1 WHEREAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
3 and removal of a one and one-half story, wood frame, single family dwelling located on property
4 hereinafter referred to as the "Subject Property" and commonly known as 606 BUSH AVENUE.

WHEREAS, based upon the records in the Ramsey County Recarder's Office and
information obtained by Department of Safety and Inspections on or before June 9, 2008, the
following are the now known interested or responsible parties for the Subject Property: Bee
Vue, 21301 Furman St NE, Wyoming, MN 55092; Bee Vue, 825 University Ave W, #2, St.
Paul, MN 55104; University National Bank, 200 University Ave W, St. Paul, MN 55103;
Anastasi & Associates, 14985 60tht St. N, Stillwater, MN 55082; Old Treasure Real Estate
Development, 1200 Forest St, St. Paul, MN 55106; Payne-Phalen District 5 Planning Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated September 3, 2008; and
WHEREAS, this order informed the then l�own interested or responsible parties that the
structure located on the Subj ect Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
ar demolish the structure located on the Subject Property by October 3, 2008; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a nuisance condition; subj ect to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Aearing Officer of the Saint Paul
City Council on Tuesday, December 9 and December 23, 2008 to hear testimony and evidence,
and after receiving testimony and evidence, made the recommendation to approve the request to

or responsible parties to make the Subject Property safe and not detrimental to the public peace,
health, safety and welfare and remove its blighting influence on the community by rehabilitating
this structure in accordance with all applicable codes and ordinances, or in the altemative by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The rehabilitation or demolition of the structure to be completed within fifteen (15) days after
the date of the Council Hearin�; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
January 7, 2009 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order conceming the Subject Property at 606 BUSH AVE .
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declazes it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the known interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

and removing the structure in accordance with all applicable codes and ordinances. The
r°'�°w�"�� demolition and removal ofthe structure must be completed within
fifteen (15) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Department of
Safety and Inspections is hereby authorized to take whatever steps are necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
3. In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling on a lot of 3,049
square feet.
According to our files, it has been a vacant building since July 12, 2007.
The current property owner is Bee Vue, per AMANDA and Ramsey county property records.
The City of St. Paul has boarded this building to secure it from trespass.
There have been four (4) SUMMARY ABATEMENT NOTICES since 2007.
There have been three (3) WORK ORDERS issued for:
- Boazding
- Removal of tall grass and weeds
On August 19, 2008, an inspection of the building was conducted, a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. An ORDER TO
ABATE A NUISANCE BUILDING was posted on September 3, 2008 with a compliance date of
October 3, 2008. As of this date this property remains in a condition which comprises a nuisance
as defined by the legislative code.
The Vacant Building registration fees are not paid. Amount owed is $1,000.00.
Taxation has placed an estimated market value of $24,300 on the land and $65,300 on the
building.
As of December 8, 2008, the $5,000.00 performance bond has not been posted.
As of November 5, 2008, a Code Compliance inspection has been completed.
Real Estate taxes for the year 2008 are delinquent in the amount of $4,423.96 plus penalty and
interest.
Code Enforcement Officers estimate the cost to repair this structure is $50,000-$60,000. The
estimated cost to Demolish is $8,122 to $11,122.
DSI, Division of Code Enforcement Resolution submitted for consideration orders the property
owner to repair or remove this structure within fifteen (15) days, if not the resolution authorizes
the Division of Code Enforcement to demolish and assess the costs to the property.

The Vacant/Nuisance Buildings Unit, Department of the Department of 5afety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:

and legally described as follows, to wit:

On August 19, 2008, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deficiencies is not necessarily all the deficiencies present at this time.
As first remedial action, a Code Compliance Inspection must be obtained from
the Building Inspection and Design Section, 8 Fourth Street East, Suite 200, •
Commerce Building (651)266-9090. That inspection will idenrify specific defects,
necessary repairs and legal requirements to correct this nuisance condition. You
may also be required to post a five thousand dollar (�5,000.00) performance

issued, except for a demolition permit.
This building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03
and sha11 not again be used for occupancy until such tnne as a Certificate of
Compliance or a Certificate of Occupancy has been issued.
This is a one and one-half story, wood frame, single family dwelling.
Exterior
1. The exterior walls and/or trim of the house and/or garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces.
Scrape and repaint to effect a sound condition in a professional manner.
2. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks, loose or rotting siding, to a professional state of maintenance.
3. The window and/or doar screens are missing, defective or in a state of
disrepair. Provide proper window and door screens for ail openable windows
and doors. Screens must be tight-fitting and securely fastened to the frames.
4. The windows and(or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, hazdware and associated trim in a professional manner. Permit may be
required.
5. The eaves and soffits aze in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
Interior
6. The interior ceilings are defective. Repair all ceiling defects and finish in a
professional manner.
7. The interior wa11s are defective. Repair all wall defects and finish in a
professional manner.
8. There is a Lack of Water Service.
There is evidence of improper wiring. Have a licensed electrical contractor
enact all necessary repairs and certify system integrity. Permits may be
required.
10. There is evidence of improper/defective plumbing. Have a licensed plumber
enact all necessary repairs and certify system integrity. Permits may be
required.

