Yea, RESOLVED, that William Owens be permitted to install and operate a drive -in restaurant on the north side of University Avenue approximately 117.5 feet west of Oxford Street, on property described as Lots 23, 24, 25, 26 and 27, Block 2, Simonitschts Subdivision of Blocks 11 8 14 of Hyde Park, in accordance with applicantts plans dated May 22, 1958 and subject to compliance with all laws and regulations pertaining to said type of activity and subject also to the following conditions: 1. That applicant construct and maintain a decorative fence along the north property line of the aforementioned premises, said fence to be of such construction as to prevent papers and similar waste that may accumulate on applicantts premises from being scattered over adjacent premises. 2. That said drive -in restaurant be closed at twelve o'clock midnight on week days, and at one o'clock A. M. on week ends. City Clerk Building Dear Sir: ` I , This is in the matter of the application of William Owens for a permit to install and operate a drive -in. restaurant, referred back to the Zoning Board for further study, on property located on the north side of University Avenue, some 117.5' west of Oxford. This property has been classified Light Industry since the. adoption of the zoning ordinance in 1922. At their meeting on June 5, 1958, the Board reviewed this matter, and wishes to point oui the following pertinent facts: 1. The Board takes note of the fact that on the north side of University' between Oxford and Dunlap there are two existing similar operations. 2. The traffic pattern resulting from any use of this property for parking purposes in connection with this restaurant would produce negligible problems over and above the existing traffic conditions on University Avenue, on the adjoining streets and alley. 3. Any adverse effect upon residential land use across the alley to the north would be minimized provided the applicant would install a fence aesthetically designed along its northerly property line for the protection of the residential land use across the alley to the north. 4.% The Board discussed the nuisance question of noise generated by this proposed activity, particularly in the early morning hours, i and feel that this is more properly a licensing problem, parti- cularly as in this instance there are similar land uses with the same problems in the immediatO hrea. The plans submitted by the applicant will meet all existing standards for this type,of facility and call for a parking area for approximately 50 vehicles. There will be two standard width- driveways from University Avenue with no access to the alley to the north. If this permit is granted, the Board feels that the applicant should place a decorative fence along the north property line that would be of such construction to contain papers or similar waste that may accumulate upon the applicant's premises. This property is described as -lots 23, 24, 25, 26, 27,Block 2, Simonitsch's Subdivision of Blocks 11 and 14 of Hyde Park. The property is zoned Light Industry. 9- This property presently is occupied as a trailer sales and used car lot and has a frontage of 195' on University Avenue and extends northerly a distance of 118.5'. ° Tbe'adjacent land uses are as follows: Hetfield- Queenan operates a used car lot to the east; White Castle restaurant is to the west; retail stores are across University Avenue to the south and single family homes are across an alley to the north. Field investigation discloses no basic objection from the standpoint of ad- jacent land use or traffic. Applicant's plans meet existing standards for this type of facility and they call for not access to a 16' alley to the north, but will have two drive -ways on to University Avenue. The Traffic Engineer has approved the proposed layout and operation.
