Peterson- - An ordinance amending Ordinance No. 8829, approved October 23, 1946, as amended, entitled: "An ordinance granting permission to the City of West St. Paul to continue to connect the sewers of the City of West St. Paul to the sewer system of the City of Saint Paul for the purpose of affording an outlet for the sewers of the City of West St. Paul, and provid- ing terms and conditions governing such permis- sion, and repealing Ordinance No. 7995, approved February 21, 1939. This is an emergency ordinance rendered necessary for the preservation of the public peace, health and safety." THE ODUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: WHEREAS, heretofore and subsequent to the enactment of said City of Saint Paul Ordinance No. 8829, and certain amendments thereto, under the subsequent City of Saint Paul Ordinance No. 9505, approved MW 31, 1950, relating to the grant unto said City of West St. Paul of permission and authority to construct, maintain, and operate proper sewer connection joining the public sewer system of said City of West St. Paul with the public sewer system of said City of Saint Paul for the conveyance effd disposal of sanitary sewage entering the public sewer system of said City of West St. Paul, said City of Saint Paul, through its Council and upon its own initiative, duly instituted and has since conducted a presently pending and uncompleted investigation concerning the reasonableness of "Annual Charges" exclusive of "Annual Sewer Rental Charges" and othE charges, prescribed by Section 3 of said City of Saint q! Paul ordinance, as amended, and thereby imposed upon said City of West z St. Paul and required to be paid by said City of West St. Paul to said City of Saint Paul thereunder, and for said Council's revision of such a "Annual Charges" as shall be necessary to conform the same, in each p instance, to that which said Council therein shall determine, prescribe, and promulgate as reasonable and applicable; and WHEREAS, said Council finds therein that such investigation, in respect of such "Annual Charges" distinguishable, as aforesaid, from "Annual Sewer Rental Charges" and othw charges made payable by said City of West St. Paul, to said -City of Saint Paul thereunder, will necessarily involve considerable additional investigatorial study and considerable time for its completion and for its said Council's final determination therein, and that the same has demonstrated that such prescribed and promulgated "Annual Charges" are substantially less in certain particulars than those which might be deemed reasonable and equitable and that the same in such particulars shouldbe made the subject of temporary increases commencing as of September _L, /&dinjz and without nreiudice to the I i� sa Id. f t; I � 4 j to City Clerk D BY ORDINANCE COUNCIL FILE NO. ORDINANCE NO. .188544 L; That the final sentence of Section 3 thereof, which reads as follows: J4 "Such charges shall be first due on the first day ' of July, 19L,6, and on the first day of each year thereafter while such service is being afforded, and shall be in addition to sewer rental charges levied for the Minneapolis -Saint Paul Sanitary <. , District." 1° shall be and the same hereby is amended so that said sentence shall read as follows: �. "That the item of annual charge, Eight Dollars —� ($8.00) hereinabove made applicable for each single or two- family dwelling or governmental building,* church or school sewer connection now existing or herekftex�_made to the sewer system of the City of West St. Paul and the subsequent specified item of minimum annual charge, Eight Dollars ($8.00) hereinabove made applicable to each other sewer connection now existing or hereafter made to the sewer system of the City of West St. Paul represent increases in the heretofore prescribed and promul- gated specified annual charges and specified minimum annual charges, applicable to the several classifica- tions of property now or hereafter connected with the sewer system of the City of West St. Paul and are in the nature of temporary increases of specified annual charges and minimum annual charges, respectivelyi��- ^- hereby prescribed and promulgated and to become effective on the 1st day of September 1958, and on the 1st day of each year thereafter while such sewer service is being afforded, hereunder, without prejudice to the completion of said pending and uncompleted investigation by the Council of the City of Saint Paul and said Council's determination thereon and its prescription of other or higher annual charges and minimum annual charges as shall be found reasonable and equitable in the premises, and said annual charges as hereinabove prescribed and promulgated or provided to be determined and levied in accordance with the provisions hereof shall be _ in addition to annual sewer rental charges and other - charges by this ordinance provided to become and be payable by said City of West St. Paul or others to said City of Saint Paul, hereunder." Section 2. J of this ordinance; and that said City of West St. Paul shall prepare and file with the City Clerk-of said City of Saint Paul, within said 20 days' period a duly certified copy of such concurring and accepting ordinance hereinabove provided to be enacted by the governing body of said City of West St. Paul in the premises. Section 3. This ordinance is hereby declared to be an emergency ordinance rendered necessary for the preservation of the public peace, health, and safety. Section /+. Sperl AN ORDINANCE ACCEPTING THE SAINT PAUL ORDINANCE NO. 11005, RELATING TO SEWER MAINTENANCE CHARGE. THE COMMON COUNCIL OF THE CITY OF WEST SAINT PAUL DOES ORDAIN: WHEREAS, the City of Saint Paul, Ramsey County, Minnesota, has heretofore, by Ordinance No. 11005, granted permission to the City of West Saint Paul to connect with the sewers of the City of Saint Paul, and WHEREAS, the said Ordinance specifies the charge to be made for sew1naintenance. NOW THEREFORE, the Common Council of the City of West Saint Paul does ordain: T) That the City of West Saint Paul does hereby accept and agree to the terms and conditions set forth in said Ordinance No, 11,305. 2) That the City Clerk of the City of West St. Paul is authorized and directed to file a certified copy of this Ordinance with the City Clerk of the City of Saint Paul.
