1 VJF�REAS, Department of Safety and Inspections has requested the City Council to
2 hold public hearings to consider the advisability and necessity of ardering the repair or wrecking
3 and removal of a two story, wood frame duplex located on property hereinafter refened to as the
4 "Subject Property" and commonly Irnown as 977 AURORA AVENUE. This property is legally
5 described as follows, to wit:

WHEREAS, based upon the recards in the Ramsey County Recorder's Office and
information obtained by Deparhnent of Safety and Inspections on or before June 15, 2009, the
following are the now known interested ar responsible parties for the Subject Property: Khai
Hong Lim & Shuping Teoh, 977 Aurora Avenue, St Paul, MN 55104; Freddie MAC c/o Jeff
Anderson, 15451 Founders Lane, Apple Valley, MN 55124; Summit-University Planning
Council.
WHEREAS, Deparhnent of Safety and Inspections has served in accardance with the
provisions of Chapter 45 of the Saint Pau1 Legislative Code an order identified as an "Order to
Abate Nuisance Building(s)" dated October 1, 2009; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WHEREAS, this order informed the interested or responsible parties that they must repair
or demolish the structure located on the Subject Propez by November 2, 2009; and
WHEREAS, the enforcement officer has posted a placard on the Subj ect Property
declaring this building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Deparhnent of Safety
and Inspections requested that the City Clerk schedule public hearings before the Legislative
Hearing Officer of the City Council and the Saint Paul City Council; and
WHEREA5, the interested and responsible parties have been served notice in accordance
with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and
purpose of the public hearings; and
WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul
City Council on Tuesday, November 24, 2009 to hear testimony and evidence, and after
receiving testimony and evidence, made the recommendation to approve the request to order the

interested or responsible parties to make the Subject Property safe and not detrimental to the
public peace, health, safety and welfare and remove its blighting influence on the community by
rehabilitating this structure in accordance with all applicable codes and ardinances, or in the
alternative by demolishing and removing the structure in accordance with all applicable codes
and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen
(15) days after the date of the Council Hearing; and
WHEREAS, a hearing was held before the Saint Paul City Council on Wednesday,
December 16, 20�9 and the testimony and evidence including the action taken by the Legislative
Hearing Officer was considered by the Council; now therefore
BE IT RESOLVED, that hased upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 977 AURORA AVENUE.
L That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
five thousand dollars ($5,000.00).
3. That there now exists and has existed multiple Housing or Building code
violarions at the Subjeet Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known
responsible parties to correct the deficiencies or to demolish and remove the
building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Department of 5afety and Inspections has posted a placard on the Subject
Property which declares it to be a nuisance condition subject to demolition.
7. That this building has been routinely monitored by Department of Safety and
Inspections, Vacant(Nuisance Buildings.
8. That the lrnown interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.

The above referenced interested or responsible partaes shall make the Subject Property
safe and not detrimental to the public peace, health, safety and welfare and remove its

blighting influence on the community by rehabilitating this structure and correcting all
deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in
accordance with all applicable codes and ordinances, or in the alternative by demolishing
and removing the structure in accordance with all applicable codes and ordinances. The
rehabilitation or demolition and removal of the struchue must be completed within
�`,���°�� one hnndred-eightv (180) days after the date of the Council Hearing.
2. If the above corrective action is not completed within this period of time Deparhnent of
Safery and Inspecrions is hereby authorized to take whatever steps are necessary to
demolish and remove this shucture, fill the site and chazge the costs incurred against the
Subj ect Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative
Code.
In the event the building is to be demolished and removed by the City of Saint Paul, all
pexsonal property or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time
period. If all personal property is not removed, it shali be considered to be abandoned
and the City of Saint Paul shall remove and dispose of such property as provided by law.
4. It is fizrther ardered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

as defined by Legislative Code, Chapter 45. The Department of Safety and Inspections has
issued an order to the then known responsihle parties to eliminate this nuisance condition by
carrecring the deficiencies or by razing and removing this building(s).
The property was re-inspected on November 6, 2009. There was no compliance and the nuisance
condiuon remains unabated, the community continues to suffer the blighring influence of this
property. It is the recommendarion of the Department of Safety and Inspections that the City
Council pass a resolution ordering the responsible parties to either repair, or demolish and
remove this building in a timely manner, and failing that, authorize the Department of Safety and
Inspections to proceed to demoiition and removal, and to assess the costs incurred against the
real estate as a special assessment to be collected in the same manner as taxes.

