WHEREAS, Department of Safety and Inspections has requested the City Council to
hold public hearings to consider the advisability and necessity of ordering the repair or wrecking
and removal of a one and one-half story, wood frame house and its two-stall detached wood
frame gazage located on property hereinafter referred to as the "Subject Property" and commonly
known as 996 IGLEHART AVENUE. This property is legally described as follows, to wit:

WHEREAS, based upon the records in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before May 17, 2009, the
following are the now known interested or responsible parties for the Subject Property: Chad M
and JodyL Wagner, 8104 CountyHighway Q, ChippewaFalls, WI 54729-6101; Citimortgage
Inc, 1000 Technology Drive, Ste 314, O'Fallon, MO 63368-2239; MERS, c/o American
Mortgage Corp, 6700 France Avenue S, #230, Edina, MN 55435; Wilford & Geske, PA, 8425
Seasons Pkwy, #105, Woodbury, MN 55125; Summit-University Planning Council.
WHEREAS, Department of Safety and Inspections has served in accordance with the
provisions of Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated August 13, 2009; and
WHEREAS, thas order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Property by September 14, 2009; and
W�IEREAS, the enforcement officer has posted a placard on the Subject Property
declaring this building(s) to constitute a uuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Department of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREAS, the interested and responsible parties haue been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, November 24, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to arder the

interested or responsible parties to make the Subject Property safe and not dehimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
demolishing and removing the structure in accordance with all applicable codes and ordinances.
The demolition of the shucture to be completed within thirty (30) days after the date of the
Counci] Hearing; and
WI3EREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 16, 2009 and the tesrimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 996 IGLEHART AVENUE.
That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
Tbat the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
That there now exists and has existed multiple Housing or Building code
violations at the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to conect the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of Safety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant/Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following arder:
The above referenced interested or responsible parties shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by demolishing and removing the shucture in
accordance with all applicable codes and ordinances. The demolition and removal of the
structure must be completed within �Aj nine 90 days after the date of the
Council Hearing.
2. If the above corrective action is not completed within this period of time Departsnent of
Safety and Inspections is hereby authorized to take whatever steps aze necessary to
demolish and remove this structure, fill the site and charge the costs incurred against the
Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.

In the event the building is to be demolished and removed by the City of Saint Paul, all
personal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personai property is not removed, it shall be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul Legislative Code.

The building is a one and one-half story, wood frame, single-family dwelling with a two-stall
detached wood frame garage on a lot of 4,792 square feet.
According to our files, it has been a vacant building since February 27, 2009.
The current property owner is Federal National Mortgage Assn, per STAUIP. Ramsey County
Property Records still shows owner as Citi Mortgage, Inc.
There have been seven (7) SUMMARX ABATEMENT NOTICES since 2009.
There have been nine (9) WORK ORDER(S) issued for:

- Improperly stored refuse, garbage and misc debris

On July 20, 2009, a Building Deficiency Inspection Report was compiled and the following
conditions were observed.
This list of deTiciencies is not necessarily all the deficiencies present at this time. This
building(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.03 and shall
not again be used for occupancy until such time as a Certificate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.
This is a one and one-half story, wood frame house and its two-sta11 detached wood frame
garage.