ll. The bathroom floor covering is deteriorated ar inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
12. There is an infestation of wasps (upstairs). Eradicate.
13. The interior of the house is filled with refuse/debris. Clean out interior.
14. Smoke Detector: Lack of properly installed and operable smoke detector.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by October 3, 2008 the Department of Safety and
Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property taxes as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Inspection Report must be obtained from the
Building Inspection and Design Section, 8 Fourth Street, Suite #200, Commerce Building,
(651)266-9090. This inspecfion will identify specific defects, necessary repairs and legal
requirements to correct this nuisance condition.
As an owner or responsible party, you are required by law to provide full and complete
disclosure of this "Order to Abate" to a11 interested parties, all present or subsequent renters and
any subsequent owners. If you sell, transfer, or convey in any manner, the ownership ar
responsibility for this property, you must within seven (7) days, notify the Enforcement Officer
with the names and addresses of any new owners or responsible parties.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placard shall
not be removed without the written authority of the Department of Safety and Inspecfions,
Division of Code Enforcement. The deparhnent is fiuther required to file a copy of this "Order
to Abate" with the City Clerk's Office.
If conective action is not taken within the rime specified in this order, the Enforcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council wi11 adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement action or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

Pursuant to your request the above-referenced properiy was inspected and the following report is
submitted:
BUILDING
1. Reinforce deteriorated floor joists and provide permanent support at east end of joists
in an approved manner.
2. Replace deteriorated basement stairway to access mechanical and plumbing
equipment in approved manner.
3. Remove or replace rear entry roof structure in approved manner.
4. Provide access and ventilation to all under floor crawl space areas. Repair as
necessary.
5. Replace deteriorated roof sheathing as necessary.
6. Repair or replace damaged exterior doors and storm doors.
7. Insure basement cellar floor is even, is cleanable and all holes are filled.
8. Install handrails and guardrails at all stairways, including basement stairways per
attachment.
9. Install floor covering in the bathroom and kitchen that is impervious to water.
10. Provide thumb type dead bolts for all entry doors. Remove any surface bolts.
11. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty
etc. as necessary.
12. Provide complete storms and screens in good repair for all door and window
openings.
13. Repair walls, ceilings and floor throughout as necessary.
14. Prepare and paint interior and exterior as necessary. Observe necessary abatement
procedure if lead base paint is present (See SY. Paul Legislative Code, Chapter 34 for
additional information).
15. Any framing members that do not meet code (where wall and ceiling covering is
removed, members that are over-spanned, over-spaced, not being cazried properly,
door and window openings that are not headered, etc.) are to be reconstructed as per
code.

16. Provide general clean-up of premise.
17. Provide smoke detectors per the Minnesota Building Code and carbon monoxide
detectors per State law.
18. Provide weather sealed, air sealed, and vermin sealed exterior.
19. Provide proper drainage around house to direct water away from foundation.
20. Replace house roof covering and vent to code.
ELECTRICAL
1. Ground the electrical service to the water service within 5' of the entrance point of
the water service.
2. Bond around water meter with a copper wire sized for the electrical service per
Article 250 of the NEC.
3. Provide a complete circuit directory at service panel.
4. Check all outlets for proper polarity and verify ground.
5. Properly wire exterior lights at front door.
6. All electrical work must be done by a licensed electrical contractor under an electrical
permit. Any open walls or walls that are open as part of this project must be wired to
the standards of the 2005 NEC.
PLUMBING
AII plumbing work requires permit(s) and must be done by a plumbing contractor licensed in
Saint Paul.
1. The water heater temperature and pressure relief valve discharge piping is incorrect.