feet.
According to our files, it has been a vacant building since December 7, 2007.
The current property owner is Khai Hong Lim & Slmping Teoh, per Ramsey County Froperty Records.
The city has had to board this building to secure it from trespass.
There have been fourteen (14) Si7MMARY ABATBMENT NOTICES since 2007.
There have been thirteen (13) WORK ORDER(S) issued for:

The VacantlNuisance Bnildings Unit, Department of the Department of Safety and
Inspections, Division of Code Enforcement, hereby declares the premises located at:
977 AURORA AVE
and legally described as follows, to wit:

to comprise a nuisance condition in violation of the Saint Paul Legislative Code, Chapter
45.02, and subject to demolition under authority of Chapter 45.11.
On August 31, 2009, a Building Deficiency Inspecrion Report was compiled and the following
conditions were observed.
This list of de�ciencies is not necessarily all the deficiencies present at this fime. This
bnflding(s) is subject to the restrictions of Saint Paul Ordinance Chapter 33.Q3 and shall
not again be used for occupancy until such time as a Certiticate of Compliance or a
Certificate of Occupancy has been issued. All repairs must be in accordance with
appropriate codes. Changes or additions to the electrical system, mechanical system, or
the plumbing system may necessitate updating or upgrading the systems involved.

Remove and rebuild rear entry deck, guardrail, landing to code.
Insure basement cellar floor is even, is cleanable, and all holes are filled.
Install handrails and guardrails at all stairways, including basement stairways, per attachment.
Strap or support top of stair stringers.
Install floor covering in the bathroom and kitchen that is impervious to water.
Install tempered or safety glass in window over stair landing to Code.
Install tempered or safety glass in window over bathtub to Code.
Provide thumb type dead bolts for al1 entry doors. Remove any surface bolts.
Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as
necessary.
Provide complete storms and screens, in good repair, for all door and window openings.
Repair walls, ceilings and floors throughout, as necessary.
Where wall and ceiling covering is removed install full-thickness or code-specified insulation.
Prepare and paint interiar and exterior as necessary. Observe necessary abatement procedure if
lead base paint is present (See St. Paul Legislative Code, Chap. 34 for additional information).
Any framing members that do not meet code (where wall and ceiling covering is removed,
members that are over-spanned, over-spaced, not being carried properly, door and window
openings that are not headered, etc.) are to be reconstructed as per code.
Habitable rooms with new usage and replaced windows sha11 have glass area equal to 8% of
floor area, or a minunum of 8 sq. ft., one-half of which shall operate; and all bedroom windows
shall meet emergency egress requirements (20" minimum width, 24" minimum height, but not
less than 5.7 sq. ft. overall openable area; minimum 5.0 sq. ft. openable area if sill height is
within 44 inches of grade).

