; where any other provisions now exist, such requirements of this ordinance shall have no application. SECTION 9. Said Bureau shall exercise all powers and perform all duties germane to the purpose of its establishment, whether herein specified or otherwise. Nothing herein contained shall be deemed to'limit or abrogate to any extent any power or duty germane to the purposes of said Bureau, created or provided by any provision of the Charter of the City of Saint Paul or other law.