3. Ordering the owner to remove or repair the building(s) at 606 Bush Avenue within fifteen
(15) days from adoprion ofresolution.
The property owner of record, Bee Vue, did not appear. No other parties of interest appeared.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling
on a lot of 3,049 square feet and had been vacant since July 12, 2007. A code compliance
inspection had been done on November 5, 2008, the vacant building registration fees were
delinquent in the amount of $1,000, and the $5,000 performance bond had not been posted. On
August 19, 2008, an inspection of the building was done and a list of deficiencies which constitute a
nuisance condition was developed. An order to abate a nuisance building was posted on September
3, 2008 with a compliance date of October 3, 2008. To date, the property remained in a condition
which comprised a nuisance as defined by the Legislative Code. Ramsey County Tasation
estimated the market value of the land to be approximately $24,300 and the building to be $65,300.
Real estate taxes for 2008 were delinquent in the amount of $4,423.96, plus penalty and interest.
Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000.
The cost for demolition was estimated to be approximately $8,122 to $11,122. There had also been
four summary abatements issued to this property since 2007, three of which went to work order: to
secure the building and the City had to board the building to secure it from trespass, remove
improperly stored refuse and miscellaneous debris, boarding, and cut tall grass and weeds. Code
Enforcement recommends the building be repaired ar removed within 15 days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
approximately 1884; however, the date was unconfirmed, and was a workers cottage-style building.
It was located across from railroad property and was in a row of four identical houses with two
houses being located on one lot with one outlot building on each parcel. This property had not been
surveyed, there was no potential for historic designation and although it did not have any significant
architectural features, she encouraged rehab.
Ms. Moermond recommended the building be removed within 15 days with no option for repair.

Bee Vue, property owner, appeared and presented a work plan. Ms. Moermond noted that Mr. Vue
had missed the previous legislative hearing.
Mr. Magner and Ms. Spong read their reports from the previous hearing into the record.
Mr. Vue asked what address his mail was being sent to. Mr. Magner said the notice of the hearing
was sent by certified mail to Mr. Bee Vue at 21301 Furman Street NE in Wyoming and 825
University Avenue West, #2 in St. Paul. He showed Mr. Vue the certified mail signed receipt and
asked Mr. Vue whether it was his signature on the receipt. Mr. Vue responded that the addresses
were correct and aclrnowledged that it was his signature on the receipt. He said that he had
purchased the property in Apri12008 and believed the property taaces had been paid. He said that he
would need to verify this with the bank. He also said that he had rehabbed approximately 12 other
buildings; he always did a good job and Jim Seeger could verify this.
Ms. Moermond asked Mr. Magner about the timeline on the summary abatement orders that had
been issued since Mr. Vue purchased the property. Mr. Magner responded that there was a
summary abatement order issued to cut tall grass and weeds on July 14, 2008 that was done by
Parks on July 21.
Ms. Moermond expressed concern that the property taxes had not been paid, the vacant building
fees had not been paid, the bond had not been posted, and the City was managing the property by
mowing the lawn.
Mr. Magner corrected that the vacant building fees had been paid by assessment. He said that in
reviewing the work plan, he would need to see the bids from the subcontractors. He asked Mr. Vue
who would be doing the general building repairs, such as the finishing work and general carpentry
and if he were planning to do the work himself, whether he had a general contractor's license. Mr.
Vue responded that he intended to do the work himself and that he did not have a general
contractor's license.
Mr. Magner stated that according to the State Building Code, a property owner could pull as many
building permits to do work on their own residence; however, they were only permitted to pull one
additional building permit for another dwelling within a two-year time period. Since Mr. Vue had
indicated that he had worked on several other properties, he would need to hire a general contractor
do the rehab for this property.
Ms. Moermond stated that the following must be received by December 30: 1) vacant building fees
for $1,000 went to assessment; 2) real estate taxes must be paid; 3) performance bond must be
posted; 4) need a work plan which includes cost of labor and materials; 5) need general contractor
bid and subcontractor bids; and 6) the property must be maintained.

On December 23, 2008 at the Legislative Hearing, Mazcia Moerxnond, the Legislative Hearing
Officer, stated that you must provide the following if you intend to rehabilitate the building:
i. the $5,000 performance bond must be posted with DSI at 375 Jackson Street;
2. real estate taxes for the yeaz 2008 are delinquent in the amount of $4,423.96 plus penalty
and interest and must be paid;
3. a work plan which include fimelines, the cost of labor and materials to be done in
accordance with the Code Compliance Inspection Report. Note: The City's estimate to
rehabilitate the building is between $50,000 and $60,000;
4. financial documentation which could be a construction loan, a line of credit or a bank
statement indicating you have the funds for this project. If it's a personal bank statement,
please redact a11 personal information such as account number, etc. and Mazcia would need
to see a financial letter or affidavit stating that you are willing to put the amount of funds
for the project; and
5. vacant building fees for $1,000 went to assessment;
6. provide general contractor bid and subcontractor bids; and
7. the property must be maintained.
The aforementioned conditions MUST be meUreceived by TUESDAY, DECEMBER 30. 2008. If
the conditions aze not met, she will recommend to the City Council that this building be removed
within I S days with no option for repair.