Verify/install a separate 20 ampere laundry circuit & a separate 20 ampere kitchen appliance
circuit.
Verify that circuit breaker amperage matches wire size.
Properly strap cables and conduits in basementJ service conduit on the exterior of the house,
Install GFCI receptacle in basement and second floor bathroom adjacent to the sink.
Ground bathroom light in basement and second floor batlu�oom and disconnect receptacle on
fixture.
Install globe-type enclosed light fixture on all closet lights.
Remove all cord wiring.
Repair or replace all broken, missing or loose light fixtures, switches & outlets, covers and
plates.
Check ail outlets for proper polarity and verify ground on 3-prong outlets.
Remove any 3-wire un� ontlets and replace with 2-wire ar ground 3-wire to code.
ThroughouC building, install outlets and light fixtures as specified 'm Bulletin 80-1.
Install hard-wired, battery backup smoke detector as specified in Bulletin 80-1 and other smoke
detectors as required by the IRC. Also, Install carbon monoxide detector(s) within 10 feet of all
bedrooms.
All added receptacles must be grounded, tanaper-resistant and be on an Arc-Fault Circuit
InterYUpter proteeted circuit.
All electYical work must be done by a Minnesota- Zicensed electrical contr-actor under an
ePectrical permit.
Any open waZls or waZls that are opened as part of this project must be wired to the standards of
the 3008 NEC.
AZl buiddings on the property must meet the St. Paul Property Maintenanee Code (Bulletin 80-1)

ORDER:
Repair the structure to a habitable condition.
This structure is a registered vacant building that must have a Code Compliance Certiticate
befare the structure may be occupied.
Obtain a Code Compliance Certificate from the Deparhnent of Safety and Inspections. You
may contact Jim Seeger at 651-266-89&9, far a code compliance inspection, permits, posting the
required performance bond, and issuance of the Code Compliance Cexrificate.
Under Chapter 33.03 of the Saint Paul Legislative Code, failure to obtain a Code Compliance
Certificate before occupying the structure may result in issuance of criminal sununonses.
As owner, agent ar responsible party, you are hereby notified that if these deficiencies and the
resulting nuisance condition is not corrected by November 2, 2009 the Department of Safety
and Inspections, Division of Code Enforcement, will begin a substantial abatement process to
demolish and remove the building(s). The costs of this acUon, including administrative costs
and demolition costs wi11 be assessed against the property taxes as a special assessment in
accordance with law.

inspection will identify specific defects, necessary repairs and legal requirements to correct this
nuisance condition.
If this building is located in a historic district or site (noted above, just below the property
address) then you must contact Heritage Preservation (HPC) staff to discuss your proposal for
the repairs required by this order and compiiance with preservation guidelines. Copies of the
guidelines and design review application and forms are available from the Deparhnent of Safety

As an owner or responsible party, you aze required by law to provide full and complete
disclosure of this "Order to Abate" to all interested partaes, all present or subsequent renters and
any subsequent owners. The property shall not be sold, transfened or conveyed in any manner
until the Nuisance Conditions have been abated and the Certificate of Code Compliance or
Certificate of Occupancy has been issued.
The Enforcement Officer is required by law to post a placard on this property which declares it
to be a"nuisance condition", subj ect to demolifion and removal by the City. This placard shall
not be removed without the written authority of the Deparhnent of Safety and Inspections,
Division of Code Enforcement. The department is further required to fi1e a copy of this "Order
to Abate" with the City Clerk's Office.
Tf correcfive action is not taken within the time specified in this order, the Enforcement Officer
will notify the Ciry Council that abatement action is necessary. The City Clerk will then
schedule dates for Public Hearings before the City Council at which time testimony will be
heard from interested parties. After this hearing the City Council will adopt a resolution sta$ng
what action if any, it deems appropriate.
If the resolution calls for abatement action the Council may either order the City to take the
abatement acfion ar fix a time wittun which this nuisance must be abated in accordance with the
provisions of Chapter 33 of the Saint Paul Legislative Code and provide that if corrective action
is not taken within the specified time, the City shall abate this nuisance. The costs of this
action, including administraYive costs will be assessed against the property as a special
assessment in accordance with law.

