The testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; and WHEREAS, a second hearing was held befare the Saint Paul City Council on Wednesday, February 4, 2009, at which the owner was heard. The testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 606 BUSH AVENUE. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolirion and removal of this building(s) is estimated to exceed five thousand dollars ($5,000.00). That there now exists and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). That Deparhnent of Safety and Inspections has posted a placard on the Subject Property which declares it to be a nuisance condition subject to demolition. According to our files, it has been a vacant building since 7uly 12, 2007. The current property owner is Bee Vue, per AMANDA and Ramsey county property records. The City of St. Paul has boazded this building to secure it from trespass. There have been four (4) SUMMARY ABATEMENT NOTICES since 2007. There have been three (3) WORK ORDERS issued for: - Boazding - Removal of tall grass and weeds On August 19, 2008, an inspection of the building was conducted, a list of deficiencies which constitute a nuisance condition was developed and photographs were taken. An ORDER TO ABATE A NiJISANCE BUILDING was posted on September 3, 2008 with a compliance date of October 3, 2008. As of this date this property remains in a condition which comprises a nuisance as defined by the legislative code. The Vacant Building registration fees are not paid. Amount owed is $1,000.00. Smoke Detector: Lack of properly installed and operable smoke detector. As owner, agent or responsible pariy, you are hereby norified that if these deficiencies and the resulting nuisance condition is not conected by October 3, 2008 the Department of Safety and Inspections, Division of Code Enforcement, will begin a substantial abatement process to demolish and remove the building(s). Reinforce deteriorated floor joists and provide permanent support at east end ofjoists in an approved manner. 2. Replace deteriorated basement stairway to access mechanical and plumbing equipment in approved manner. 3. Remove or replace rear entry roof structure in approved manner. 4. Provide thumb type dead bolts for all entry doors. Remove any surface bolts. 11. Repair or replace any deteriorated window sash, broken glass, sash holders, re-putty etc. as necessary. 12. Provide complete storms and screens in good repair for all door and window openings. 13. Repair walls, ceilings and floor throughout as necessary. 14. Prepare and paint interior and exterior as necessary. Observe necessary abatement procedure if lead base paint is present (See St. Paul Legislative Code, Chapter 34 for additional information). 15. Any framing members that do not meet code (where wall and ceiling covering is removed, members that are over-spanned, over-spaced, not being carried properly, door and window openings that are not headered, etc.) are to be reconstructed as per code. PLUMBING All plumbing work requires permit(s) and must be done by a plumbing contractox licensed in Saint Paul. 1. The property owner of record, Bee Vue, did not appeaz. No other parties of interest appeared. Mr. Magner stated the building was a one and one-half story, wood frame, single-family dwelling on a lot of 3,049 square feet and had been vacant since July 12, 2007. A code compliance inspection had been done on I3ovember 5, 2008, the vacant builcling registration fees were delinquent in the amount of $1,000, and the $5,000 perforxnance bond had not been posted. On Aub st 19, 2008, an inspection of the buildang was done and a list of deficiencies which constitute a nuisance condition was developed. An order to abate a nuisance building was posted on September 3, 2008 with a compliance date of October 3, 2008. To date, the property remained in a condition which comprised a nuisance as defined by the Legislative Code. Ramsey County Taxation estimated the market value of the land to be approximately $24,300 and the building to be $65,300. Real estate tases far 2008 were delinquent in the amount of $4,423.96, plus penalty and interest. Code Enforcement estimates the cost to repair the building to be approximately $50,000 to $60,000. The cost for demolition was estimated to be approximately $8,122 to $11,122. There had also been four suunnazy abatements issued to this property since 2007, three of which went to work order: to secure the building and the City had to board the building to secure it from trespass, remove improperly stored refuse and miscellaneous debris, boarding, and cut tall grass and weeds. Code Enforcement recommends the building be repaired or removed within 15 days. Mr. Magner presented photographs of the property. Ms. Moermond asked for a report from Ms. Spong. Ms. Spong stated that this building was built in approximately 1884; however, the date was unconfirxned, and it was a workers cottage-style building. It was located across from railroad property and was in a row of four identical houses with two houses being located on one lot with one outlot building on each parcel. This property had not been surveyed, there was no potential for historic designation and although it did not have any significant architectural features, she encouraged rehab. Ms. Moermond recommended the building be removed within 15 days with no option for repair. 09- i3 $ December 23, 2008 Legislative Hearing Minutes Page 2 2. Ordering the owner to remove or repair the building(s) at 606 Bush Avenue within fifteen (15) days from adoption of resolution. (Owner missed the hearing on December 9) Bee Vue, property owner, appeared and presented a work plan. Ms. Moermond noted that Mr. Vue had missed the previous legislative hearing. Mr. Maa er and Ms. Spong read their reports from the previous hearing into the record. Mr. Vue asked what address his mail was being sent to. Mr. Magner said the notice of the hearing was sent by certified mail to Mr. Bee Vue at 21301 Futman Street NE in Wyoming and 825 University Avenue West, #2 in St. Paul. He showed Mr. Vue the certified mail signed receipt and asked Mr. Vue whether it was his signature on the receipt. Mr. Vue responded that the addresses were correct and acknowledged that it was his signature on the receipt. He said that he had purchased the property in Apri12008 and believed the property tases had been paid. He said that he would need to verify this with the bank. He also said that he had rehabbed approximately 12 other buildings; he always did a good job and Jim Seeger could verify this. Ms. Moermond asked Mr. Magner about the timeline on the summary abatement orders that had been issued since Mr. Vue purchased the property. Mr. Magner responded that there was a suminary abatement arder issued to cut tall grass and weeds on July 14, 2008 that was done by Parks on July 21. Ms. Moermond expressed concern that the property taaces had not been paid, the vacant building fees had not been paid, the bond had not been posted, and the City was managing the property by mowing the lawn. Mr. Magner corrected that the vacant building fees had been paid by assessment. He said that in reviewing the work plan, he would need to see the bids from the subcontractors. He asked Mr. Vue who would be doing the general building repairs, such as the finishing work and general carpentry and if he were planning to do the work himself, whether he had a general contractor's license. Mr. Vue responded that he intended to do the work himself and that he did not haue a general contractor's license. Mr. Magner stated that accarding to the State Building Code, a property owner could pull as many building permits to do work on their own residence; however, they were only permitted to pull one additional building permit for another dwelling within a two-year time period. Since Mr. Vue had indicated that he had worked on several other properties, he would need to hire a general contractor do the rehab for this property. Ms. Moermond stated that the following must be received by December 30: 1) vacant building fees for $1,000 went to assessment; 2) real estate tases must be paid; 3) performance bond must be posted; 4) need a work plan which includes cost of labor and materials; 5) need general contractor bid and subcontractor bids; and 6) the property must be maintained.
