RESOLVED, that upon appeal of Melvin Spiegler and Sam
Spiegler from the decision of the Commissioner of Parks,
Playgrounds and Public Buildings, and upon the favorable
recommendation of the Board of Zoning, permission is hereby
granted for the extension of Commercial use to cover all of
the south 180 feet of Lot 20, Block 2, Cruickshank's Garden
Lots, except the easterly 50 feet thereof, on the north side
of East Seventh Street, between Birmingham and Hazelwood Streets,
in accordance with plans filed June 4, 1958 and plan approved
June 19, 1958.

attached appeal of Melvin and Sam Spiegler to extend Commercial use
to cover all of the south 180 -ft. of Lot 20, Block 2, Cruickshank's Garden

Dear Sir:
This is in the matter of the application of Melvin and Sam Spiegler
for an appeal to extend a permitted apartment use to cover all of the
south 180' of Lot 20; Block 2; Cruickshank's Garden Lots, except the
easterly 50''thereof. This property is located on the north side of
E. Seventh Street between Birmingham and Hazelwood Avenues.
The applicant's property has a frontage of 150' on East Seventh Street
and extends northerly to a depth of 180' and is in a single ownership.
This property has sp:1it zoning, the front or southerly 100' is zoned
Commercial and the rear 80' is zoned "A" Residence. This appeal, if
granted, would permit the applicant to construct two three story apart-
ment buildings, one with sixteen units and one with eleven units, and to
provide a 27 car off-street parking area on this property.
The rough terrain of the property to'the north has retarded the extension
of Stillwater Avenue between a point 275' west of Hazelwood Avenue and
the east line of Birmingham Avenue. The applicant's property is the
southerly 180' of a Garden lot extending a distance of two normal city
blocks north of East Seventh Street. When and if Stillwater Avenue is
opened and graded, the proposed apartment ' development would not preclude
the use for residential purposes of the portion of the land between the
north line of the applicant's property and the south line of Stillwater
Avenue extended, as minimum area requirements.of the zoning ordinance
could be met.
The adjacent land uses are as follows: north and adjacent is vacant land;
south across E. Seventh Street are two single family homes; west and ad-
joining is a vacant lot, further west is a single family residence front-
ing on East Seventh Street; east are three single family residences.
All yard and density requirements of present laws would be complied with
if this appeal is granted. In addition the Traffic Engineer has approve
the proposed layout and operation of the parking area.
In terms of the several alternative land uses permitted in a commercial
zone, the Board of Zoning finds that the proposed development would be
the most acceptable in this area. Furthermore, inasmuch as the majority
of the area affected by this appeal would be used for off- street parking

and that the proposed development would not materially affect adjacent
property, the Board feels that the intent and purpose of the Zoning
Ordinance would be substantially achieved. Therefore, the Board of
Zoning recommends that this appeal to authorize the extension of a
permitted apartment use to cover all of the applicant's property be
granted subject to all statements and conditions conveyed in the appli-
cant's appeal of June 4, 1958 and plan approved June 19, 1958.