2. Ordering the owner to remove or repair the building{s) at 977 Aurora Avenue within fifteen
(15) days from adoption of resolution.
Khai Hong Lun, the property owner, appeared. Brett Aesley and Jason Frey, 978 Aurora Avenue,
also appeared. They presented photos of the properry.
Ms. Moermond asked for a report from Mr. Magner. Mr. Magner stated the building was a one and
one-half story, wood frame, single-family dwelling with a detached one and one-half stall garage on
a lot of 7,841 square feet and had been vacant since December 7, 2007. A code compliance
inspection had been done on January 26, 2009, the vacant building registration fees were, and the
$5,000 performance bond had not been posted. On August 31, 2009, an inspection of the building
was done and a list of deficiencies which constitute a nuisance condition was developed. An order
to abate a nuisance building was posted on October 1, 2009 with a compliance date of November 2,
2009. To date, the property remained in a condition which comprised a nuisance as defined by the
Legislative Code. Ramsey County Taacation estimated the market value of the land to be
approximately $32,000 and the building to be $67,100. Real estate taates were current. Code
Enforcement estimates the cost to repair the building to be approximately $75,000 to $85,000. The
cost for demolition was estimated to be approximately $10,000 to $12,000. There had also been 14
sunimary abatements issued to this property since 2007, 13 of which went to work order: to secure
the building and the City had to board the buiiding to secure it from trespass, remove improperly
stared refuse and debris, boarding/securing, cut tall grass and weeds, and remove snow and ice.
Code Enforcement recommends the building be repaired or removed within 1S days. Mr. Magner
presented photographs of the property.
Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in
1912 and was a bungalow-style building. It had an early enclosed porch with ra8er tail ends and
was on a corner lot. It had not been surveyed and was located outside the potential Frogtown
historic district. There were a lot of vacant lots on this block with in-fill housing and a commercial
parking lot was located on the northwest corner adjacent to this house. Although it did not have any
potential as a historic resource, it did anchar the neighbarhood; therefare, she encouraged
rehabilitation of the building.
Mr. Lim stated that he purchased the house February 2009 and never received any orders to clean
up the yard. He said the lot adjacent to the house was empty and people dumped stuff on the lot.
He said he planned to rehabilitate the house; the furnace and plumbing were new and he had painted
the interior. He said he had some subcontractor's bid and planned to post the $5,000 bond.
Mr. Magner stated that this was a category 2 vacant building which required approval by DSI be£ore
it could have been sold which did not happen in this case. He said the arder to abate the nuisance
was sent in October and there was no response from the owner. The only address DSI had listed for
the owner was 977 Aurara which generally, the post office will not deliver mail to a vacant
building.
Mr. L'am responded that he did not know that he needed approval befare he could purchase the
property. He said he had another property, 60 Larpenteur, which he had been working on and was
able to complete within three months. He was now in a position to begin working on 477 Aurora.
He said he found out about this hearing from the placards on the building and called the inspectar,
Matt Dornfeld.

