The property is described as the north 167.96 feet of Lot 1, Weinhagen Rearrangement. The zoning of the north 134 feet of this site is commercial, and'the balance "An Residence and has been since the adop- tion of the Ordinance in 1922. Lot 1, Weinhagen Rearrangement of Weinhagen Place was recorded on July 27, 1925. This property was developed in 1914 with a single family residence. This resi- dence has recently been moved to the southwest corner of the original Lot 1. For. many years this property'was'poorly maintained. Until recently, the grade of this lot was substantially above both St. Clair and Berkeley Avenues. It has now been graded to the approximate street grade of both streets to make the site available for the proposed development. On October 1, 1959s an appeal was made to the Council to extend a use permitted on part of this lot to the entire lot but,was later withdrawn due to the neighborhood opposition. The applicant proposes to,erect one three -story 37 unit apartment building with the majority of units being of the two - bedroom type apartment and 37 off - street parking spaces accessory thereto. In order for him to do so, it is necessary for him to appeal to extend the•commercial zoning which exists on the north 131t� feet of this lot to include 167.96 feet. It is not possible to provide the required off - street parking and 'remain within the area which is zoned commercial. This'tract has a frontage of 225:62 feet along St. Clair Avenue and a'depth of 167.96 feet, resulting'in'an area of approximately 37,895 square feet. The applicant's proposal is to-divide the 140 feet of frontage'of Lot 1 along Berkeley Avenue into two'severity foot-lots,'each with a 100 foot depth, and develop each with a single family residence. South and adjoining is 'a single - family residence fronting on Berkeley Avenue; also 140 feet of lot frontage along Berkeley which is presently vacant; east and`adjoiliing is a two - family residence front -Ing on St. Clair Avenue; north and across'St. Clair Avenue at-the corner of Wheeler Street is a single - family home fronting on Wheeler Street, west of this house is a single - family residence fronting on St. Clair Avenue, farther west on the north side of St. Clair Avenue are'*a food and meat market; a construction company office, a beauty shop, and a dry-cleaning-establishment; west -and adjoining is a new two and one -half story brick and stucco'apartment building which front's on St. Glair Avenues farther west St. Clair Avenue is developed commercially. Unit Investment Company - Field investigation discloses that the proposed extension of use would not be detrimental to the neighborhoods and that a more favorable development may be achieved through this extension. The proposed development meets the recom- mended standards for 'density and building ground coverage. In the opinion of the Board; a commercial development of a portion of this tract would have an adverse effect on the neighborhood. As a result of the opposition to rezoning the south half of the lot which fronted on Berkeley Ave. the application was withdrawn. The Unit Investment Company has now made a new application for rezoning this property for commercial use, except that portion 100 feet deep fronting on Berkeley Ave. This will leave a plot of ground 100 feet deep and about 170 feet wide fronting on Berkeley Ave. and remaining as a first residence zone. This would not be objectionable in itself if these people planned on dividing it into attractive lots and developing it by construction of sub- stantial residences. The mere platting into lots and offering them for sale does not offer us any assurance, as people would no doubt be very hesitant in purchasing these lots which would abut the parking area to the north for the same reason that we objected to the parking area as a nuisance in the first application. If the Council could protect us by giving assurance or requiring that the property fronting Berkeley would be developed with residences in keeping with the balance of the Berkeley Ave. properties, I an sure there would be little objection. Lacking this assurance, and faced with the possibility that the Unit Investment`Company will let the property facing Berkeley Ave. remain in its present deplorable state until it feels it has an opportunity to push through a further rezoning, we strongly protest the instant'applica- tion of the Unit Investment Company. Subsequently the appeal was withdrawn and no action was taken by the Commission. We received another notice of appeal by the Unit Investment Company to rezone a portion of the Lot 1, Weinhagen Rearrangement. As we understand the proposal, two lots facing Berkeley Avenue would be reduced to 100 feet in depth and would be restricted to residential use. As stated in my letter regarding the original proposal.. I and eighteen of my. neighbors, who own their homes, are very concerned over the prospect of having the value of our property depreciated and having to live with'the noise and commotion generally connected with a project of this proportion. I am opposed to any change in the zoning classification of any portion of this property unless there is positive and tangible evidence that residential dwellings will be constructed on the lots facing Berkeley Avenue.
