A public hearing having been had upon the above improvement upon due notice, and the Council
having heard all persons, objections and recommendations relative thereto, and having fully considered
the same; therefore, be it ,
RESOLVED, By the Council of the City of St. Paul that the precise nature, extent and kind of im-
provement to be' made by the said City is. regrade and pave' Fairview Avenue from Highland Parkway
to St. Clair Avenue with new concrete base and asphaltic concrete surfacing to a width of
40 feet and between Highland Parkway and Randolph Avenue construct 8 feet wide,parking

Dear Sir:
I transmit herewith a preliminary estimate of cost for the re-
grading and paving of Fairview Avenue from Highland Parkway to St. Clair
Avenue with new concrete base and asphaltic concrete surfacing to a width
of 40 feet, also between Highland Parkway and Randolph Avenue construct +
eight (8) feet wide parking lanes on both sides, adjacent to the new pave-
ment, with stabilized base and asphaltic concrete surfacing; grading and
paving street, alley and driveway returns; construct new curbs and side-
walks where necessary; reconstruct drainage facilities; construct sewer,
water and gas service connections from street mains to property lines
where necessary; reconstruct the paving, curbing and sidewalks on the in-
tersecting streets where not in conformity with said improvement; construct
conduits and appurtenances for future lighting and traffic control systems
and do'all other work which is necessary and incidental to complete said
improvement, under Preliminary Order C. F. 186353, approved February 27,

Gentlemen:
I have examined the attached petition, filed in opposition to
Preliminary Order, Council File 186353, for regrading and paving
Fairview Avenue from Highland Parkway to St. Clair Avenue, and
find that said petition does not meet the Charter requirements for
a petition of remonstrance.
Regarded as a petition opposed to the aforementioned improvement,
there.are 90 property descriptions and the signatures of owners of
57 of these parcels have been obtained, this being 63 1/3 %.

The undersigned, being owners of property against which the cost
of the following improvements would be assessed, hereby oppose and ask that
no further proceeding'be had on the Preliminary Order 186353, approved
February 27, 1958, now before the Co#ncil of the City of St. Paul, which
proposes to regrade and pave Fairview .avenue from Highland Parkway to St.
Clair Avenue with new concrete base and asphaltic concrete surfacing to a
width of 40 feet and between Highland Parkway and Randolph Avenue construct
8 feet wide parking lanes on both sides adjacent to the new pavement with
stabilized base and asphaltic concrete surfacing; grade and pave street,
alley and driveway returns; construct new curbs and sidewalks where necessary;
reconstruct drainage facilities; construct sewer, water and gas service con-
nections from street mains to property lines where necessary; reconstruct the