Ms. Moermond asked about the history of the summary abatement orders at the property and about
the vacant parcel adjacent to the property. Mr. Ma�er responded that according to the file, every
inspection resulted in a summary abatement order which went to work orders. There were only two
tall grass and weed orders which had been done by the owner. The entire pazcel is 7,841 squaze feet
and the property owner is responsible for the maintenance of both lots. Regarding 60 Larpenteur,
STAMP indicates that the ownership is still the Bank of New York. Cunently, it is only taking
Ramsey County two weeks to record change in ownership if there is clear title to the property. The
only note that they have for a diffexent address for Ivlr. Lim was under the vacant building fee file
which lists Shu Ping Teoh at 1748 McMenemy Street in Maplewood. Ae said it was the
responsibility of the property owner to notify the city with their contact informarion.
Mr. Lim responded that Shu Ping was his wife and the address in Maplewood was his residence.
He said the title company should have recorded the title and he could not understand why the
ownership wouid still list the Bank of New Yark for 60 Larpenteur.
Mr. Hesley stated that they had attempted to purchase the property at auction but believed Mr. Lim
outbid them. He expressed concern that nothing was being done with the property and that the
owner wasn't interested in it. They had tried to negotiate with Mr. Lim to sell the property to them;
however, he refused. He said tlaey had called the owner to tell him to mow the lawn in addition to
noYifying him of this hearing. Mr. Frey stated that the property was a nuisance as it was right now;
however, he believed a house on the lot was an asset to the neighborhood and did not want to see it
demolished. He said they had purchased and rehabbed many properties in St. Paul and did have the
capaciry to rehabilitate this building as well.
Mr. Magner asked Mr. Lim whether he was a licensed contractor with the State of Minnesota. Mr.
Lim responded that he was not. N1r. Magner stated that since he had pulled the building permits to
rehab the house at 60 Larpenteur, he would be required to hire a licensed contractor to do the work
on 977 Aurora. Mr. Lim responded that he was willing to hire a general contractor to do the rehab
and believed the cost of the rehab would be around $10,000. He presented an electrical bid totaling
$3,125.
Ms. Moermond expressed concern that the clty estimated the cost of the rehab to be between
$75,000 to $80,000 and he was only estimating the cost to be around $10,000. She also asked about
the collapsed retaining wall and why it had not been removed from the sidewalk. Mr. Luu
responded that he would take the retaining wall down and said that he had a friend who was a
licensed contractor who could do the work.
Mr. Hesley stated that he was a licensed contractor and had walked through the house. He believed
it would cost way more than $10,000 Yo make the repaixs to the building.
Ms. Moermond stated that the following conditions must be met in order to receive a grant of time:
1) the vacant building registration form must be filed; 2) the $5,000 performance deposit must be
posted; 3) provide a work plan, including timelines, for completing the work; 4) submit bids from a
general contractor and subcontractors; 5) provide financial documentation indicating the amount of
$70,000 to do the rehab (line of credit, construction loan, personal bank account); 6) provide an
affidavit indicating the dedication of $70,000 to be used for this project; and 7) the property must be
maintained (cinder blocks from the dilapidated retaining wall must be removed from the sidewalk).
The hearing was continued to December 8.

2. Ordering the owner to remove or repair the building(s) at 977 Aurora Avenue within fifteen
{15) days from adoption of resolution. (Continued from Nov. 24}
Khai Hong Lim, the property owner, appeared. Brett Hesley and Jason Frey, KBD Inveshnents,
978 Aurara Avenue, also appeared.
Mr. Magner reviewed the list of conditions which needed to be met as outlined in Ms. Vang's
November 25, 2009 letter.
Mr. Lim stated that after the last hearing, he met with Mr. Frey and Mr. Hesley and agreed to sell
the building to them as they had the capacity to do the rehab and he did not.
Ms. Moermond stated that the sale of the building was prohibited under the city's ordinance until
the building was completely brought up to code. She suggested they talk to an attomey to draft a
contract wherein Mr. Frey and Mr. Hesley could facilitate the rehab and the actual transfer of title
�couid be done once the certificate of code compiiance was issued.
Mr. Hesley asked whether the building's status could be changed from a category 3 to a category 2.
Ms. Moermond responded Yhat it could not. Mr. Frey stated that they had a purchase agreement
which included an addendum concerning on the sale of the property. He presented all of the
required documents—work plan, financial documentation, and a bid—as well as photos of another
property which they had recently rehabbed.
Mr. Magner suggested that they could draft a contract similar to a contract for deed wherein
ownership wouid transfer once the rehabilitation was completed and the certificate of code
compliance was issued. He said this was similar to what had occurred with the rehab of 500
Sherburne Avenue. He said that they would need to have the documents reviewed by the City
Attorney's Office; however, DSI was not opposed to such a transfer of title once the property was
brought into compliance. The main goal was to abate the nuisance condition.
Mr. Frey addressed the issue concerning the partially collapsed retaining wall and asked whether
they could wait until spring to completely repair the wa1L He said in the meantime, they would
definitely stabilize the wa11 to prevent it from further deterioration. Mr. Magner responded that the
code compliance certificate could be issued with a conection noting the retaining wall. If they
intended for this property to be rental, this item could be signed off when they obtained a certificate
of occupancy.
Ms. Moermond stated that she and Mr. Magner will review the documents submitted by KBD
Investments and will request the City Attorney review the purchase agreement, with the addendum,
to make sure everything was in order before making her recommendation to the Council on a grant
of time.