The bathroom floor covering is deteriorated or inadequate. Provide floor
covering which is impervious to water and easily cleanable throughout the
bathroom and seal around the edges and fixtures.
2. Infestation of Cocla�oaches. Exteiminate and eliminate all cockroaches
throughout the entire building. Provide this office with a copy of the
extermination report from a licensed professional Pest Control Operatar, and
follow their recommendations to eradicate these pests.
Lacking deadbolt door locks. Provide one-inch throw deadbolt locks for all
entry doors to dwelling unit(s).
4. Due to the number of deficiencies, a Code Compliance Inspection will be
required before a Placard Lift will be issued.
5. FURNACE: Have a licensed heating contractor service and clean the fiunace
or boiler and make any necessary repairs. Perform a C/O test on the hearing
plant. Then, send the attached form back to the Inspector. Repair of gas fired
appliances requires a pernut.
6. G.F.C.I.: The bathroom is lacking an electrical GF.C.I. outlet. Permit May
Be Required.
7. The stairs have missing or defective handrails. Provide all interior and
exterior stairways and steps of mare that three (3) risers with handrails which
are grippable and installed 34" to 38" above the nose of the stair treads.
8. The interior ceilangs are defective. Repair a11 ceiling defects and finish in a
professional manner.
9. The interior walls are defective. Repair all wall defects and finish in a
professional manner.
10. There is evidence of a rodent infestation. Immediately externvnate and
eliminate all rodents from the entire building. Remove rodent harborages in
the yard areas. Tuckpoint the foundation if necessary to rodent-proof the
building to prevent re-infestation. Immediately remove any dead rodents from
the premises.
11. Smoke Detector: Lack of properly installed and operable smoke detector.
Provide functioning smoke detectars in accordance with the attached
requirement, within 24 hours.

12. STORM DOOR(S): The storm door(s) aze in disrepair; repair or replace the
door(s).
13. DEFECTIVE STAIRS. Stairs are broken, defective, or in disrepair. Repair in
a professional manner.
14. Lack of Water Service. Immediately restore water service. Faalure to provide
water service will result in these premises being declared Unfit for Human
Habitation and ordered vacated for lack of this basic facility.
15. Lacking window locks. Provide operable window locks for all windows
except third floor and above.
EXTERIOR
1. GARAGES AND ACCESSORY STRUCTiIRES. All garages and accessory
structures must be in sound condition and secure from unauthorized entry.
Repair or replace any missing doors, windows, or hardware for same.
2. The eaues and soffits are in a state of disrepair or deterioration. Repair all
defects, holes, breaks, loose or rotting boards, to a professional state of
maintenance. Permit may be required.
3. The exterior walis and/or trim of the house and/ar garage has defective,
peeled, flaked, scaled or chalking paint or has unpainted wood surfaces,
Scrape and repaint to effect a sound condition in a professional manner.
4. The exterior walls and/ar trim of the garage has defective, peeled, flaked,
scaled or chalking paint or has unpainted wood surfaces. Scrape and repaint

5. The exterior walls and/or trim of the house has defective, peeled, flaked,

6. The foundation is deteriorated, defective or in a state of disxepair. Repaix all
foundation defects in a pmfessional manner to a weather-tight, water-tight and
rodent-proof condition. Permit may be required.
7. There are missing or defective guardrails. Provide all stairways, porches,
decks ar steps which are mare than 30" high with guardrails and intermediate
rails with openings in the guardrail no more than four (4) inches apart and in
accordance with the State Building Code.

8. The roof is deteriorated, defective, or in a state of disrepair. Repair or replace
the roof covering to a sound, tight and water impervious condition. Permit
may be required.
9. The exterior walls of the house and/or garage are defective. Repair all holes,
breaks,loose or rotting siding,to a professional state ofmaintenance.
10. The exterior walls of the garage are defective. Repair ail holes, breaks, loose
or rotting siding, to a professionai state of maintenance.

and doors. Screens must be tight-fitting and secarely fastened to the frames.
14. The windows and/or storm windows are in a state of disrepair. Replace all
missing or broken window glass. Make all necessary repairs to frames,
sashes, haxdwaze and associated trim in a professional manner. Permit may be
required.
As owner, agent or responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by September 14; 2004 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and zemove the building(s). The costs of this action, including administrative costs
and demolition costs will be assessed against the property tases as a special assessment in
accordance with law.
As first remedial action, a Code Compliance Lnspection Report must be obtained from the
Building Inspection and Design Section, 375 Jackson Street, Suite 220, (651)26b-8989. This
inspection will identify specific defects, necessary repairs and legal requirements to conect this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the pxoperty
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compliance with preservavon guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of 5afety
and Inspections web site (see letterhead) and from the FIPC staff. No permits wi11 be issued
without HPC review and approval. HPC staff aiso can be reached by calling 651-266-9078.

As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this °Order to Abate" to all interested parties, all present or subsequent renters and
any subsequent owners. The property shall not be so1d, transferred or conveyed in any manner
until the Nuisance Conditions have been abated and tt�e Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placazd on this property which declares it
to be a"nuisance condition", subject to demolition and removal by the City. This placazd shall
not be removed without the written authority of the Departrnent of Safety and Inspections,
Division of Code Enforcement. The department is further required to file a copy of this "Order
to Abate" with the City Clexk's Office.
If corrective action is not faken within the time specified in this order, the Enfarcement Officer
will notify the City Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which tnne testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution stating
what action if any, it deems appropriate.
If the resolution calls far abatement action the Council may either order the City to take the
abatement acrion or fix a time within which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective actioii
is not taken within the specified fime, the City shall abate this nuisance. The costs of this
action, including administrative costs will be assessed against the property as a special
assessment in accordance with law.

5. Ordering the owner to remove or repair the building(s) at 996 Iglehart Avenue within fifteen
(15) days from adoption of resolution.
The property owner of record, Federal National Mortgage Assn, did not appeaz. No other parties of
inferest appeared.
Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling
with a detached two-stall garage on a lot of 4,792 square feet and had been vacant since February
27, 2009. A code compliance inspection had not been done, the vacant building registration fees in
the amount of $1,000 went to assessment on April 29, 2009, and the $5,000 performance bond had
not been posted. On July 20, 2009, an inspection of the building was done and a list of deficiencies
which constitute a nuisance condition was developed. An order to abate a nuisance building was
posfed on August 13, 2009 with a eompliance date of September 14, 2009. To date, the property
remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey
County Taxation estunated the market value of the land to be approximataly $62,700 and tha
buiiding to be $96,800. Real estate taxes were delinquent current. Code Enforcement estimates the
cost to repair the building to $80,000. The cost for demolition was estimated to be approximately
$10,000 to $12,000. There had also been seven summary abatements issued to thas property since
2�09, nine of which went to work order: boarding(securing, remove improperly stored refuse and
debris, cut ta11 grass and weeds, and remove snow and ice. Code Enforcement recommends the
building be repaired or removed wiYhin 15 days. Mr. Magner presentad photographs of the
property.
Ms. Moerniond asked for a report from Ms. 5pong. Ms. Spong stated that this building was built in
1889 and was a Queen Anne-style building. The building had good integrity and was part of
collection of five houses, this one being in the ruiddle, of Queen Anne-sCyle buildings. This
property had not been surveyed and was not in any potential historic district; however, since it was
a part of a collection of houses, she encouraged rehab.
Ms. Moermond stated that she had received correspondence from Cindy Carlson, HRA, who
requested additional time to purchase the property with the intention of removing the building.
Since rehabilitation was being recommended by Ms. Spong, she recommended continuing the
hearing to December 8 to discuss other options for this property with representatives of the HRA.

This matter was iaid over from the November 24 hearing to allow the F�A to provide options for
this property as opposed to demolition. No one representing the FIRA appeared.
Ms. Spong stated that she believed this properiy was worth rehabilitating; however, since it was not
located within any potential historic dish the HPC would have little impact or say on the
outcome of this property.
Mr. Magner stated that the FIRA had not purchased this property to date and were requesting 90
days to stali demolition. He said he did not feel comfortable allowing the grant of time as the
nuisance would continue to go unabated. He suggested allowing 30 days for the city to commence
demolition of the properiy.
Ms. Moermond stated that since there wasn't a repxesentative of the T�RA in attendance at the
hearing, she recommended the building be removed within 30 days with no option for repair.
